A. Reports on the Existing Condition Information

1. Field assessment of existing conditions on the levee was performed by the U.S. Army

Engineer Research and Development Center. The findings were included and available in a report, titled "Condition Assessment of US International Boundary &

Water Commission, Texas and New Mexico Levees, Volume I, Main Text," dated June

2004.

2. Field assessment of existing conditions of the project was performed by URS Group, Inc.. The findings were included and available in a report, titled "Design

Documentation Report, Design of Rehabilitation Levee Improvements of the

Rectification Project from Ysleta to Fabens, Texas, El Paso County, Texas," dated

June 23, 2012.

3. Field assessment of existing conditions of the project was performed by URS Group, Inc.. The findings were included and available in a report, titled "Supplement 1 to the

Design Documentation Report, Rehabilitation of Wasteways 1 and 2 within the Ysleta to Fabens Levee Reach, El Paso County, Texas," dated July 15, 2016.

B. Geotechnical investigations were performed as noted in Section 00.31.32.

1.3 EXISTING INFORMATION

A. Field survey was performed by Frank X. Spencer & Associates, Inc. which was used as the basis of design.

1.4 SURVEY CONTROL

A. Horizontal and vertical controls are based on Texas State Plane Coordinate Grid System

Central Zone North American Datum (4203) of 1983 (NAD 83) in US survey feet and

North American Vertical Datum of 1988 (NAVD 88) in US survey feet, respectively.

B. The survey was based on existing monumentation set by USIBWC which is referenced on the Survey Control Maps. Data for these points was provided by USIBWC.

C. The surveyor prepared the Survey Control Maps for the total length of the reach showing existing levee alignment, existing levee stationing, ROW and survey control points per the USIBWC survey guidelines. The survey is presented at ground distance.

1.5 EXISTING SURVEY MARKERS

A. The surveyor surveyed and located seventeen (17) existing survey markers.

1.6 TOPOGRAPHIC SURVEY

The surveyor performed a topographic survey along the project reach to include, but not limited to, levee, distances to the ROW, any ramps that enter or exit the levee and any ditches or canals that cross the levee or are immediately adjacent to the levee. The final topographic mappings, including a 3-dimensional surface, were provided in an AutoCAD file, survey point file and a surface TIN file.

1.7 EXISTING STRUCTURE SURVEY

A. The surveyors surveyed and obtained x & y coordinates and elevations of existing surface features of visible structures and utilities, including, but not limited to, Wasteways 1 and

2 and security fencing. These locations are shown on the Plan and Profile sheets of the

Contract drawings.

1. NOTE: It is the Contractor’s responsibility to verify locations of all existing utilities

(shown and not shown) prior to construction.

1.4 GENERAL

A. The Project’s Environmental Assessment (EA), titled "Final Environmental Assessment:

Improvements to the Rio Grande Rectification Project," dated March 2009. The

Contractor shall review and comply with the requirements provided in the EA document.

B. This document list environmentally and culturally sensitive areas that need to be protected from any disturbances of construction activities. The environmentally and culturally sensitive areas that were identified on the document are identified below.

1. Biological Resources

a. Work should be schedule to occur outside of the bird breeding season whenever possible. The breeding and nesting season is from March 1 through August 31. If work continues into the bird breeding season the areas proposed for disturbance will be surveyed in order to avoid the inadvertent destruction of nests and eggs

b. Western burrowing owl (Athene cunicularia hypugaea) is found within this levee reach.

2. Natural Resources

a. Equipment cannot be parked, staged, or used under large, mature trees. Keeping equipment away from the large, mature trees will prevent incidental damage to the tree and prevent compression of the root ball.

1.5 PRESERVATION OF CULTURAL AND NATURAL RESOURCES AND THE

ENVIRONMENT

A. If the Contractor initiates changes to the Contract and USIBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.

B. Culturally Sensitive Areas

1. If a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way, cease all work immediately, secure the site from further disturbance and possible vandalism, and notify USIBWC. The site, building, or location will be investigated and evaluated by USIBWC.

1.6 OTHER CONSIDERATIONS

A. The Contractor is required to ensure that all Environmental Permits, Issues, and

Comments (EPIC), which are included within the Contract Documents are followed and implemented to ensure potential impacts are avoided.

