ADDENDUM TO FAR 52.212-1 -- INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (SEP 2021)
Paragraph (b) entitled “Submission of Offers” is deleted in its entirety and replaced with paragraph (b) “Submission Information” below.
Paragraph (c) entitled “Period of acceptance of offers” is tailored to read: The Government requires a minimum of 120 calendar days for acceptance of offers submitted in response to this solicitation.”
Paragraph (e) entitled “Multiple Offers” is tailored to read: “The government will not consider multiple offers presenting alternate terms and conditions for satisfying the requirements of this solicitation.”
Paragraph (g) entitled “Contract award (no applicable to Invitation for Bids)” is deleted in its entirety and replaced with paragraph (g) “Contract Award” below.
(b) Submission Information:
Offeror’s are to submit via email an introductory document and two volumes: Volume 1 – Technical and Volume II – Price (Attachment 1 – RFP Pricing Sheet). The introduction document should include the information listed below and any other items for which a location has not otherwise been specified. Failure to follow these instructions may result in removal from this competition.
a. Complete and provide Attachment 3, Contact Information Sheet.
b. Acknowledgement of Solicitation Amendments (if any).
c. Any Certifications or Representations required by this RFP. These include FAR 52.209-7, FAR 52.212-3, and FAR 52.212-3 Alt I para. (c)(11), and FAR 52.219-28.
Offers shall be submitted via email to Ms. Cassandra Range, cassandra.a.range.civ@mail.mil and Mr. Kerry Blasingim, kerry.g.blasingim.civ@mail.mil. Offers are to be submitted in Times New Roman, with a font size of 12. Smaller font size is allowed for charts, graphs, and figures, however must not be less than 8.
Submission Requirements:
Volume I - Technical Approach
The offeror shall submit a realistic technical approach which clearly describes how the offeror will achieve the objectives of the SOW requirements as stated in paragraph 1.3. Proposals shall include a drawing of the rail chain tiedown assembly which clearly depicts the proposed design of the entire rail chain tiedown assembly in accordance with (IAW) paragraph 1.3 of the Statement of Work (SOW). The drawing shall clearly label each individual component as listed in Paragraph 1.3 of the SOW to include type, number and manufacturer of each part.
The offeror shall submit confirmation that the rail chain tiedown assemblies offered in response to this solicitation conform to all requirements of the Association of American Railroads (AAR) Open Top Loading Rules (OTLR), Section 1, Part 2, paragraph 21 current as of the date of the solicitation. The following is a list of acceptable sources of confirmation documentation. Only sources listed below will be considered.
a) A report from an independent testing laboratory confirming that the complete rail chain tiedown assembly meets the testing thresholds stated in paragraph 1.3 of the SOW. The report shall include the source, design and part numbers for each component being tested and utilized to fulfill this requirement.
b) A letter from the AAR stating that any component being proposed to fulfill this requirement has met the necessary AAR, OTLR requirements and is being added to the OTLR.
c) A formal request from the offeror to the AAR, OTLR committee requesting the addition of any component being proposed to fulfill this requirement be added to the OTLR list of acceptable parts. This request shall be accompanied by official documentation that all requirements of the OTLR have been met.
d) An independent laboratory report stating that any component(s) being proposed to fulfill this requirement and not specifically listed in the OTLR has been tested as required by OTLR Rule 47. The report shall state the component(s) meets the required strength and any other OTLR requirements, such as identifying marks have been met.
Volume II - Price
The offeror shall submit proposed rates for supplies to be provided utilizing Attachment 1, RFP Pricing Sheet, to the solicitation. Offerors shall submit pricing for each CLIN (CLINs 0001, 1001,2001, 3001 & 4001). Pricing shall be per car set (1 car set = 36 rail chain tiedown assemblies) and include transportation costs. Offers without proposed rates for each CLIN on the Pricing Sheet will be determined incomplete and unawardable.
In order to be considered for award, prices must be determined fair and reasonable using one or more techniques set forth in FAR 13.106.3.
(g) Contract Award
The Government intends to award without requesting or accepting revised offer(s). Therefore, an Offeror’s initial offer shall contain the most favorable terms and reflect its best possible performance potential. The Government reserves the right to award no contract, depending upon the quality of the offer submitted and the availability of funds.

Written questions will be answered in writing and provided to all offerors via a posting to SAM.gov. However, due to the time required to research a question and provide an answer, questions received less than 10 calendar days prior to the due date of offers specified in this solicitation may not be answered. Solicitation changes will be made via amendment and posted to SAM.gov.
