BIDDER RESPONSIBILITIES & THE BID PACKAGE

Bidders are solely responsible for understanding the scope of work and all requirements, terms, conditions, evaluation criteria, etc., before submitting a bid. If the language is unclear or ambiguous, it is the bidder’s responsibility to request clarification or assistance before submitting a bid. If the IFB is modified prior to the final bid submission date, the State will issue an addendum to all bidders that received a bid package.

Bidder shall provide rate(s) on Budget Proposals (Exhibit B-1.1 through B-1.5). Bidder shall set forth rates in clear, legible figures in the spaces provided in Exhibit B-1.1 through B-1.5. Failure to provide the required rates shall be cause for rejection of your bid.

3. The Small Business Preference (five percent (5%) up to $50,000) may be combined with the DVBE incentive but will not exceed a combined total of $500,000.

4. The DVBE incentive is computed from the lowest responsive and responsible bid price.

SMALL BUSINESS PREFERENCE PROGRAM

Current law requires state departments to support the success of small businesses, including microbusinesses, in participation in contracting opportunities. CDCR is committed to supporting Small/Micro Business participation in state contracting and seeks to contract with certified Small/Micro Businesses whenever possible.

A Small/Micro Business enterprise is defined as a business certified by the Department of General Services (DGS), Office of Small Business and Disabled Veteran Business Enterprise Certification Services (OSDS) in which:

1. The principal office is located in California

2. The officers are domiciled in California

3. The business is independently owned and operated

4. The business, with any affiliates, is not dominant in its field of operation; and

a. For Small Business, either:

(1) The business, together with any affiliates, has one hundred (100) or fewer employees and averaged annual gross receipts of $16,000,000 or less over the previous three years, or

(2) The business is a manufacturer with one hundred (100) or fewer employees

b. For Micro Business, either:

(1) The business, together with any affiliates, has twenty-five (25) or fewer employees and averaged annual gross receipts of $5,000,000 or less over the previous three years, or

(2) The business is a manufacturer with twenty-five (25) or fewer employees.

Section 14835, et seq., of the California Government Code requires that a five percent (5%) preference be given to bidders who certify as a Small/Micro Business enterprise. The rules and regulations of this law are contained in Title 2, California Code of Regulations, Section 1896, et seq. A copy of the regulation is available upon request.

To claim the Small/Micro Business preference, which may not exceed $50,000 for any bid, your firm must:

1. Have a completed application (including proof of annual receipts) on file with the DGS, OSDS, by

5:00 p.m. on the date bids are due, and

2. Receipt of documents verified by such office.

Therefore, if you are a Small/Micro Business, but are not certified, it is to your advantage to become certified. For certification and preference approval process information, contact the OSDS by telephone at (916) 375-4940 or access the OSDS Internet website at Apply for or Re-Apply for Certification as a Small Business and/or Disabled Veteran Business Enterprise.

NON-SMALL BUSINESS PREFERENCE REQUEST

Pursuant to Title 2, CCR Section § 1896, et seq., and GC Section § 14838, et seq., a bid preference of five percent (5%) is available to a responsive non-small business claiming no less than twenty-five percent (25%), Small Business/Micro Business (SB/MB) subcontractor participation with one or more SB/MB enterprises. This preference is considered only if the tentative low bidder is not a certified SB/MB.

In granting the Non-Small Business Preference, no bid price will be reduced by more than $50,000. This preference cost adjustment is for bid evaluation purposes only and does not alter the actual cost offered by the bidder.

A non-small business is defined as a responsive/responsible bidder that is not certified by the DGS OSDS as a SB/MB enterprise.

To be eligible for the non-small business preference, the business prime vendor must complete and submit the Non-Small Business Preference Request and Subcontractor Acknowledgement form (OBS

555) with their bid proposal.

NONPROFIT VETERAN SERVICE AGENCY (NVSA) SMALL BUSINESS

PREFERENCE

Pursuant to Military and Veteran Code Section 999.50 et seq., Nonprofit Veteran Service Agencies (NVSAs) claiming Small/Micro Business preference and verified as such in the relevant category or business type, will be granted a preference of five percent (5%) of the lowest responsive bid, if the lowest responsive bid is submitted by a bidder not certified as a Small/Micro Business.

In granting Small/Micro Business preference to NVSAs, no bid will be reduced by more than $50,000.

The preference cost adjustment is for computation purposes only and does not alter the actual cost offered by the bidder.

