About this file
This is an Exemption from Competition Request Form submitted by the Idaho Department of Correction (IDOC) to the Idaho Division of Purchasing (DOP) for the direct procurement of Urine Analysis Testing services. The request, submitted on April 18, 2025, by Destinie Hart (dhart@idoc.idaho.gov, 208-658-2176), seeks authorization to award a one-time contract to AverHealth for urine analysis testing services in Probation and Parole District 2. The contract is anticipated to terminate in October 2025, with an estimated total cost of $60,000.00. IDOC's previous contracted urine analysis vendor in District 2 discontinued service, creating an immediate need for a replacement provider to maintain operational continuity and facility safety.
IDOC justifies the exemption from competition based on the impracticality of completing a competitive solicitation process before the planned statewide ITB release later in 2025. AverHealth, already contracted in Districts 1, 6, and 7, is familiar with IDOC's processes and operational requirements, reducing implementation risk and timeline. The proposed rate is $18.95 per test, with testing performed at IDOC facilities by AverHealth staff. The exemption rationale emphasizes the urgency of establishing vendor services, the efficiency of utilizing an incumbent provider with demonstrated performance history, and the strategic timing to consolidate separate district contracts into a single statewide vendor procurement. The DOP Administrator has indicated intent to approve the exemption pending legal notice, with the request scheduled for posting before final approval.

Exemption from Competition
IDAPA 38.05.01.042.05 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to:
special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.
Proposed Supplier * Enter Unknown if supplier is not known
AverHealth
Duration *
One-Time purchase Ongoing
Anticipated Total Cost * $60,000.00
Background * Describe the circumstances
IDOC's contracted UA vendor in Probation and Parole District 2 was unable to fulfill the contract and the contract has been discontinued. IDOC is in immediate need of a UA provider in District 2.
This field has a 300 character limit
Justification * Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
IDOC would like this temporary contract to end in Oct 2025, aligning with the timeline of the other district UA contracts, with the intent to release an ITB soliciting a statewide provider rather than separate providers by district in order to streamline our processes and provide testing consistency across the state. IDOC requests an exemption from competition to use AverHealth in District 2 (this vendor is also contracted in districts 1, 6, and 7) at a rate of $18.95/test where tests are performed at IDOC facilities by AverHealth staff. Due to the need for a shorter-term contract, the benefit of a vendor familiar with IDOC processes, and the urgency of establishing a vendor in District 2 to maintain order and safety, IDOC requests your consideration of this one-time exemption.
Description * Describe the extent to which competition is possible
By the time a new ITB had been released and a contract awarded, it would be nearing the time that IDOC will release an ITB for a statewide UA vendor to serve all districts.
Agency Certification *
The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State.
