About this file

This document is an Invitation to Bid (ITB) for a Non-Commercial Thinning (NCT) project on the Payette National Forest in Idaho. The project is managed by the Idaho Department of Lands (IDL) and consists of two areas - Sloan's Point (1,357 acres) and Big Creek 2 (276 acres) - with a combination of thin and scatter and thin and pile treatments. The bids are due by 12:00 PM MT on November 9, 2023, and a public bid opening is scheduled for that same day at 3:00 PM MT. A virtual pre-bid meeting will be held on October 16, 2023, and questions are due by October 20, 2023. The anticipated contract award date is November 21, 2023, and the contract period runs through October 31, 2025.

The bid will be awarded to the lowest responsive and responsible bidder. Pricing will be based on a price per unit of measure, and the final payment will be determined by the work quality percentage. Contractors must show they have sufficient equipment and work crews to complete the work by the specified timeline. Subcontracting is allowed with prior approval from IDL. Camping and fire prevention requirements are outlined, and the contractor must comply with all applicable laws and regulations.

STANDARD INFORMATION

ADDENDA

It will be the respondent’s responsibility to check for any addenda prior to submitting a bid.

In the event it becomes necessary to revise any part of the solicitation documents, addenda will be made available. Information given to a respondent will be available to all other respondents if such information is necessary for purposes of submitting a or if failure to give such information would be prejudicial to uninformed respondents.

BURDEN OF PROOF

ANY VARIATIONS of brand names or deviations from the specifications MUST BE CLEARLY STATED. It shall be the responsibility and burden of the submitting vendor to furnish the State WITH ITS ORIGINAL SUBMISSION sufficient data to determine if the goods or services offered conform to the specifications.

VERBAL INFORMATION

The State will not be responsible for any verbal or oral information regarding a bid.

DISQUALIFICATION AND AWARD INFORMATION

The state reserves the right to make reasonable inquiry to determine the responsibility of a contractor. Such requests may include but not be limited to financial statements, credit ratings, statements of experience and past performance, references, etc. Successful contractors must show to the satisfaction of the Idaho Department of Lands that they have sufficient equipment and work crews to complete the work contracted by the time specified. The unreasonable failure of a contractor to promptly supply information in connection with such a request is reason for disqualification. Except as otherwise provided by law, information furnished by the contractor pursuant to this provision may not be disclosed outside the Idaho Department of Lands without prior written consent of the Contractor. Disqualification of a high-ranking contractor may be pursued when their reputation, experience or references are such as to create a doubt about satisfactory job completion or if the bids are considerably below Department estimates and the other bids.

The purchasing agent will contact the contractor and request that they disqualify themselves by withdrawing in writing. If the contractor refuses to withdraw, the purchasing agent may notify the contractor in writing or email that the Department will not offer the contractor a contract and proceed with an award to the next responsible contractor.

PARTNERSHIPS

Contractors responding as partners must furnish the Idaho Department of Lands the name of the partnership, names of the partners, and the partnership's federal taxpayer ID number. All payments will be made to the partnership.

INTERNAL REVENUE SERVICES REPORTING REQUIREMENT

Contact the Idaho Industrial Commission with any Worker’s Compensation questions.

Any contractor who hires employees to accomplish the contracted work must provide a certificate of worker’s compensation insurance.

PREFERENCES

Section 67-2349, Idaho Code, requires application of a preference in determining which contractor submitted the lowest responsible bid. If the contractor who submitted the lowest bid is domiciled in a state which has a preference law that penalizes Idaho domiciled contractors, then the State must apply a preference. The penalty applied to out-of-state contractors competing against Idaho contractors is determined by the penalty applied by the contractor’s domiciliary state to its out-of-state contractors.

In determining domicile, the following “rule of thumb” will be used: Corporations – the state in which the corporation is chartered or incorporated; Sole proprietor or partnership

– the state in which the permanent headquarters of the business is located.

