Addendum to Evaluation - Commercial Product and Commercial Services
FAR 52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)
(a) The Government will award a fixed price contract resulting from this solicitation. Quotes will be evaluated for technical acceptability utilizing the following factors and the award will go to the lowest priced technically acceptable quote.
Factor 1 - Health Inspection Report: One legible copy of the state or local government health inspection report for the proposed food preparation facility, if and as required by state and local regulations. The health inspection shall be conducted less than 12 months from the quote submission due date. The facility must have received a score of "A" or "B"; 85 or above" or
"pass", if pass/fail inspection system is used. The score must be clearly annotated on the report. Failure to provide an acceptable health inspection report will render the quote submission unacceptable.
NOTE: If MEPS is located on a military installation. IAW AR 40-657, contractors delivering and serving food on a military installation must pass a Veterinary Service Food Protection Audit to be a sanitarily approved source. The apparent successful offeror shall furnish products from an approved food preparation facility. The approval shall be obtained prior to contract award. Food establishments located on the military installation are inspected locally by veterinary inspection personnel.
The apparent successful offeror shall coordinate their request to schedule an auditor obtain local approval of the food preparation facility with the MICC - Fort Knox. Failure to obtain approval will render the apparent successful offeror ineligible for award.
Factor 2 - The Government will evaluate past performance on an acceptable/unacceptable basis to determine past performance acceptability.
The past performance evaluation is an assessment of the offeror's probability of successfully performing the required effort; therefore, past performance evaluation is not a determination of contractor responsibility.
The past performance assessment is based on the offeror's record of recent and relevant past performance with respect to the services specified in the solicitation requirements. There are two aspects to the past performance evaluation: (1) the recency and relevancy of the past performance, and (2) the quality of that past performance. Past performance is recent if it is within the previous 36 months. Past performance is relevant if it involves contracts valued at a minimum of $25,000.00.
Adjectival Rating Description:
Acceptable - Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown (See note above).
Unacceptable - Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of a company without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the company may not be evaluated favorably or unfavorably on past performance but shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.
(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
