About this file

This is a template form used by the Indian Health Service (IHS) to obtain self-certification of Indian Economic Enterprise (IEE) eligibility under the Buy Indian Act (25 U.S.C. 47). The form is issued in conjunction with Sources Sought Notices, Requests for Information (RFI), or formal Solicitations, and serves as part of the offeror's response package for potential contract awards.

Offerors must certify that their enterprise meets the definition of an "Indian Economic Enterprise" with Indian ownership as defined in HHSAR 326.601. The enterprise must maintain this eligibility status at three critical junctures: at the time of offer submission, at contract award, and throughout the entire contract performance period. Contractors must provide immediate written notification to the Contracting Officer if eligibility is lost at any point. The form requires the offeror to provide the name of the federally recognized tribal entity, the 51% owner of the IEE firm, business name, UEI SAM number, and a certifying signature with printed name. Individual Contracting Officers may request documentation of eligibility prior to set-aside or sole source contract awards, and awards are subject to protest if the offeror's eligibility is questioned. False or misleading information submitted in connection with a Buy Indian Act set-aside is punishable under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729–3731 and 18 U.S.C. 287. Successful offerors must also maintain active registration in the System of Award Management (SAM).
