About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form used for solicitations, sources sought notices, and requests for information.

The form is a self-certification document for offerors responding to Indian Health Service (IHS) contract opportunities under the authority of the Buy Indian Act (25 U.S.C. 47). Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" (HHSAR 326.601) with Indian ownership. The enterprise must maintain eligibility at three critical junctures: at the time of offer submission, at contract award, and throughout the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. The form requires the offeror to provide the name of the federally recognized tribal entity, business name, UEI number, name of the 51% owner of the IEE firm, and a certifying signature with printed name. Contracting Officers may require documentation of eligibility prior to awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. All successful offerors must be registered with the System of Award Management (SAM). The form warns that false or misleading information submitted in offers is a violation of law punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The specific solicitation referenced is 75H70526Q00020 for a Digital Storytelling project dated 07/28/2026.
