About this file

This is a blank Indian Economic Enterprise Representation Form required by the Indian Health Service (IHS) for the Buy Indian Act set-aside solicitation 246-26-Q-0026. The form serves as a self-certification document that allows offerors to declare whether they meet the definition of an "Indian Economic Enterprise" (IEE) as defined under 25 U.S.C. 47 and HHSAR 326.601. Offerors must certify their eligibility at three critical junctures: when submitting an offer, at the time of contract award, and throughout the full contract performance period. The form requires the offeror to identify the federally recognized tribal entity and the individual or entity holding 51% ownership of the IEE firm, along with business name, certifying signature, DUNS number, and printed name of the certifying official.

The representation form emphasizes that offerors must maintain IEE eligibility throughout all contract phases and must immediately notify the Contracting Officer if eligibility status changes at any point. Successful offerors must also maintain active registration in the System of Award Management (SAM). The form carries significant legal weight, as false or misleading information constitutes a violation of federal law under 18 U.S.C. 1001, with potential penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287 for false claims made during contract performance. Individual Contracting Officers may require supporting documentation of IEE eligibility before award, and awards may be subject to protest if the successful offeror's eligibility is questioned.
