Response: The plant will be run by an operations and maintenance contractor selected by the Government.
46) Question: Section F.5 of the Solicitation, Offer and Award entitled Actual Damages-Construction indicates that the Contractor shall pay actual damages to the Government for each calendar day of delay until the work is completed or accepted. Our surety is objecting to this provision, as it is not a usual and customary provision for payment due to an Owner in the event of late project completion by a Contractor. Normally, the language designed to compensate the Owner for late completion by a Contractor reads as follows: "Contractor shall be liable for and shall pay to the Owner as fixed and agreed liquidated damages the sum of $x,xxx per day for each calendar day of delay in completion of the Work from the date for Final Completion (as specified herein or in any written extension of time granted by the Owner) until the Engineer has issued a Certificate of Substantial Completion for the Project. The foregoing liquidated damages shall constitute full compensation (for any and all actual, incidental or consequential damages including, without limitation, for public inconvenience, loss of use, loss of revenue, or additional financing to the Owner and public for the completed Work) to the Owner for Contractor's failure to substantially complete the Project before the date for Final Completion. Liquidated damages may be deducted from amounts due to the Contractor". Will the Government consider changing Section F.5 to allow for liquidated damages instead of actual damages?
Response: Liquidated damages are now included.
47) Question: C4 and sheet 3934 shows a dumpster enclosure by option 1 administration building. On sheet A3100 of option 1 shows the dumpster enclosure. The question is whether the dumpster is included in the base bid price or under the Option 1 price?

52) Question: On drawings M109, M451, M1305, M2212 and M3721 it references a Sodium Hypochlorite storage tank, but it does not specify what kind of tank it is or size. Typically these are fiber glass tanks. In Spec Section 11.82.10 it calls out for two polymer tanks, in the WAS Thickening Facility. Are these Sodium Hypochlorite tanks reference on the above drawings, existing tanks or new tanks. If they are new what type of tank is required, size, capacity, tank diameter, Chemical and Specific gravity.
Response: Existing
53) Question: We are requesting confirmation on the stainless steel aeration piping, specifically the pipe wall thickness. Note ITT/Sanitaire's scope includes the stainless steel droplegs and 'in-basin mains' (which is our manifold pipe). The fine bubble specifications refer to section 40 00 63 for more information on the stainless steel required for the aeration system. Depending on the interpretation of 'exposed piping', Section 40 00 63 calls for either 0.219 or 0.250 inch thick wall for pipes sizes of 6 through 10" (which are the sizes we would be supplying). This wall thickness would be highly unusual for aeration system piping. Industry standard is either SCH 10 or 12 gauge stainless piping, which is more than adequate for our purposes (low pressure air). Note that SCH 10 piping is allowed for this project in the Channel Aeration specification (page 11.82.29-6). We are requesting that we be allowed to bid/supply either SCH 10 or 12 gauge, 304 stainless steel piping for our droplegs and manifolds. It will be more than adequate to handle low-pressure air, it will be more economical than SCH 40, it will be much easier to handle and install, and it will transfer heat better than SCH 40 (thus cooling the air more prior to the transition to PVC.
Response: Specification is correct and unchanged with regard to process air piping wall thickness. Unrelated revisions have been made to Specification Section 11 82 29, and it has been reissued in Amendment 6.
54) Question: In spec section 02.92.00 part 2 item 2.2 D it calls for 9’ high fence existing fence is 10’ high with 1” mesh 11 gauge core wire.
Response: The existing fence is 9 feet high; bid the fence according to the requirements of the plans & specifications.
55) Question: Is there going to be a concrete curb around the new fence?
Response: No.
56) Question: 118204-6.2.2.C – States that pumps shall be 4 stage. Our pumps selected to meet the design conditions are 3 stage for the Main Pumps and 5 stage for the Jockey Pumps. Will this be a problem?
Response: The specification calls for a 4 stage pumping unit; specific design points that should be met; pumps must comply with the specification.
57) Question: 118204-6.2.2.C.1- Main Pumps require Minimum Efficiency at Design Point 2 of 55%, however our pumps will meet 43%. Will this be a problem? Response: Yes, pumps must comply with the specification.