To be eligible for the NVSA Small/Micro Business Preference, the business concern must:

1. request preference at the time of bid submission, and

2. must possess a valid certification prior to bid submission.

An SB/NVSA is not subject to the same standards as other certified Small/Micro businesses. SB/NVSA standards are identified in Military and Veterans Code Section 999.51(a) (3).

IDENTIFICATION OF CONTRACTORS, SUBCONTRACTORS, CONSULTANTS:

SMALL/MICRO BUSINESS AND DVBES

CDCR must identify all contractors, subcontractors, and consultants who will provide labor or render services in the performance of this Agreement and further identify whether any of the listed subcontractors and consultants are a certified Small/Micro business, or a certified DVBE. Therefore, the bidder must complete a Bidder Declaration (GSPD-05-105). If any changes occur in the submitted original GSPD-05-105, the Contractor shall notify the Office of Business Services (OBS), in writing within ten (10) working days of those changes, including any changes to Small/Micro business or DVBE status.

https://www.dgs.ca.gov/PD/Services/Page-Content/Procurement-Division-Services-List-Folder/Certify-or-Re-apply-as-Small-Business-Disabled-Veteran-Business-Enterprise https://www.dgs.ca.gov/PD/Services/Page-Content/Procurement-Division-Services-List-Folder/Certify-or-Re-apply-as-Small-Business-Disabled-Veteran-Business-Enterprise

Therapeutic Communities Services

I. INTRODUCTION

A. General Information The California Department of Corrections and Rehabilitation (CDCR), Division of Rehabilitative Programs (DRP) is committed to providing rehabilitative treatment and services to participants in the Youth Conservation Camps (YCC) throughout the state of California.

The YCC serves low to high needs participants between the ages of 17.6 to 25 years of age who meet the criteria for housing and programming in the least restrictive environment. Aligned with a variety of reforms, YCC continues to implement a therapeutic model where staff, families, volunteers, and Community Based Organizations/Partners share a set of common values supporting positive youth development. A key goal in ensuring progress at YCC is improving the cohesive, community environment that permits youth to grow, develop new skills, and encourages leadership development immersed in positive experiences and helping others.

Learning opportunities during their rehabilitative period should be linked with the development of affirming experiences building upon relationships with pro-social adults. The starting point for skill building is discovering and building on the strengths of the participants, not the participant’s limitations, allowing participants to grow, change and eventually return safely and productively to the community.

B. Extension/Expansions/Reductions If it is determined to be in the best interest of the State, upon agreement between CDCR and the Contractor, the State may extend this Agreement through an amendment for up to two (2), optional one (1) year terms. The services for the extended period shall be provided at the rates specified in Exhibit B-1.4 and Exhibit B-1.5, Budget Proposal (Optional Year) submitted with the bid.

If additional funding is made available during the term of this Agreement, CDCR reserves the right to expand the contracted program services to include adding new program types. If the contracted services are expanded, staffing levels shall be permitted to increase proportionately and consistently with the terms of the original Agreement. Expansions will require an Amendment to the Agreement and are at the sole discretion of CDCR.

CDCR reserves the right to reduce the contracted services, which may include a decrease in the number of participants or an adjustment in the length of treatment for each participant. If the contracted services are reduced, staffing levels shall be permitted to decrease proportionately and consistently with the original Agreement. Reductions will require an Amendment to the Agreement and are at the sole discretion of CDCR.

C. Transition of the Agreement to a Successor The Contractor shall have a plan for transition of participants, records, and data to a successor.

The plan shall include the steps that will be taken prior to expiration or termination of this Agreement. The plan shall specify what steps the Contractor will take after termination of the Agreement to continue to provide data and assistance to the successor for a minimum of six (6) weeks after the termination date.

The plan must be approved by the DRP Program Analyst (PA) and updated as requested by the DRP PA during the term of this Agreement. The draft plan is due to the DRP PA within sixty

(60) calendar days of Agreement execution.

II. YOUTH CONSERVATION CAMP LOCATION

The Contractor, with oversight by CDCR, shall provide various treatment interventions and re-entry services at each Youth Conservation Camp (YCC) location, identified in Attachment 1, Youth Conservation Camp Locations.