1.7 USE OF GEOLOGIC MATERIALS ON A FEDERALLY FUNDED PROJECT

A. To ensure preservation of historical and archaeological data, when the Contractor, the

Construction Contractor, or any subcontractor proposes to use a borrow pit/source/quarry

USIBWC Solicitation IBM16B0002 Page 00.31.24-3 for soil, rock, or gravel, the source must first be approved by the COR to ensure compliance with Section 106 of NEPA (36 CFR 800).

B. Submit a map showing the location of proposed sites to the COR at least forty five (45) days in advance of use.

C. Take no action to use or alter the proposed location until written approval for site use is received from the COR.

D. If the quarry or borrow site already provides materials for TxDOT, USACE, or other governmental agency, a copy of the environmental approvals from said agencies may be provided to the COR.

E. Include permission for Government access to any geological source locations.

B. The Contractor must adhere to all agreements, mitigation plans, and standard best management practices.

C. If Contractor-initiated changes in the construction method result in impacts to waters of the U.S., the Contractor shall have sole responsibility to obtain all required new or revised Section 404 permit and shall adhere to all agreements, mitigation plans, and standard best management practices required by these permits.

1.6 RESPONSIBILITIES

A. The Contractor shall be responsible for providing the proposed location of the project staging areas for compliance confirmation of the COR prior to installation of stormwater pollution prevention (SWPP) measures.

B. The Federal Government is not subject to local jurisdictions' building codes, nor is it required to obtain building permits from local jurisdictions for construction on real estate owned or controlled by the USIBWC. However, borrow pits and other offsite locations are subject to local regulations. The Contractor is responsible for researching and obtaining all necessary permits for offsite work.

C. The Contractor shall be responsible for obtaining all necessary permits and rights of entry for all work required under this Contract.

D. The Contractor will also be required to research the need for any other required permits, based on the information available from the Contract Drawings and Technical

Specifications prior to the beginning of construction. For the work under this Contract, the Contractor shall be responsible for coordinating and obtaining all permits required by

Federal, state, and local entities, unless otherwise specified within the Contract and these

Technical Specifications.

E. The Contractor shall apply and pay for all required permits. The Government is not responsible for any existing or newly introduced permits required before, during and/or after construction.

1.6 SECURITY

A. The Contractor is responsible for securing the work site, equipment, and materials from vandalism and theft.

B. The Contractor shall implement a security program that:

1. Protects the work, the existing premises, and the Government’s operations from theft, vandalism and unauthorized entry.

2. Initiates a security program in coordination with Government’s existing security system at mobilization.

3. Maintains the security program throughout construction duration until Contract

Closeout.

C. The Contractor shall implement entry control to the work area that:

1. Restricts entry of non-Government persons and vehicles into the work area and existing facilities, unless otherwise compliance confirmed by the Government.

2. Allows entry only to authorized persons with proper identification.

D. The Government shall not be responsible for the security of any items within the work area and associated PSLs.

1.7 INSURANCE

A. When not required by the Contract clauses, the Contractor has the right to purchase coverage for property insurance, builder's risk insurance (including perils of wind, collapse, vandalism/malicious mischief, and theft, including theft of materials whether or not attached to any structure), and/or flood insurance or to be self-insured for these exposures.

B. The Contractor shall be held liable for all costs associated with losses, deductibles, and self-insurance for coverages not required by the Contract clauses.

1. Losses shall include architects' and engineers' fees that may be necessary to provide drawings and specifications for the repair and/or replacement of damaged property.

2. Losses shall include appropriate supervision and quality control of all work for the repair and/or replacement of damaged property.

C. Any insurance policies purchased for work or property related to this Contract for coverages not required by the Contract clauses shall list the International Boundary and

Water Commission, United States Section, as an additional insured.

1.8 DEPARTMENT OF HOMELAND SECURITY

A. In any event the staff of the U.S. Department of Homeland Security (also known as U.S.

Customs and Border Protection (CBP)) alerts and directs any field crews to stop work in for any security reasons in the area, the Contractor shall consider this as top priority and fully cooperate with the directions of DHS at all times until the security alert is cleared by the DHS. In addition the Contractor shall contact and coordinate with the COR for any additional steps to be taken during and after the security alert from the DHS is cleared.

B. Access to the site is controlled by Border Patrol. All site work is anticipated to take place on the south side of the DHS border fence. Gates through the border fence are located at both ends of the project site. Access through the border fence must be coordinated with

Border Patrol.

