About this file
This is an Indian Affairs Indian Economic Enterprise Representation Form used for federal contract opportunities set aside under the Buy Indian Act (25 U.S.C. 47). The form serves as a self-certification document that offerors must complete to verify they meet the definition of an "Indian Economic Enterprise (IEE)" as defined in the Department of the Interior Acquisition Regulation (DIAR) Part 1480. Offerors are required to provide their federally recognized tribal entity name, legal business name, unique entity ID (UEI), the name of the 51% or greater owner of the IEE firm, and a certifying signature with printed name. The form also requires identification of the solicitation or sources sought number, project title, and date of form submission.
Enterprises must maintain IEE eligibility at three critical points: when submitting an offer in response to a written solicitation, at the time of contract award, and throughout the entire contract term. Contracting officers are authorized to request additional documentation or information to verify eligibility at any point during the acquisition lifecycle, including the pre-award/proposal evaluation phase. False or misleading information submitted with an offer is subject to penalties under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729 to 3731 and 18 U.S.C. 287. This template form does not address specific products, services, pricing terms, or response deadlines, as it is designed for general use across multiple buy Indian act solicitations.
