Shall not be binding or enforceable against the State; and
May be subject to other terms and conditions agreed to by the Contractor and the purchaser.
2.1.6 All Contract prices, terms, and conditions must be provided to any Maryland local government or nonprofit entity requesting services under the Contract. The Contractor bears the risk of determining whether or not a government, agency or organization with which the Contractor is dealing is a State entity.
2.2 Background and Purpose
The MDOT MTA is one of the largest multi-modal transit systems in the United States. A. A full shelter is assumed to ship as a complete shelter with all necessary parts, glass, hardware, and a three-seat bench that is ready for installation as a complete unit.
B. To maintain a uniform inventory the Contractor shall supply MDOT MTA with Enseicom shelters or an approved equal.
C. Currently, the MTA primarily uses two types of Enseicom shelters, Barrel Single Shelter (Model S 040) and Cantilever Shelter (Model S 010). “Cantilever” shelters have two legs in the rear of the shelter and in addition to the standard side glass panel must be able to utilize side panels in different width. For uniformity, at a minimum the cantilever shelter must be able to use 36” wide side panels to allow for installing in confined locations. The standard side glass panel for the barrel shelter is 54-1/8” x 84-15/16” x 3/8” thick. The standard/uniform rear glass panels for both the Barrel and the Cantilever shelters are 41-3/16” x 81” x 3/8” thick. Contractor shall submit shop drawings and samples that show sufficient size and detail to evaluate the finished product characteristics prior to awarding the contract.
F. To ensure sufficient time for MDOT MTA to review and approve an alternate shelter the contractor must submit all relevant information on the alternate shelter during the question-and-answer period, prior to the deadline set for written questions. MDOT MTA will then decide and issue the response as part of the official answers and/or addendum prior to the bid due date. Such requests should be emailed to Procurement Officer at hmartin@mdot.maryland.gov.

4.12.2 Bidders shall acknowledge the receipt of all addenda to this IFB issued before the Bid due date.
4.12.3 Failure to acknowledge receipt of an addendum does not relieve the Bidder from complying with the terms, additions, deletions, or corrections set forth in the addendum, and may cause the Bid to be deemed not responsive.

If applicable, the Bidder’s Bid shall contain an explicit statement, signed by an authorized representative of the parent organization, stating that the parent organization will guarantee the performance of the subsidiary.
4.16.3 A parental guarantee of the performance of the Bidder under this Section will not automatically result in crediting the Bidder with the experience or qualifications of the parent under any evaluation criteria pertaining to the actual Bidder’s experience and qualifications. Instead, the Bidder’s responsibility will be assessed to the extent to which the State determines that the experience and qualifications of the parent are applicable to and shared with the Bidder, any stated intent by the parent to be directly involved in the performance of the Contract, and the value of the parent’s participation as determined by the State.
