About this file
This document is a set of questions and answers related to a federal contract opportunity for Stevedoring and Related Terminal Services (S&RTS) at the seaports in Kuwait. The contract requires providing all necessary labor, materials, and equipment to handle the import and export of Defense Transportation System (DTS) sponsored cargo at the designated seaports.
The key details include:
- The contract is for a 5-year base period with a 6-month extension option.
- Contractors are required to demonstrate authorization to perform stevedoring services at the Kuwaiti ports.
- Pricing is based on commodity rates established in a Schedule of Rates (SOR), with potential for additional labor and equipment charges in certain situations.
- The contractor is expected to have adequate personnel and material handling equipment (MHE) on hand to immediately commence operations as cargo arrives, though there may be periods with no cargo movement.
- The contractor is responsible for various reporting requirements, customs clearance, and other administrative tasks, the costs of which should be included in the commodity rates.
- The government will provide 24-hour notice for most operations, but the contractor must be prepared to support expedited requests within 2-6 hours at certain ports.

I have a follow up question to #7in round 1 .
For the past five years starting July 2019 the exact average monthly cargo movement through the port was 740 pieces (Import & Export). This number is significantly different from the PWS.
As all the services the contractor is expected to provide is compensated through commodity rates which is directly related to cargo movement the average cargo movement figure is very important to price the contract correctly. The contractor can account for and absorb a 5% to 25% deviation. It is difficult to absorb and account for 60% lower cargo movement throughout the five years. Should the contractor still assume that the average monthly cargo movement through the port for next five years will be approximately 2000 pieces to price the contract?
How much deviation should the contractor account for from the 2000 average monthly cargo figure?
27-Mar-24
The local unit, estimated the number of pieces as an average, the unit used historical, current, and hypothetical data to predict future use. Known facts about military operation, has proven there will be fluctuation in cargo handled per month/year, prediction of port usage in todays environment could/would increase or decrease, rule of thumb for deviations could be a high as 75% and as low as 10%, predicting deviations will be at the offeror desecration. This is an IDIQ contract, as such the quantities could increase or decrease, the guarantees a minimum of $2,500.00 if no cargo is moved in the first year of performance.
25-Mar-24
Section 6.7.1.2 What is the minimum monthly cargo movement the contractor should assume for pricing purposes. How much deviation can the contractor expect from the average?
27-Mar-24 see answer above question 24
26 25-Mar-24 Section 2. 6.10 Third Party Logistics - where is the compensation for these tasks? 27-Mar-24 The SOR has been revised to include Schedule 10 as a result of incorporating new 3PL language in the revised PWS, both documents dated 26 Mar 24.

Section 6.7.4 What specific commodity rate covers cleaning up the yards?

Compensation for services defined in this paragraph are included in the commodity rates established in SOR.

32 25-Mar-24 Section 5.1.4 Where is the line item 1C & 1D on the SOR? 27-Mar-24 These commodities will not be used
33 25-Mar-24 Section 5.20 What specific commodity rate includes intraport transfer? Is it the loading vessel or discharging trucks? 27-Mar-24 Cost for Intraport transfer is all inclusive in commodity rates in Loading/Unloading Vessel and Loading/ Discharging Trucks.
34 25-Mar-24 Section 6.4.1.6 Contractor is not expected to prepare any documentation to clear cargo from the ports? 27-Mar-24 False, The revised PWS paragraph 6.10 has been incorporated to include the documentaion requirement and Schedule 10 has been added to SOR capturing the 3PL commodity line item.

25-Mar-24
If the contractor expects to subcontract the stevedoring operation to a subcontractor, do you require an agreement to be provided between the two companies?
27-Mar-24
The Government will contract with the Prime Contractor who will be the only entity held accountable for meeting the requirements of the PWS and fulfill the contractual obligation to the Government. The Prime will be responsible for any subcontractor performing work on their behalf and ensuring the contract is performed in accordance with the requirements of the PWS. Any failure to perform in accordance with the PWS or fulfilling contractual obligation will fall on the Prime who is the awardee of the contract. The Government does not need a copy of your agreement with the subcontractor.
39 25-Mar-24 Will a letter from the subcontractor showing KPA approval be required if the main contractor intends to subcontract the work? 27-Mar-24 This question was addressed in Round 1 - Solicitation Q&A which was sent to all known offerors via email and posted to Sam.gov on