A contractor domiciled outside the boundaries of the state of Idaho may be considered as an Idaho domiciled contractor provided that there exists for a period of one year preceding the date of the bid a significant Idaho economic presence as defined herein. A significant Idaho economic presence shall consist of the following: (a) That the contractor maintains in Idaho fully staffed offices, or fully staffed sales offices or divisions, or fully staffed sales outlets, or manufacturing facilities, or warehouses or other necessary related property;

and (b) if a corporation, that it be registered and licensed to do business in the state of Idaho with the Office of the Secretary of State.

REJECTION OF BIDS AND CANCELLATION OF BID SOLICITATION

Prior to the issuance of a contract, the State shall have the right to accept or reject all or any part of a bid when: (i) it is in the best interests of the State of Idaho; (ii) the bid does not meet the minimum bid specifications; (iii) the bid is not the lowest responsible bid; (iv) a finding is made based upon available evidence that a respondent is not responsible or is otherwise incapable of meeting specifications or providing an assurance of ability to

IDL LUMA EVENT #156 6 of 36 SLOAN'S POINT & BIG CREEK NCT fulfill contract requirements; or (v) the item offered deviates to a major degree from the specifications, as determined by the State (minor deviations, as determined by the State, may be accepted as substantially meeting the bid requirements of the State of Idaho).

Deviations will be considered major when such deviations appear to frustrate the competitive solicitation process or provide a respondent an unfair advantage. Prior to the issuance of a contract, the State shall have the right to reject all bids or to cancel a solicitation or invitation to bid. Cancellation may be for reasons that include but are not limited to: (i) inadequate or ambiguous specifications; (ii) specifications have been revised;

(iii) property is no longer required; (iv) there is a change in requirements; (v) all bids are deemed unreasonable or sufficient funds are not available; (vi) bids were not independently arrived at or were submitted in bad faith; (vii) it is determined that all requirements of the solicitation process were not met; (viii) insufficient competition; or (ix) it is in the best interests of the state of Idaho.

AWARD PROCEDURES

For contracts with a total value of $100,000 or less, the State will email all respondents within five (5) business days following the solicitation closure of its intent to award a contract(s) and the party(ies) to whom the contract(s) will be awarded and will then email a contract award to the successful respondent(s).

For contracts with a total value of more than $100,000, the State will notify all respondents within five (5) business days following th e solicitation closure, by mail and/or email, of its i ntent to award a contract and the party(ies) to whom the contract will be awarded. After elapse of the five (5) day appeal period, if no appeals are received, the State will award a contract to the successful respondent(s). IDL reserves the right to enter negotiations in accordance with IDL Procurement Policy 13.

Respondents to whom a contract has been awarded will have fourteen (14) calendar days from the mailing date of the award notice to return to the State a signed copy of the contract along with the required certificates of insurance. If the State does not receive such documents within the specified time period, the State may declare, at its sole discretion, that all respondent’s rights to the contract are forfeited, and the State may proceed without further delay or notice to award the contract to the next low respondent.

PROJECT DESCRIPTION

IDL LUMA EVENT #156 8 of 36 SLOAN'S POINT & BIG CREEK NCT https://www.avenzamaps.com/ https://inciweb.nwcg.gov/

Technical Requirements Thin, lop and scatter, prune, or pile trees from a minimum of 12 inches high to 8 inches DBH in all or portions of units (see treatment table). Bole spacing will be used to determine spacing and varies from 20 feet to 40 feet. Bole spacing is defined as the distance from the bole of one leave tree to another leave tree. The desired result of thinning, lopping, scattering, pruning, and piling is to promote early seral and fire resilient species, increase large tree forest structure and decrease the potential for uncharacteristic fire severity.

Early seral and fire resilient species consist of western larch, ponderosa pine, and Douglas-fir.

