FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS

FAR 52.212-2 is replaced in its entirety:

(a) The Government intends to award a single indefinite delivery, indefinite quantity (IDIQ) contract as a result of this solicitation. The Government intends to evaluate proposals and award a contract without conducting discussions. However, the Government reserves the right to conduct discussions if it is determined to be in the best interest of the Government. The Government will conduct a low price technically acceptable (LPTA) source selection. To receive an award, the Offeror must (1) be deemed responsible IAW FAR Part 9, (2) conform to all required terms and conditions, and (3) represent a best value to the Government, price and other factors considered.

To arrive at a source selection decision, procedures detailed in FAR 15.101-2 will be utilized.

(1) Each offeror’s proposal will be evaluated against the following factors:

(a) Factor 1 – Business Proposal

(b) Factor 2 - Technical Proposal

i. Subfactor 1 –Phase-In/Transition Ramp-up

ii. Subfactor 2 – Technical Approach

iii. Subfactor 3 – Mission Essential Contractor Services Plan

iv. Subfactor 4 – IT Integration

(c) Factor 3 - Price

(2) Relative order of importance: Price will be evaluated but not rated. The Business Proposal and Offeror’s

Technical Proposal will be rated on an Acceptable/Unacceptable basis.

(b) The above factors shall be evaluated in the following manner:

(1) Factor I – Business Proposal. The Offeror’s Business Proposal will be evaluated on an Acceptable/Unacceptable basis as defined below. The Government will not award to an Offeror that has an Unacceptable rating for the factor.

RATING DEFINITION

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

In order to be rated Acceptable, the Offeror’s proposal shall conform to all requirements of this solicitation, including the Proposal Preparation Instructions under Addendum to FAR 52.212-1. The Offeror must be registered in System for Award Management (SAM) at the time of proposal submission.

(2) Factor II—Technical Proposal. The Offeror’s Technical Proposal will be evaluated on an Acceptable/Unacceptable basis at the subfactor level as defined below. The Government will not award to an Offeror that has an Unacceptable rating for any subfactor.

RATING DEFINITION

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

(a) Subfactor 1. –Phase-In/Transition Ramp-up. To be rated Acceptable, the Offeror must submit a realistic transition plan for accomplishing the requirements identified in the PWS, Paragraph 1.3.1.1. The Offeror’s approach shall demonstrate an understanding of the implementation schedule requirements and should result in accomplishment of the tasks to be fully operational to begin accepting HHG/UB shipments not later than 180 days after award.

(b) Subfactor 2. – Technical Approach. To be rated Acceptable, the Offeror’s Technical Approach must clearly describe the contractor’s experience, capabilities, personnel, techniques, procedures, and programs required for achieving the objectives of the PWS paragraphs cited below. The proposed approach shall effectively demonstrate the Offeror’s ability to comply with these PWS requirements. Proposals that merely paraphrase the requirements of the Government’s PWS, or use such phrases as “will comply” or “standard techniques will be employed,” will be considered Unacceptable and will not be considered further.

1. Facilities (PWS 1.3.2.3)

2. Remote Climate Sensor Monitoring (PWS 1.3.2.4)

3. Handling-In (PWS 1.3.3 and subparas)

4. Storage (PWS 1.3.4 and subparas)

5. Handling-Out (PWS 1.3.5 and sub paras)

(c) Subfactor 3. – Mission Essential Plan. To be rated Acceptable, the Offeror must submit a realistic Mission Essential Contractors Services Plan which meets the requirements set forth in DFARS clause 252.237-7024.

(d) Subfactor 4. – IT Integration. To be rated Acceptable, the Offeror must provide a Systems Integration plan which clearly identifies the activities and timeframes required to interface the offeror’s IT system(s) with Government IT systems (i.e., Milmove/IGC). The System Integration Plan shall demonstrate full integration by showing the establishment of successful information systems connections between the Offeror’s IT system and

Government-managed system in accordance with PWS 1.3.6.3. and 1.3.6.4. IGC will be the initial interface used.

Milmove is an OPTIONAL CLIN should a new IT platform need to be used.

(3) Factor III - Price Proposal. Price will be considered in determining the best value Offeror. Price will be evaluated for completeness; however, price will not be rated. In order to be considered for award, the Total Evaluated Price (TEP) must be determined fair and reasonable. Prices not included in the TEP, as identified in Attachment 2, Pricing Schedule, will be evaluated for fair and reasonableness. The Offeror’s proposed pricing will be evaluated using one or more of the techniques set forth in FAR 15.404-1(b)(2) to determine prices fair and reasonable. Proposed pricing will also be evaluated to determine that all prices are complete (a proposed price has been entered in all cells with a light green background in Attachment 2, Pricing Schedule). The Government may determine a price proposal is unawardable if the prices proposed are materially unbalanced. Unbalanced pricing exists when, despite a fair and reasonable TEP, the price of one or more line items is significantly overstated or understated and poses an unacceptable risk to the Government.

(a) Options. The Government will evaluate offers for award proposed by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). If the Government extends the contract pursuant to FAR 52.217-8, Option to Extend Services, such extension will be at the rates in effect under the contract when the option is exercised. For the TEP calculation, pricing for the 6-month extension of services period will be based on the prices of 1/2 the total extended prices for Option Period 4 (Attachment 2—Pricing Spreadsheet Tab B).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
