Attachment 5 ‐ Q&As

Question # Document Reference (para./line item) Question Government Response Soliciation Change (if any)

RFP Pg 3‐6

Do we have to fill in estimated annual values in addition to submission of Pricing Schedule?

It is not necessary to fill in the SF1449 with prices. Pricing is captured solely through Atch 2, Schedule of Rates.

None.

RFP

Pg 45 Part 1 (Addendum 52.212‐1)

As flowcharts/bullet points are not allowed, 25 page allowable limit for the Technical Proposal is not sufficient to adequately describe work processes. Can 25 page limit be increased?

Neither flowcharts or bullet points are unallowed. The issue is they tend to take up a lot of space and don't adequately address how the requirement will be performed because indicating an order in which tasks are performed is not equivalent to describing how those tasks are accomplished. That said, given the breadth of airside services provided in this requirement, we've extended the page limitation to 28 pages.

Addendum to 52.212‐1(b)(5)(B) has been revised accordingly.

PWS c.3.7.2.4

Please elaborate on content of "Environmental Training" for which all personnel have to be certified.

Training must be sufficient to satisfy the requirements outlined in the UAE Port, Customs & Free Zone Corporation Enivornmental, Health and Safety guidelines. Those guidelines incorporate EHS standards from HSE‐UK, OSHA, NFPA, IAEA, API, IP, ASME, IGEM and ASHARE.

None.

PWS d.6.2.2.3

Clause states that Loading of Geared and Non‐geared Vessel is to be priced under the same Schedule. The labor and MHE required to load a Non‐geared Vessel will substantially be more than for a Geared Vessel. Please clarify.

The overwhelming majority of loading operations (90% or more) will be on non‐geared vessels. Rates should be based on non‐ geared vessel operations. Labor used for loading and discharge operations should be accounted for in the commodities CLIN.

None.

PWS f.6.2.2.4

As with c. above, Geared / Non‐geared Vessel is not specifically mentioned in the clause but Dischargeing from both types will be significantly different in terms of Labor and MHE required.

Please clarify.

The overwhelming majority of discharge operations (90% or more) will be on non‐geared vessels. Rates should be based on non‐geared vessel operations. Labor used for loading and discharge operations should be accounted for in the commodities

CLIN.

None.

PWS g.6.2.6.7

Please confirm we can also re‐charge Additional Labor as and when required. (Only re‐charge of Equipment is mentioned).

The additional extra labor charge would only be applicable when the CLIN does not already include labor as part of the rate. For example: the detention rate for a 50T crane would not have an extra labor charge because the CLIN is inclusive of the labor and

MHE.

None.

PWS h. 6.3 & 6.4

Observation that both of these Clauses are almost identical in their reference to GFE.

There was some duplicated information. Resulting from the change, 6.3 is specifically in reference to any Government‐ Furnished property. 6.4 is specific to Contractor‐Furnished property.

Removed duplicate information. Rev.1 PWS section 6.4 follows new numbering format of document.

PWS i.6.5.1.1

Please clarify as to USG not paying for shifting of Commercial Cargo / Obstacles for the creation of a Staging area. The Ports in question are primarily commercial / merchant in nature, therefore there could be a lot of commercial cargo to relocate in order to create a free space on behalf of the USG. Location and volume of Merchant Cargo in the Port is not under the control of Contractor so we would appreciate some consideration for recharge of necessary MHE and Labor to the USG if costs are incurred.

Recommend changing the sentence "Government will not pay for handling any commercial cargo and/or obstacles that need to be removed for the staging of government cargo." to read..."Government will not pay for handling any port/contractor owned/leased assets and/or obstacles that need to be removed for the staging of government cargo. The total staging area to be cleared will be determined by the COR/ACOR." The negative implication here is that non‐port/contractor asset removal would be compensated as agreed by the USG/Contractor prior to operation.

Reference section 6.4.1.1 in Rev.1 PWS for change in verbiage that reads…" Government will not pay for handling any port/contractor owned/leased assets and/or obstacles that need to be removed for the staging of government cargo. The total staging area to be cleared will be determined by the COR/ACOR."

PWS j.6.5.1.5

Can you confirm that permanent office space will only be required at Jebel Ali and Maktoum Airport?

No confirmation. The required locations can change as the mission changes. All locations identified in the PWS within UAE are subject to the office requirement.

None.

UAE S&RTS ‐ HTC711‐18‐R‐R006

PWS k.6.5.3.1

Equipment hire is to include Mob ‐ Demob. However, geographical distance and time required for mob / demob will vary considerably depending on final delivery location requirement for the equipment e.g. Port requirement compared to inland delivery point to discharge Inland Transportation cargo. Mob / demob distance to the Airports in the Solicitation also varies considerably and so end pricing could end up distorted. Please clarify how to incorporate Mob / Demob in to Equipment hire rates for Schedule 4 and 11.

Recommend changing the sentence "All equipment rates applicable to this contract are inclusive of driver/operator, fuel, lubricants, slings and accessories and mobilization/demobilization costs."...to read…"All equipment rates applicable to this contract are inclusive of driver/operator, fuel, lubricants, slings and accessories, riggers and mobilization/demobilization costs.

