About this file
This is a Request for Special Procurement submitted by the Oregon Department of Corrections (DOC) on April 26, 2022. The agency is requesting authorization to procure ruggedized 1U rack-mounted UPS devices rated at 1.5KVA specifically designed to withstand extreme temperatures in outdoor environments. These devices are required for an intermediate distribution frame (IDF) infrastructure upgrade at Oregon State Penitentiary (OSP) to provide battery backup and protection for sensitive networking equipment exposed to outdoor conditions. The requested procurement period spans from April 26, 2022, to October 1, 2022, with a total estimated cost of $74,800. The DOC conducted extensive research and determined that only one vendor on the market manufactures UPS units meeting all specified requirements, including ruggedization for outdoor use, extreme temperature tolerance, and SNMPv3 manageability compatibility with the Facilities Device Network standard. Alternative vendors such as CDWG and Eaton/APC were unable to provide suitable solutions.
The special procurement is justified on the basis that it will not encourage favoritism or diminish competition, as exhaustive internet research identified no alternative providers capable of meeting the fit, form, and function requirements. The justification further emphasizes that the procurement substantially promotes public interest by ensuring timely installation of critical safety and security infrastructure at a maximum-security facility that cannot be practicably achieved through standard competitive solicitation procedures. The DOC designated Procurement Officer, Toni Payseno, submitted the request on April 26, 2022, and the special procurement finding satisfied both standards of favorable consideration under Oregon Revised Statutes 279B requirements.

REQUEST FOR SPECIAL PROCUREMENT
PART A. Requesting Agency must complete Items 1 through 13.
1. Requesting Agency Name: Department of Corrections (DOC)
2. Date of Request: ____4/26/2022___ 3. Agency Number: 29100
4. Agency Contact Name: __Nate Lowe________ 5. Phone: ___503.559.9547____
6. Type of Request: X Special Procurement _____
7. Time Period Requested: From: ____4/26/2022______ To: __10/01/2022____________
8. Total Estimated Cost: $__74,800______________
9. Title: Supplies and/or Services to be Acquired:
Ruggedized 1URM Extreme Temp 1.5Kva UPS devices
10. Request, Background, Current Need, and Proposed Contracting Procedure:
a. Request:
We are requesting a special procurement for the 1U rack mountable UPS device specifically designed to withstand extreme temperatures in an outdoors environment. DOC has a perimeter intermediate distribution frame (IDF’s) to build at Oregon State Penitentiary (OSP) that are ALL outdoor, external IDF’s that require battery backup for sensitive networking equipment that is also specifically ruggedized for the environment. The device must be manageable by SNMPv3 as it is the standard of the Facilities Device Network. This was the ONLY vendor found on the market that meets all these requirements.
CDWG had no solution and neither did Eaton/APC. Having exhausted all usual vendors, this was researched and discovered to be the best and ONLY fit.
b. Background:
OSP is going through a major infrastructure upgrade. Since this is on the outside of the buildings, there is heat and weather conditions that must be taken into consideration. Regular UPS’s are not recommended for this type of project. DOC conducted extensive research for the best product, the availability, and protection it would offer.
c. Current Need:
These UPS’s are for the secure perimeter around OSP. This is to protect equipment from power surges, brown outs, and power failures. It is necessary and critical for safety and security of the Institution.
d. Proposed Contracting Procedure:
11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.

This is the only product found on the market that meets all requirements.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
__X____ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
Extensive internet research was conducted in April 2022 and only one provider of these units is available that will meet the fit, form and function required. It is with confidence that a standard solicitation process would garner the same results since there are no other providers identified that can offer the same sturdy features and durability required at a maximum-security institution.
and
______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
or
__X____ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
After extensive research, there were no other vendors located who could offer a product that will meet the rugged requirements of these units. It is critical that these units are in place as soon as possible to ensure the safety of security staff and the incarcerated adults residing at the facility.
13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request if it is submitted through OregonBuys. Agency may elect to attach a signed Request.