The services provided will require working with participants between the hours of 9:00 am to 9:00 pm, Monday through Friday, and on Saturday and Sunday between the hours of 9:00 am to 9:30 pm. During fire season, services will be provided Monday through Friday between the hours of 5:30 pm to 9:30 pm. Weekends will require working with and supporting participants that are dispatched to remote locations. The Contractor, with support from the DRP PA and Cal- Fire, will develop opportunities for innovative service delivery for participants who are away from the camp for short term and extended periods of time during fire season and other emergency responses. The Contractor shall employ personnel who can adapt to sudden changes in participant availability and are open to providing services on weekends and after traditional 8:00 am to 5:00 pm work hours Monday through Friday.

A. Holidays

The Program will not operate, and contract staff shall not report to YCC on any holidays observed by the State of California. Currently, the State observes the following holidays:

New Year’s Day, Martin Luther King, Jr. Day, Presidents’ Day, Cesar Chavez Day, Memorial Day, Independence Day, Labor Day, Veteran’s Day, Thanksgiving Day, the Day after Thanksgiving, and Christmas Day. If the holiday falls on a Saturday, there will be no program closure. If the holiday falls on a Sunday, the holiday will be observed, and the program will be closed on the following Monday.

The Contractor shall work with the YCC to develop and conduct specific activities during holiday seasons, which can be stressful to participants.

B. Activation

Upon Agreement execution, the DRP PA will work closely with the Contractor, who shall assign one (1) individual hired as an Engagement Director (ED) to serve as the primary contact for all aspects of the contract and engagement with the participants. The ED will oversee the work performed by any subcontractors and meet with YCC staff during the development phase of the Therapeutic Communities’ Plan of Action (TCPA). The TCPA shall be completed, and a copy sent to the DRP PA within thirty (30) calendar days of Agreement execution.

III. PROGRAM SERVICES APPROACH

A. Program Environment

The Contractor shall provide a program model and environment that is therapeutic in nature, structured and includes a daily regimen that promotes positive change for the participants at the YCC. This model fundamentally differs from traditional command and control correctional approaches. By purposeful and consistent application of behavioral and learning principles, the model must support the development of new skills and behaviors that will assist participants through the transition period and upon community re-entry. The program should be designed for the developmental stage of participants between the ages of 17.6 to 25.

Intervention shall be specifically designed to promote aspects of development in a strength-based environment, built on a foundation of acceptance and respect.

B. Cultural Competence The Contractor shall operate a culturally competent program. Cultural competence refers to the process by which individuals and systems respond respectfully and effectively to people of all cultures, languages, classes, races, ethnic backgrounds, disabilities, religions, genders, sexual orientation and other diversity factors in a manner that recognizes, affirms and values the worth of individuals, families and communities and protects and preserves the dignity of each. Five (5) essential elements contribute to a system’s ability to become more culturally competent. The system should (1) value diversity, (2) have the capacity for cultural self-assessment, (3) be conscious of the dynamics inherent when cultures interact, (4) institutionalize cultural knowledge, and (5) develop programs and services that reflect an understanding of diversity between and within cultures.

C. Stages of Change

The Contractor shall apply the Stages of Change model, also known as the transtheoretical model for behavior change. This model has been widely applied across such disparate areas as tobacco cessation, weight loss, substance addiction, and criminogenic needs. The five-stage model is used to assess an individual’s readiness for behavioral change and provides a collaborative, step-by-step process for setting and achieving goals and objectives. It is important to be aware of the Stages of Change in order to effectively interact with the participants and set realistic goals. The stages, progressing from Pre-contemplation (Not willing to make a change); Contemplation (Uncertain about change, ambivalent); Preparation (Ready to make a change soon; committed); Action (Doing something different) and Maintenance (Hanging on to change).

D. Mental Health Services

Trauma and incarceration are interrelated issues in the lives of participants. The Contractor shall understand the principles of trauma-informed services related to anxiety and stress that the participants experienced prior to incarceration, during incarceration, while on the fire lines, prior to being discharged, and all experiences which may trigger related responses, including anger. Services need to focus on several areas, including confrontation of negative behaviors, beliefs, and attitudes; assessment of current relationships; reinforcement of positive behavior and habits; development of strategies to address frustration and anxiety, building tolerance;

and development of higher stages of moral reason leading to changes in overall behavior.

E. Motivational Interviewing Techniques

The Contractor shall use motivational interviewing techniques in the delivery of program services.

IV. REQUIRED PROGRAM COMPONENTS

CDCR is seeking to enact a Therapeutic Community (TC) program within YCC that facilitates a rigorous re-entry and transitional planning component. The program shall utilize evidence-based principles. The primary goal of the program is to help participants develop and access the necessary skills, tools, and resources to successfully transition back into the community.

