About this file

This document is a Darfur Contracting Act Certification form issued by the California Department of General Services (DGS) Procurement Division. The form is designed for companies that have conducted business activities outside the United States within the previous three years to certify their eligibility to bid on or submit a proposal for a State of California contract. The document provides two options for compliance: Option #1 allows companies to certify they are not a "scrutinized company" under penalty of perjury, while Option #2 is for scrutinized companies that have obtained written permission from the Department of General Services to submit a bid or proposal.

The certification process is tied to Public Contract Code Sections 10475-10481, which apply to companies with international business operations. Companies must disclose their status and either certify they are not a scrutinized company or provide documentation of written permission from DGS to participate in state contracts. The form requires companies to provide their vendor name, Federal ID Number, and an authorized signature, with the understanding that making a false certification could result in legal consequences. The document is specifically related to contracting restrictions connected to activities in the Darfur region and serves as a mechanism for the State of California to manage and control international business interactions in state procurement processes.