Before work begins, the contractor shall designate, in writing, the person, or persons who shall represent the contractor during any absence from the project site. In the designation, the contractor shall describe the areas of responsibility assigned to the representative. Designated representative(s) shall be fully conversant in the English language and shall be able to fully communicate with all parties.

The Contractor shall furnish all labor, equipment, transportation, supervision, supplies (except those designated as Government-furnished), incidentals, and perform all work necessary to complete the project in compliance with terms, specifications, conditions, and provisions of this solicitation.

During all operations, care shall be taken to minimize damage to leave trees. Damage to leave trees by contractors operations shall be counted as a deficient tree.

If ponderosa pine is cut from December 1 to June 30, in units where the majority of material cut is ponderosa pine or in units where ponderosa pine is a minor component cut but is adjacent to a ponderosa pine plantation, mitigation measures for Ips. will be required. Mitigation measures can include green chaining or bucking material into lengths less than 4 feet or removing bark on one quadrant of the bole.

WORK TO BE PERFORMED:

I. HAND THINNING:

Only trees that are a minimum of 12 inches tall and less than 8 inches DBH shall be considered for cutting.

Trees designated for cutting:

1. Do not cut whitebark pine, aspen, or healthy western larch.

2. Cut all conifer trees except for whitebark pine and healthy western larch within the dripline of trees larger than 8 inches DBH.

3. Cut the remaining conifer trees to the desired bole spacing for the given unit (see treatment table).

• Favor to leave healthy trees in order of preference: whitebark pine, western larch, Ponderosa pine, Douglas fir, lodgepole pine, Engelmann spruce, grand fir, subalpine fir except when thinning would create near monocultures >1 acre in size. In these instances, leave 20-30% of the residual trees as trees of a lower species preference. Leave trees of lower species preference if they are healthier or better formed than trees ranking higher on the species preference (e.g. ok to leave a healthy grand fir over a diseased Ponderosa pine) o Healthy trees are described as trees not diseased or damaged, with good form and with a crown ratio of 30% or greater in Ponderosa pine, western larch and lodgepole and 50% or greater in Douglas fir/Engelmann spruce/grand fir/ subalpine fir

IDL LUMA EVENT #156 10 of 36 SLOAN'S POINT & BIG CREEK NCT

SRamirez Text Box Big Creek NCT 2 NCT Treatment Table

5. Spacing on individual trees may be varied up to 25% to select the most desirable tree.

6. Do not cut aspen; include aspen (greater than 1 inch DBH) in spacing. Cut all conifers less than 8” DBH and over 12” tall within 40 feet of aspen except for whitebark pine and western larch.

7. Do not cut whitebark pine, cut all conifers less than 8” DBH and over 12” tall within 10 feet of any whitebark pine, pull all cut material a minimum of 10 feet from dripline of leave trees.

7. Trees selected as cut trees shall be cut at or below four inches above the ground level. If natural obstacles prevent severing the bole at that point, stump height shall not exceed four inches above the obstacle. All live limbs shall be removed from the stump. Stumps shall be cut horizontally. Trees shall be directionally felled away from residual trees, improvements, or private property. Such directional felling shall not be required when in the faller’s judgment it is unsafe to do so, and the tree shall be left standing. All roads and associated drainage features within these units shall be kept free of cut material.

II. PRUNING:

All live conifer trees retained (excluding whitebark pine) shall be pruned to a height of seven (7) feet or 1/3 of total tree height, whichever is less. Limbs shall be cut within ½ inch of the limb collar and completely severed from the tree. Only live limbs (limbs with green needles) need to be pruned. Dead limbs do not need to be pruned. Pruning may be completed with a chainsaw, pruning saw or shears. If pruning is completed with a chainsaw, caution shall be taken to minimize damage to the bole of the tree. If damage from chainsaw removes portions of the bark greater than four (4) inches in length or more than 25% of the circumference (whichever is less), the damaged tree shall be cut and a different leave tree shall be selected in its place.

