About this file
This is a Darfur Contracting Act Certification form issued by the California Department of General Services Procurement Division for use in state contract bidding. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on State of California contracts. Bidders must certify their compliance status regarding scrutinized company designations under Public Contract Code Sections 10475-10481. The form pertains to IFB #S26-33345 for Vending Machine Relocation, Installation, Removal, Service and Repair in San Diego and Imperial Counties, which requires contractors to provide comprehensive vending machine services including repairs of coin mechanisms, bill acceptors, spiral motors, control and display boards, sensors, electrical components, and disposal of surveyed equipment through approved recycling centers.
Bidders have two certification options available. Option #1 allows companies to certify under penalty of perjury that they are not scrutinized companies as defined by Public Contract Code Section 10476, provided they have had international business activities within the previous three years. Option #2 is available for scrutinized companies that have obtained written permission from the Department of General Services to submit a bid or proposal on a case-by-case basis if determined to be in the best interest of the state. Both options require completion of company name, Federal ID Number, authorized signature, and printed name and title of the signing official. The certification must be included with the bid or proposal submission, and companies without any international business activities in the previous three years are exempt from this requirement.
