About this file

This Request Form to Division of Purchasing (DOP) Exemption from Competition (Form 379) was submitted by the Idaho Division of Vocational Rehabilitation (IDVR), with requestor Ryan Waddell, seeking an exemption from competitive procurement for wheelchair accessible vehicle modification conversion services. The procurement is for a one-time purchase to provide a specialized All-Terrain Conversion (ATC) with Electronic Mobility Control (EMC) modifications to enable a participant with a C5 spinal cord injury to operate a manual wheelchair-accessible vehicle. The exemption request was submitted on June 16, 2025, with anticipated approval by June 24, 2025, and the opportunity was posted for public review to allow suppliers to provide information supporting or contradicting the claimed need for exemption from competition.

The anticipated total cost of the vehicle modification is $199,250.00, with United Access, LLC identified as the proposed supplier. IDVR asserts that competition would be impractical and disadvantageous because most vehicle modification installers do not offer both EMC and ATC modifications, and safety risks exist when conversions are performed by suppliers lacking National Mobility Equipment Dealers Association (NMEDA) certification. The agency documented that two other regional providers—Access Vans (Idaho-based) and MobilityWorks (Salt Lake City)—declined the referral due to lacking required certifications or capabilities. The EFC Administrator indicated intent to approve the exemption pending legal notice. No set-asides are designated for this procurement.

My Agency wishes to administer or award a solicitation at a dollar amount above its normal Delegated Purchasing Authority (Limited/One-Time DPA)

The property required is available on one or more open contracts, but my Agency wishes to purchase from a different vendor. A solicitation is being developed (by my Agency under its DPA or in conjunction with DOP) and my Agency wishes to limit responses to a specific manufacturer/brand name (I.e. no substitutions). Background * Describe the circumstances

In 2022 the participant sustained a C5 spinal cord injury resulting in quadriplegia. He has an existing driver’s license but requires a modified vehicle to allow him to drive. He will drive from a manual wheelchair. This will allow for ongoing independence, as well as completion of both academic and vocational goals. A comprehensive behind-the-wheel driving evaluation with a Certified Driving Rehabilitation Specialist (CDRS) prescribed an All-Terrain Conversion (ATC) with Electronic Mobility Con

Justification * Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?

Many vehicle modification installers do not offer both EMC and ATC modifications, therefore they would decline to accept the referral. Safety risks are posed if conversions were to be performed by suppliers that are not NMEDA certified dealers.

Description * Describe the extent to which competition is possible

Idaho based mobility equipment supplier, Access Vans, declined to accept the referral as they are not qualified to perform EMC installations.

MobilityWorks in Salt Lake City also declined, as they do not currently have an EMC certified installer on staff and do not perform ATC vehicle conversions. Due to the need for both ATC and EMC capabilities, as well as NMEDA certifications, there is limited to no provider competition available.

The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State.
