Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.”
Paragraph (h) entitled “Multiple awards” is tailored to read: “The Government intends to award one contract as a result of this solicitation. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.”
ADDENDUM TO FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award one contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered: The following factors shall be used to evaluate offers:
A. Technical Worksheet (Acceptable/Unacceptable)
B. Price
(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This includes options under FAR clause 52.217-8, Option to
Extend Services, which applies to this solicitation. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Basis for contract award - This acquisition is being conducted under FAR Part’s 13, Simplified
Acquisition Procedures, Subpart 13.5 and Part 12, Acquisition of Commercial Items of the Federal Acquisition
Regulation (FAR). Offers will be evaluated using the factors identified in FAR 52.212-2, Evaluation –
Commercial items and this addendum. Noncompliance may be grounds to eliminate the quote from consideration for contract award. Award will be made on the basis of lowest evaluated price of the quote whose technical factor is rated “acceptable”.
Specifically, by submitting a quote the offeror understands and accedes to all the terms and conditions of this solicitation. The evaluation process shall proceed as follows: First, the Technical Worksheets of all offers received will be evaluated and receive a rating of Acceptable or Unacceptable. In order to be rated as
Acceptable, the Technical Worksheet must meet the Government's minimum requirements. Quotes deemed
Unacceptable are those that fail to meet the Government's minimum requirements.
All offers Price quote whose Technical Worksheet received an acceptable rating will then b e evaluated to determine fair and reasonableness using one or more techniques set forth in FAR 13.106-3. The
Government will review the prices quoted in Attachment 2 of the pricing Excel (.xlsx) spreadsheet to determine if the prices quoted are fair and reasonable. If the lowest priced offer is deemed to have fair and reasonable prices, the Government will complete a responsibility determination IAW the criteria specified in
FAR 9.104-1. If found responsible, the evaluation process stops at this point as that offer represents the best value to the Government. Award shall be made to that offeror without further consideration of any other offers.
If the lowest priced offeror cannot be determined fair and reasonable or if the lowest offeror is found to be non-responsible, the next lowest priced offer will be evaluated. This process will continue until an offer is judged to have an acceptable Technical Worksheet, fair and reasonable prices, and the offeror is deemed responsible or until all offers have been evaluated.
(e) The Government reserves the right to award no contract at all depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate offers and award a single IDIQ contract without requesting or accepting revised offers. Therefore, the offerors will be advised that their initial offer should contain the most favorable terms and reflect its best possible performance potential.
The Contracting Officer at any time may inquire about any offeror’s Quote if additional information or a revised Quote is required. The Contracting Officer may inquire about all, none, or as many quotes as needed, however, the Contracting Officer shall treat all quoters fairly and impartially, in accordance with FAR 1.102-
2(c)(3).
1. The following factors shall be used to evaluate offers:
A. Factor I: Technical Worksheet. Each offeror’s Technical Worksheet will be evaluated as
Acceptable or Unacceptable, as defined below. An Offeror will be considered ineligible for award if the
Technical Worksheet is not complete.
RATING DESCRIPTION
Acceptable Technical Worksheet clearly meets the minimum requirements of the solicitation.
Unacceptable Technical Worksheet does not clearly meet the minimum requirements of the solicitation.
B. Factor II: Price.
(1) Completion of the pricing schedule will require the user to have good working knowledge of the
Microsoft Excel program. The Offeror shall complete and submit the Schedule of Rates Sheet. The price quote shall be submitted as an attachment to an email and contain no hidden formulas or external links. The
Government will utilize the Excel (.xlsx) spreadsheet to capture pricing and to calculate the Total Evaluated
Price (TEP) for evaluation and award purposes. Thus, the total TEP is calculated using the rates proposed in all tabs where proposed unit pricing is required, for the base and all option periods, to include the 6 month extension of services. The summation of the base, all option years, and the six month extension of services will constitute the total price. Offeror will be considered ineligible for award if all required pricing is not complete.
(2) In order to be considered for award, price must be determined fair and reasonable using one or more techniques set forth in FAR 13.106-3.