C. The Contractor shall provide a list of all workers' names, their social security number, and a copy of a Government issued identification card to the COR. This list shall be provided at least three (3) days prior to the workers arriving onsite. Border Patrol and/or

USIBWC will run background checks on all employees working onsite.

1. The Contractor shall provide updates whenever employees are added or deleted from the work crews.

2. Employees must pass the background checks/vetting to be allowed to work onsite.

a. Workers with felony convictions, issues with their immigration paperwork, or outstanding warrants are precluded from working onsite.

D. The Contractor shall ensure that all employees working onsite are identifiable with a project identification card, a special hard hat color, a significantly colored piece of clothing, or another method agreeable to Border Patrol.

E. All on-road vehicles shall have the name of the construction company/Contractor clearly displayed on the side of the vehicle.

1.6 SEQUENCE OF WORK/TIME FOR COMPLETION OF WORK

A. The work is to be performed as shown on the Contract Drawings.

B. After receipt of the Contract Notice to Proceed (NTP) the Contractor shall comply with all submittal requirements as covered under these specifications and obtain Government review of each submission.

1. No construction shall be started, with the exception of preparing the construction laydown and staging areas, until the Government reviews the required submittals and determines it satisfactory for purposes of beginning construction.

2. The Government will not grant any time extension for any resubmittal required when, in the opinion of the Contracting Officer, the initial submission failed to meet the minimum quality requirements as set forth in the Contract.

3. If the Government allows the Contractor to proceed with limited construction based on pending minor revisions to the reviewed submittals, no payment will be made for any in-place construction related to the pending revisions until they are completed, resubmitted and are satisfactory to the Government.

4. No payment will be made for any in-place construction until all submittals required for that portion of the work and/or required prior to the start of construction have been made, reviewed, and are satisfactory to the Government.

C. Construction on both Wasteway #1 and Wasteway #2 shall be completed during the non-irrigation season. Typical irrigation seasons start around the end of February and stop near the end of October. The Contractor shall be in close coordination with El Paso

County Water Improvement District #1 (EPCWID1) and USIBWC for irrigation release dates.

1.7 WORK UNDER OTHER CONTRACTS

No construction work is anticipated to be performed at the project site under separate Contract with other Contractors during the Contractor’s performance period.

1.8 LABOR AND STAFFING

A. Contractors are responsible for determining the appropriate staffing necessary to perform the Contract work. Contractors are also responsible for complying with the minimum wage and benefits requirements for each labor classification performing work on the

Contract.

B. If a classification considered necessary by the Contractor for performance of the work is not listed on the applicable wage determination, the Contractor must initiate a request for approval of an additional classification along with the proposed wage and benefit rates for that classification.

C. The Contracting Officer will attach the appropriate Davis-Bacon wage determination to this Contract. The Contractor is responsible for all requirements of the Davis-Bacon Act.

1.9 PROJECT LOCATION

A. The work is within the United States Section of the International Boundary and Water

Commission (USIBWC) Rio Grande Rectification Project, in El Paso County, Texas .

B. The work is located completely within the United States, but is directly adjacent to the international border with Mexico.

1.10 INVESTIGATION OF SITE CONDITIONS

A. The Contractor, as well as their subcontractors, is urged to visit the job site and to become fully aware as to the existing conditions affecting the work to be performed under the Contract documents.

B. The Contractor shall be responsible for ensuring that all of its suppliers, manufactures, and subcontractors have reviewed all applicable Contract documents relative to their work. The Contractor shall provide all labor, material, equipment, and services not provided by the Contractor’s suppliers, manufacturers, fabricators, and/or subcontractors but required for complete and operable facilities as described in the Contract documents.

1.11 OTHER CONTRACTUAL REQUIREMENTS

A. Items mentioned in the Sections and not shown on the Drawings, or shown on the

Drawings and not mentioned in the Sections, shall be of like effect as if shown or mentioned in both.

B. The Contractor is required to report any ambiguities that exist within the terms of these

Contract documents to the Government.

C. In any case where these Technical Specifications conflict with the Federal Acquisition

Regulations (FAR), FAR requirements will take precedence. In any case where FAR requirements are stricter or impose a higher standard than these Technical Specifications, FAR requirements will take precedence. PART 2 - PRODUCTS

2.1 GOVERNMENT FURNISHED MATERIALS

The Government will not provide any materials for this project.