58) Question: 118204-7.2.3.D and E. The spec calls for a “discharge bowl” with “two symmetrically arranged diffuser vanes” and a suction bell “free of bearing hubs and supporting vanes to allow unobstructed flow to the impeller”. These requirements appear to be for Solids Handling Pumps. This could easily be a carry over from another specification, please clarify.
Response: The specification is correct; please comply with the specification.
59) Question: 118204-9.3.2.B.3 States that “Each pump and variable frequency drive shall be tested…” Can we offer to performance test with our factory VFD? Per the specification, the Contractor is responsible for supplying the VFDs so if we can’t use ours we will need the contractor to ship each of the VFDs to our factory along with a VFD tech, at his expense, for the tests. This requirement may increase the risk of freight damage to the VFDs during transit to multiple destinations prior to installation at the jobsite. This will also impact the pump delivery schedule as they are then tied directly to the VFD production schedule. Please clarify.
Response: The specification is correct; the requirement shown in/on the first line of that same paragraph says, “Each complete pumping unit shall be factory tested”.
60) Question: Coating specification 099100 – This specification is vague in regards to pumps and whether field applied or not. It does state in 3.2C “Equipment that would be damaged by sandblasting shall receive the shop coatings and finish coatings.” We plan to offer our standard coating. Please clarify the intent of the specification.
Response: The specification is clear; please review paragraph 2.5 of the specification.
61) Within Section L of the Solicitation there are two sections L.8 that are similar. The first section L.8 is the “Qualification of Bidders” and the second is the “Best Value Evaluation Criteria” a) Do both sections L8 apply? Ie is it the intent that the first section L.8 be completed (i.e a Statement of Construction Experience and Financial Condition) and submitted in a “separately sealed envelope” to be “returned unopened unless necessary” in addition to summary of qualifications for the Best Value Evaluation Criteria (which refers to attachment J-4 Summary of Qualifications). B) If so we are unable to find Page D-2 in regard to the Statement of Equipment referenced in the L.8 Qualifications of Bidders – IBWC (APR 1989). The page numbers are numeric and Section D pertains to Package and Marking. What section of the Solicitation can this information be found?
Response: The Qualification of Bidders must be completed in its entirety and will be the information used to evaluate the Bidder’s under the Best Value Evaluation Criteria. The intent is not to have the information submitted in a separately sealed envelope but as part of a bidder’s overall proposal/bid package. Section D pertains to the Attachment J-4 “Summary of Qualifications Form” and not the draft contract.
62) Question: On sheet M450 of the contract drawings, Construction Interface Note 1 refers to the 72” PE line at the Primary Effluent Bypass Structure and states, “Contractor shall remove existing (OGW) 72” Blind Flange and install 72” primary effluent gate (PEG).” However the response to RFI #7 references the 72” PE line and states that “A blind flange is available for the closure of the 72” pipe at the Primary Effluent Bypass Structure.” Please confirm that the Blind Flange has been removed from the 72” PE line inside of the PEBS?
Response: Blind flange has been removed from the 72” line.
63) Question: The plans call out for 2 types of window coverings: 4 different styles. Please clarify that the architect is looking for aluminum vanes, not PVC vanes for the vertical blinds only. Aluminum is more costly and offers fewer color choices. Response: We could not find any conflict with the plans; please bid Aluminum vanes for the vertical blinds in accordance with Dwg A3101 under office accessory key #1, 2 and 3 notes.
64) Question: I would like to get some clarification on types J, P, S, V, W, and A1. What types of fixtures will be required for these types? Please advise as soon as you have a chance.
Response: The lighting fixtures are described in detail on the lighting fixture schedule on drawing E3.
65) Question: Please provide a specification and/or detail for the temporary security fence.
Response: It is already included in the plans & specifications; Specification 02 02 00 Security, Part 1, Section 1.2 C states that, “If fencing or barriers are breached or removed for purposes of construction, the Contractor shall provide and maintain temporary security fencing equal to the existing.” The Contractor must propose security measures, including fencing to the COR. Additionally, Section 1.2 B states “The Contractor shall repair all damage to property of Government and others arising from failure to provide adequate security.”