Mobilization/demobilization costs for services requested outside of the identified operating locations in para. 1.2.1 will be charged based on rates identified in Schedule 15.

Reference section 6.4.3.1 & 5.6.2 in Rev.1 PWS for change in verbiage…"All equipment rates applicable to this contract are inclusive of driver/operator, fuel, lubricants, slings and accessories, riggers and mobilization/demobilization costs.

Mobilization/demobilization costs for services requested outside of the identified operating locations in para. 1.2.1 will be charged based on rates identified in Schedule 15. " NOTE: riggers have been added to this description.

PWS l.6.13.2.1

Disposition of Air cargo to Road Transport re‐charge Schedule is stated as being Schedule 1A. Please confirm that correct Schedule is 1D.

6.13.2.1 should read "1D" not 1A. Reference section 6.12.2.1 in Rev.1 PWS for change in verbiage.

Changed from "1A" to "1D".

PWS m.6.13.4

Aircraft Service support. Payment of landing fees and so on for Aircraft could involve considerab le financial outlay to the Authorities. We request that a reasonable service charge be allowed for providing this service.

An administrative fee of 5% of the total charges billed is already identified as CLIN 0244 (Schedule 14).

Jebel Ali (Dubai), Khalifa (Abu Dhabi) and Fujairah are in three different emirates and are managed by different authorities.

The Port tariff rates and rates for Airport / other services are different for these three locations. It is recommended that the Schedule of Rates for the 3 locations be given independently (in 3 different worksheets) and not combined as it is now.

The vast majority (99%) services are requested in Jebel Ali. Only one schedule will be produced.

None.

Pre‐Proposal Conf

Pre‐Proposal Conf

As per Pre‐Proposal Conference, it was mentioned that licenses for all sea ports and airports operating is needed. All ports in UAE are managed by the government so what license documents are expected from the Contractor during bid submission? Similarly at Al‐Maktoum International Airport, all stevedoring operations are conducted by DNATA – so what documents are expected from the contractor from this location.

As required by the RFP, offerors are to submit any port licenses that apply. The implication here is that if a given Emirate requires you to register to operate at their port and thus provides you with a document showing proof of your authorization to work at their port, the USG requires a copy of that document with your proposal. As far as DNATA, a letter of intent from DNATA stating they would be able to perform airside services on behalf of your company would be best. Our understanding is that DNATA is the only company allowed to perform those services at Al‐Maktoum, so there's not really a choice in the matter where those services come from. However, we do want to know that DNATA is willing to work with your company to accomplish those services.

None.

PWS Para. 1.2.1

Al‐Dhafra and Al‐Minhad are military air bases. Is the contractor expected to load/unload aircraft at these bases? Also for inland transport and services other than load/unload – upon submission of required documents, will SDDC provide contractor access to these air bases?

1. No, the contractor will not handle aircraft at Al Dhafra or Al Minhad. 2. Yes, SDDC/USG assists with accessing restricted military bases.

None.

PWS

Para. 6.13.6.1.2

(3PL)

Any additional locations within UAE other than Al‐Maktoum International Airport – how much notice period will be given to the contractor for activating 3PL Services.

The required locations are identified in 6.13.6.1.2. Additional locations can be added with 30 calendar day's notice.

See section 6.13.6.1.2 in Rev.1. PWS for change in verbiage…"Any additional locations within UAE shall be added when requested by COR/ACOR with 30 calendar days notice."

PWS 6.5.1.5

Will Contractor 3PL Staff be allowed to sit/operate on this office?

Yes, subject to COR/ACOR/USG discretion. None.

SOR

Schedule 6: Line Item ‐ 0161

Line Item 0161 Office Spare Requirement – will it be a concrete building type or are portable cabins acceptable? If any permissions are needed, will SDDC obtain that from DPW

Currently, permanent structures are not needed to satisfy the requirements of this contract. Those requirements are subject to change. SDDC will assist with obtaining all necessary permissions for office space as needed.

None.

SOR

Schedule 13:

Line Item ‐ 0227

Line Item 0227 ‐ Office Space (Permanent) – will it be a concrete building type or are portable cabins acceptable? If any permissions are needed, will SDDC obtain that from DPW

None.

SOR Schedule 1F

There is a mistake in Grand Total Acknowledged. Corrected formula. Rev.1 Schedule of Rates added.

SOR

After Schedule 2A and before

4A

Schedule 3 and Schedule 4 are Missing. SOR's structured correctly to cover required services and for proper invoicing. The skip in schedule numbering is inconsequential to this requirement.

None.

SOR Port Tariff

After submission of the proposal, if the port tariff at any sea port is changed by the port Authority/UAE Government, how will the contractor be reimbursed?

The RFP and resulting contract will include the clause DFARS 252.247‐7002, Revision of Prices, which allows for the adjustment of prices throughout the term of the contract. Port tariff changes are commonly accomplished by the authority of this clause.

Administratively the contractor would have to inform the contracting officer of the changes, then negotiate fair and reasonable adjustment of the applicable prices.

None.

SOR

Airport Handling

After submission of the proposal, if the airport handling charges at any airport is changed by DNATA, how will the contractor be reimbursed?

See answer to #22. None.
