About this file
This is a Justification for an Exception to Fair Opportunity under FAR Overhaul Subpart 16.5 for an indefinite-delivery contract award by the Naval Undersea Warfare Center Division Newport, Code 02.
The Naval Undersea Warfare Center Division Newport (NUWCDIVNPT) requests authorization to award a renewal contract for Siemens HyperWorks Technical Support and Software Maintenance (TSSM) coverage from Altair. The procurement covers three line items of Hyperworks Mechanical Engineer TSSM services (part number AU-ME-STDMNT) with quantities of 216.48, 65.64, and 216.48 units for the base year, plus additional option year quantities for two subsequent years (FY27–FY29). Service Cost Center (SCC) funds will finance this purchase. The estimated contract value is redacted in the document but covers the base year and two option years. The justification cites FAR Overhaul 16.507-6(b)(2), asserting that only one contractor is capable of providing the required supplies and services because Siemens HyperWorks possesses unique technical capabilities including proprietary mesh generation engines for complex curved structures, integrated multi-physics workflows within a single interface, and local execution capability for secure, air-gapped defense networks—features that alternative CAE/CAD/FEA software platforms lack. The Contracting Officer has determined the anticipated cost to be fair and reasonable. The document identifies significant financial and operational costs associated with transitioning to alternative software, including approximately 2,000 hours of lost production time, 11 months of schedule delays across IT installation, workforce retraining, engineering model reconstruction, and simulation validation phases. The justification confirms no plans exist to compete future contracts for these supplies and services unless another potential source emerges.

IN REPLY REFER TO
The Naval Undersea Warfare Center Division Newport (NUWCDIVNPT) utilizes Siemens
HyperWorks (purchased from Altair) as its core Computer-Aided Engineering (CAE), Computer-Aided Design (CAD), and Finite Element Analysis (FEA) software environment.
This platform provides foundational modeling, structural finite element simulation, Continued access to HyperWorks enables the Command to maintain and operate its established modeling and simulation infrastructure, supporting mission-driven naval engineering tasks. This procurement action renews software maintenance and technical support for existing HyperWorks licenses to ensure uninterrupted operational capability across the Command's naval engineering programs.
Siemens HyperWorks was selected as the Command's technical standard because it provides specialized structural meshing, automated modeling workflows, and advanced solver capabilities that alternative products fail to deliver. First, features a proprietary, high-fidelity geometric mesh generation engine designed specifically to handle complex, curved shell structures and extreme hydro-acoustic fluid boundary elements. Alternative simulation suites lacked the specialized mathematical algorithms needed to automatically generate defect-free hexahedral meshes across complex, high-curvature geometries, requiring extensive manual correction that frequently introduced calculation errors. Second, integrates geometric cleanup, high-density meshing, multi-physics solvers, and acoustic post-processing within a single, unified user interface. This is a critical technical capability that alternative software solutions lack, as competitors typically require users to piece together multiple disparate applications to complete a full simulation workflow, creating severe data-translation bottlenecks and operational inefficiencies. Third, Siemens software architecture allows the complete suite to execute locally on isolated, on-premise workstations and high-performance computing clusters. This addresses the reality of defense engineering within secure, air-gapped enclaves, whereas competitor suites mandate constant internet access or external vendor cloud licensing verification, rendering them non-viable for secure military networks.
6. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this Justification for an Exception to Fair Opportunity will be fair and reasonable.
7. Other Supporting Facts
Transitioning NUWCDIVNPT from the established Siemens HyperWorks environment to an alternative software platform would impose severe, quantifiable financial burdens and unacceptable operational delays on critical naval defense schedules.