III. LOP and SCATTER:

1. Contractor shall lop the 12-inch tall to 8 inch D.B.H. thinned trees as shown in the Treatment Table.

Lop and scatter slash resulting from contract activities.

2. All limbs cut from the top and boles will not extend over 2 feet in height above the ground. Slash will be evenly scattered beyond the drip line of leave trees. If residual tree crowns are touching slash will be distributed evenly between boles, but not touching the boles. Slash will be scattered in a manner so as not to create a berm.

3. Boles of cut trees do not need to be bucked unless it is necessary to facilitate lopping and scattering of limbs.

IV. SLASH TREATMENT REQUIREMENTS:

A. All slash created by operations performed under this contract, which falls outside the block boundaries shall be pulled back into the block(s) and treated with the applicable slash treatment.

B. All slash created by operations performed under this contract shall be pulled back at least 5 feet from the top of road cuts and at least 2 feet beyond the traveled surface of the road prism on the fill side, for all roads as shown on the Contract Maps. This material shall be treated with the applicable slash treatment.

C. All slash created by operations performed under this contract shall be pulled back at least 15 feet from all culvert intakes and treated with the applicable slash treatment.

D. All slash created by operations performed under this contract shall be pulled back at least 5 feet from the traveled portion of trails.

Hand Pile and Cover:

In blocks with slash treatment designated as “Hand Pile and Cover”, the following conditions shall be met:

A. Slash to be Hand Piled:

All slash less than 4 inches in diameter is designated for treatment. Portions of boles larger than 4 inches may be bucked and left untreated providing that the butt is on the ground, green limbs are removed, and smaller portions/crown of the tree are piled. Material that is not required to be piled must be lopped to within 2 feet of the ground.

Do not remove slash on decommissioned roads.

B. Location of Piles:

IDL LUMA EVENT #156 11 of 36 SLOAN'S POINT & BIG CREEK NCT

The minimum spacing of piles between the edge of the pile and the crowns of adjacent leave trees shall be at least the average diameter of the pile. Piles shall be located such that the heat, when the pile is burned, will vent uphill into an opening in the canopy. No piles are to be made on roads or trails as shown on the Contract Maps drainage ditches, riparian areas, or within channel bottoms above a culvert intake without prior written approval of the COR. Slash shall be moved up to 50 feet, if necessary, to protect residual trees or meet minimum pile size requirements. In areas where slash amounts are not sufficient to meet pile requirements contractor may lop and scatter.

Hand piles will be a minimum of 30 feet from the nearest structure or historic ruin if encountered.

Hand piles will not be placed on or near enough to damage areas that appear to have been modified by humans such as sites containing ruins, old cans or bottles, machinery, fences, or obvious excavations made by humans.

C. Construction and Size of Piles:

All piles shall be as compact as possible with a desired size of 6 feet in height and 6 feet in diameter.

Minimum pile size is 5 feet in height and 4 feet in diameter. Maximum pile size is 6 feet in height and 10 feet in diameter.

All piles shall have a good base to keep the pile from toppling. Larger material shall be placed in the upper portion of the pile to aid in compaction of the pile. This may be accomplished by either teepee stacking or parallel stacking material. Jack-strawed piles; criss-cross piles and poorly compacted piles will not be accepted. All material in excess of 5 feet in length shall be cut before placing in the pile. Material protruding out beyond the compact portion of the pile shall be bucked off and added to the pile to facilitate a clean burn.

D. Covering of Piles:

Piles must be constructed with a 3 by 3-foot (or larger) sheet of waxed paper placed on the pile when it is approximately ¾ of the finished height of the pile. The remaining slash is to be piled on top to prevent the paper from blowing away. The contractor shall supply the paper.

SPECIAL CONSIDERATIONS:

Riparian Conservation Areas:

No cut RCA (riparian conservation area) buffers are 30 feet for both perennial streams and intermittent streams, known RCAs are marked on maps. No treatment shall occur within the 30 foot RCA buffer. No piling, only lop and scatter, shall occur as a slash treatment between 30 feet and 75 feet of the stream. All Non-Commercial Thinning treatments can occur outside of the 75 foot RCA buffer. All streams found in the project area that were not mapped will follow the same treatments.