In addition, when appropriate, there should be a restorative justice component involving participants and their victims in guided and healthy discussions that focus on accountability, victim restoration, and community restoration.

YCC identifies a TC as a small group of participants who receive immersive treatment as a unified cohort that learn and grow together, through group and individual therapeutic work, to desist from criminal behavior and become thriving and engaged members of their communities.

The population that CDCR serves frequently have a problematic relationship with substance use due to their prior traumas, potential familiar relationship with addiction, ongoing cognitive development and risk taking, and drug experimental behaviors. The Contractor shall provide services that address the unique nature of the adolescent offender, as well as the many multicultural and intergenerational struggles that may exist within this population.

To facilitate a successful therapeutic community, the Contractor shall provide an evidence-based program which includes components addressing the following:

a. Restorative Justice

b. Violence Interruption

c. Substance Use Disorder Counseling

d. Re-Entry and Transitional Planning

e. Criminal Thinking

f. Positive Reinforcement/Motivational Incentives

g. Performance Measures

A. Restorative Justice Healing Initiative

Restorative Justice programming is a critical component of TC services. YCC staff, volunteers, and contract staff with a history of victimization may also participate in restorative justice conferencing held at camp. Staff participation will be voluntary.

Restorative justice conferencing will be held to reduce the likelihood of future offenses;

target discussions to foster accountability, empathy, community identification, and other pro-social behaviors among participants; increase participant victim confidence in the juvenile justice system; and heal individual negative experiences for each participant and their victims.

B. Violence Interruption

A critical element of a successful community is the provision of a physically and psychologically safe environment by identifying and utilizing interventions based on the principals of Cognitive Behavioral Therapy (CBT). YCC is engaged in numerous efforts to maintain a safe and secure rehabilitative space; however, as is to be anticipated with this population, learned aggressive survival behaviors and gang dynamics can intermittently interfere with the therapeutic environment. Therefore, violence prevention is a key component of program services and shall address aggression, impulse control, hostility, anger and violence and how to best interrupt conflict cycles. The program services shall focus on solving issues through the application of violence interruption techniques such as mediation, behavior change and the rewriting of the cultural and violence-free norms among the participants for them to engage within the therapeutic community, YCC community, and external community.

C. Substance Abuse Counseling

Participants with substance use disorder/usage will learn to understand the effects and the root causes of their drug and alcohol use and/or addiction as well as learn strategies on how to live a life free of a substance use disorder. Participants will learn how to effectively manage stress, anxiety, and triggers that lead to drug and alcohol usage and criminal activity. Small group and individualized interventions will also emphasize positive lifestyle changes, relapse management, domestic violence, and conflict resolution. The participants will be provided direction and support to build a solid foundation for long-term recovery while at the YCC and upon their release into the community.

D. Re-Entry and Transitional Planning

The Contractor shall provide a re-entry and transitional planning component that includes, but is not limited to, coordination between participants and contract staff at the YCC to share critical information, support, and resources, including job or career placement to include probation/parole staff whenever possible. It is also required that the Contract staff assist in the creation of a re-integration plan to help participants engage in thoughtful, individualized reentry planning, to include housing, education, employment, wellness and health services.

E. Criminal Thinking

A key component of the TC is helping participants learn new skills and replace old habits that led to their criminal behavior. The Contractor shall provide interventions based on the principles of CBT that will be utilized to encourage participants to change their antisocial thinking, criminal behaviors, moral reasoning, moral development, reasoning and behavioral traits, narcissism, resistance to changes, and defensive attitudes that lead to criminal activity. The Contractor shall utilize evidence-based CBT curricula to address criminal thinking as recognized by National Institute of Corrections (NIC), Substance Abuse and Mental Health Services Administration (SAMHSA), or another accredited agency.

F. Performance Measures

Each of the program components shall be evaluated to determine efficacy. The Contractor shall establish a plan that details the outcome measures for each program component and describe how it will determine the progress of each participant as related to their individual goals. The plan shall be provided to the DRP PA within thirty

(30) calendar days of Agreement execution.

G. Positive Reinforcements and Motivational Incentives

The Contractor shall incorporate non-paid incentives inclusive of certificates, graduation ceremonies, game nights, snacks, music/art activities, holiday with family focused activities, and other incentive related activities approved by the YCC Superintendent.
