About this file

This is an Indian Affairs Indian Economic Enterprise Representation Form used for federal contract opportunities set aside under the Buy Indian Act (25 U.S.C. 47). The form serves as a self-certification mechanism for offerors to demonstrate eligibility as an Indian Economic Enterprise (IEE) as defined in the Department of the Interior Acquisition Regulation (DIAR) Part 1480. Offerors must complete fields identifying the federally recognized tribal entity, the legal business name, the Unique Entity ID (UEI), and the name of the 51% (or greater) owner of the IEE firm, along with a certifying signature from an authorized representative.

The form establishes that IEEs must maintain compliance with all eligibility requirements at three critical junctures: at the time of offer submission, at the time of contract award, and throughout the full contract term. Contracting Officers retain the authority to request additional documentation of eligibility at any point during the acquisition lifecycle, including pre-award evaluation. The form contains explicit warnings that false or misleading information submitted in connection with an award set aside under the Buy Indian Act constitutes a violation under 18 U.S.C. 1001, while false claims during contract performance are subject to False Claims Act penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The form requires entry of the solicitation/sources sought/RFI number, project title, and date of form submission.