2.2 PRODUCTS TO BE FURNISHED BY THE CONTRACTOR

A. The Contractor shall provide all labor, all equipment, and all products required to execute the project.

B. All materials provided by the Contractor for the project shall be new or recycled, high grade, free from defects, meeting the specifications herein. The minimum quality of the work shall be in accordance with the specifications herein. The Contractor's Quality

Control System Manager will ensure compliance confirmation and the Contractor's testing company will ensure that materials, equipment, and work quality strictly adhere to the requirements of the Contract documents.

C. Materials, equipment, and work quality not conforming to the requirements of these specifications shall be considered defective and will be subject to rejection. Defective work material, whether in place or not, or equipment shall be removed immediately from the site by the Contractor, at its expense, when so directed by the COR.

D. If the Contractor fails to replace any defective or damaged work, materials, or equipment after receiving notice, the COR may cause such work or materials to be replaced by other forces. The replacement expense shall be deducted from the amount to be paid to the

Contractor. Defective equipment will not be allowed in the performance of any work.

E. Water for All Construction Activities

1. The water required for all construction activities including, but not limited to, dust control (Section 01.57.13) and vegetation establishment (Section 32.92.00), shall be considered as incidental and shall be provided from a metered source that is compliance confirmed by the USIBWC.

2. Water from the Rio Grande shall not be used by the Contractor at any time.

3. Water use must be in accordance with Texas water law.

B. Once these required submittals have been compliance confirmed by the COR, the

Contractor will be allowed to mobilize and begin work within USIBWC's right-of-way.

3.2 USE OF RIGHT-OF-WAY

A. Construction operations shall be confined to the USIBWC right-of-way. Portions of the site beyond areas on which the work is to be performed are not to be disturbed.

B. Roads serving the right-of-way, identified as such or not, owned by the USIBWC or CBP shall be clear and available to these agencies.

C. It is the Contractor’s responsibility to locate and/or verify the areas required for construction beyond the USIBWC right-of-way, identify the owners of the affected properties and acquire necessary easements, prior to commencement of construction, at no cost to the USIBWC.

D. The Contractor is required to maintain access along the Rio Grande during all phases of project work.

3.3 OCCUPANCY OF RIGHT-OF-WAY

A. Partial Government Occupancy

The Government may need to occupy the right-of-way during the entire construction period, with the exception of areas under construction. The Contractor shall cooperate with the Government during construction operations to minimize conflicts and facilitate

Government access. The Contractor needs to maintain existing access to the facility, unless otherwise indicated in the Contract Drawings. The Contractor shall provide not less than seventy two (72) hours notice to the Government of construction activities that will affect any Government activities.

B. Government Occupancy of Completed Areas of Construction

The Government reserves the right to occupy and to place and install equipment in completed areas of the facility, before Substantial Completion, provided such occupancy does not interfere with completion of the work. Such placement of equipment and partial occupancy shall not constitute acceptance of the total work.

3.4 WORK RESTRICTIONS

A. Onsite Work Hours

The Contractor’s attention is directed to the Contract.

B. Wasteways

1. The wasteways are owned by others. The work to be performed on irrigation structures shall be performed in accordance with the irrigation owner’s restrictions.

2. The Contractor shall coordinate all associated work with the irrigation owner and the

C. Cutting the Levee for Structure Improvements

In some instances, the work may require cutting the levee. This work shall not be performed during periods of known heavy rains or flooding.

3.5 DELIVERY OF FILES TO USIBWC

A. Delivery shall be accomplished via email or through direct delivery (US Postal Service, FedEx, UPS, etc.).

B. Placing documents on a cloud server, online drop box, or online management system

C. Electronic files shall be provided in their native format (MSWord, Excel, Primavera, etc.)

as well as Adobe pdf.

1. Pdfs shall be produced directly via software and shall include valid electronic signatures or they shall be scans of the original documents.

a. The minimum scanning resolution shall be 400 dpi for color and grayscale and shall be 600 dpi for black and white.

b. Color documents shall be scanned in color.

D. Hard copy delivery packages/boxes shall not exceed forty (40) pounds.

E. Hard copies shall not be provided in 3-ring binders (except for O&M manuals, if required).