Perennial streams are defined as generally having year-round flow except in periods of extreme drought.

Intermittent streams are defined as a stream or portion of a stream that flows in response to seasonal runoff and unlike ephemeral streams have well-defined channel bed and banks.

Heritage Considerations:

Treatments will be performed as listed in the table and shown on the map, when structures or ruins are encountered they shall be left as they are found. No objects shall be removed and handpiles will be placed as to not affect the site. See specifications under handpiling. Parking or driving off of hardened road surfaces is not allowed to protect natural and cultural resources. Payette National Forest Motor Vehicle Use Maps should be used to identify road access in addition to any approved administrative routes.

Requirements for Whitebark Pine Whitebark pine has not been identified in the treatment area, however if it is observed the following requirements apply:

1) Do not cut or limb whitebark pine of any age class, dead or alive

IDL LUMA EVENT #156 12 of 36 SLOAN'S POINT & BIG CREEK NCT

2) Felling of trees will be directional away from any whitebark pine

3) Damage will not occur to whitebark pine including from the movement of slash, marking of any kind, parking or any other equipment or vehicle use.

4) Piles will be arranged to avoid scorching any whitebark pine trees. Piles can be arranged to target species competing with whitebark pine such as subalpine fir.

5) Slash would be removed and scattered to a distance greater than 33 feet from the dripline of whitebark pine trees of all age classes to the extent possible, but may occur up to a distance of 10 feet if necessary to minimize impacts to adjacent trees. Windrowing slash is not acceptable unless it is the only option for meeting pullback standards. In this circumstance slash will be piled or windrowed to avoid damage to leave trees to the extent possible.

Wildlife Considerations:

1) If flammulated owl or great gray owl nest sites are observed cease activities in a 1500-foot buffer around the site and contact the project inspector or COR.

2) If northern goshawks are observed cease activities in the area and contact the project inspector or

COR.

3) If elk wallows or natural licks are found do not cut or alter vegetation within 240 feet and notify project inspector or COR.

PERIOD OF PERFORMANCE:

Sloans Point: Work can start in April 2024 and must be completed by October 31, 2024.

Big Creek 2: Work can start field season 2024 and must be completed by October 31, 2025.

INSPECTION & COMPLIANCE:

Either a 1/20th acre circular plot (26.3 feet radius horizontal distance) or a 1/50th acre circular plot (16.65 ft.

radius horizontal distance) will be used for inspection. Where excessive crop trees are found to be the result of trees over 8 inches DBH which cannot be cut, the Contractor will not be penalized.

DETERMINATION OF WORK QUALITY PERCENTAGE:

Work quality percentages are derived from data developed from inspection plots. The final work quality percentage times the bid price determines the pay. A work quality percentage of 90 percent or higher will result in full payment. If high stumps or uncut surplus trees are the primary reason for unsatisfactory work, the Contractor shall rework areas designated by IDL until satisfactory work quality is obtained.

Example: Number of trees cut per plot = 40 Number of unacceptable cuttings = 8 trees 8 divided by 40 X 100 = 20% 2 leave trees damaged = 2% 100% minus 22% = 78% 78% X bid price for job = Pay Rate

Satisfactory Work Quality: A minimum work quality standard of 90 percent is required.

Unsatisfactory Work Quality: Based on inspection results, if the work quality percentage falls below 90 percent, the IDL COR will immediately notify the Contractor in writing and instruct the Contractor to improve

IDL LUMA EVENT #156 13 of 36 SLOAN'S POINT & BIG CREEK NCT the quality of the work. If the quality of the work is not raised to an acceptable level within two consecutive workdays after written notification, the IDL COR may issue a stop work order.
