SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

SOLICITATION/CONTRACT FORM

The required response date/time has changed from 20-Jun-2016 02:00 PM to 08-Jul-2016 02:00 PM.

The following have been modified:

ADDENDUM 52.212-2

ADDENDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014):

Paragraphs (d) and (e) are added to read as follows:

(d) Basis for contract award - This acquisition is conducted under FAR Part’s 12, Acquisition of

Commercial Items, Subpart 12.6 and Part 15, Contracting by Negotiation of the Federal Acquisition Regulation

(FAR). Government will evaluate offers using the factors identified in FAR 52.212-2, Evaluation – Commercial items and this addendum. Non- compliance may be grounds to eliminate the proposal from consideration for contract award. Government will make an Award on the basis of Lowest Price Technically Acceptable Source

Selection Process, IAW FAR 15.101-2. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors, and the Addendum to FAR 52.212-1, the Offeror agrees to the terms of this solicitation.

Specifically, the evaluation process shall proceed as follows:

First, Government will rank proposals in price order from lowest to highest based on the total evaluated price (TEP).

Government will then evaluate the lowest ranked TEP offeror’s technical proposal to receive a rating of Acceptable or Unacceptable. For an Acceptable rating, the Technical proposal must meet Government's minimum requirements as stated. Proposals deemed Unacceptable are those that fail to meet Government's minimum requirements.

If the lowest ranked offeror’s technical proposal is rated Acceptable, Government will then evaluate pricing as proposed in Attachment 2, Pricing Schedule (.xlsx) spreadsheet to determine fair and reasonableness using one or more techniques set forth in FAR 15.404-1(b)(2).

Additionally, IAW FAR 15.404-1(g), Government will review proposed prices to determine if unbalanced pricing exists.

If proposed prices are unbalanced, Government will note this and consider the risk to the Government in making the source selection decision. IAW FAR 15.404-1(g)(3), if the lack of balance poses an unacceptable risk, Government may reject the offer and not consider further for award. If it is determined the technically acceptable offer with the lowest ranked TEP has fair and reasonable prices and balanced pricing (or if unbalanced pricing exists that it does not pose an unacceptable risk), Government will complete a responsibility determination IAW criteria specified in

FAR 9.104-1.

Government will consider each Offeror’s Corporate Experience Information in Government’s responsibility determination IAW standards specified in FAR 9.104-1. If found responsible, the evaluation process stops at this point as that offer represents best value to the Government.

Government shall then make Award to that Offeror without further consideration of any other offers.

If the technically acceptable offer with the lowest ranked TEP is determined not to have fair and reasonable prices, unbalanced pricing poses an unacceptable risk to the Government or if the Offeror is found non-responsible, Government will evaluate the technically acceptable offer with the next lowest ranked TEP in accordance with the paragraph above. This process will continue for any technically acceptable offers in order of ascending TEP until an

Offeror is judged to have an acceptable technical rating, fair and reasonable prices, balanced pricing (or if unbalanced pricing exists that it does not pose an unacceptable risk) and the Offeror is deemed responsible; or until

Government has evaluated all technically acceptable offers.

If all technically acceptable offers are not awardable based on the initial evaluation process above, the Source

Selection Authority (SSA) will determine whether it is in the Government's best interest to enter into discussions. If the SSA determines to enter into discussions, SSA will establish a competitive range IAW FAR 15.306(c). The source selection team will complete the discussion process, request final proposal revisions, and document final evaluation results IAW DOD Source selection procedures for those

Offerors within the competitive range. After evaluation of final proposal revisions, the SSA will make a selection of the best-value proposal consistent with stated evaluation criteria.

Government shall use the following factors to evaluate offers:

A. Factor I: Technical Approach. Government will evaluate each Offeror’s written Technical Proposal to determine if the Offeror’s technical approach is Acceptable or Unacceptable at the subfactor level, as defined below.

RATING DESCRIPTION

Acceptable Proposal meets minimum requirements of the solicitation.

Unacceptable Proposal does not meet minimum requirements of the solicitation.

If any technical subfactor is rated Unacceptable, the overall Technical Proposal is Unacceptable. If all technical subfactors are rated as Acceptable, then the overall Technical Proposal is Acceptable. Offeror’s proposals must receive a rating of Acceptable for all of the following technical subfactors for award consideration:

(1) Subfactor 1 – Stevedoring Business License. For an Acceptable rating, Offeror shall provide a copy of the Prime Contractor's valid and current Port Stevedoring Business License issued by the Singapore Government or its representative. Offeror cannot substitute a subcontractor's license for prime contractor's license.

(2) Subfactor 2 – Mission Capability. For an Acceptable rating, Offeror’s technical approach must clearly describe the concept of operations in the following objectives of the PWS. When evaluating the Offeror’s Technical

Approach, the Government will determine if the approach demonstrates:

a) Offeror’s ability to conduct operations in accordance with applicable safety standards and regulations.

b) Offeror’s ability and knowledge of ocean terminal operations, minimizing cargo damage/loss and time to complete operations to include:

• Discharging vessels including:

• De-lashing/unsecuring cargo, and properly storing lashings.

• Lifting cargo off ship to pier apron or other conveyance.

• Disposing of operational materials and cleaning vessel holds.

• Loading vessels including:

• Stow-planning to ensure vessel trim and stability and making maximum efficient use of available space aboard vessel.

• Proper placement, lashing/blocking/bracing of cargo aboard ship.

• Disposing of operational materials and cleaning vessel holds.

• Loading/unloading conveyances (rail/trucks/barges-lighterage), ensuring that cargo is properly placed and secured (load), sideboards, chains, binders, and other associated equipment is placed back on conveyances after completion of operations.

• Cargo (containers/vehicles/other equipment) drayage in/around Singapore, as required.

• Timely/accurate receipt/accountability/disposition of cargo without loss or damage.

• Stuffing/Stripping containers including blocking bracing cargo (stuffing) and disposal of materials and cargo disposition (stripping)

• Cargo Preparation/Intra-Terminal Transfer

• Proper handling/stowage of ammunition and hazardous cargo

• Cargo onward Movement/Port Clearance

• Cargo Yard Management, Staging and Call Forwarding including acquisition of staging area(s) required to support operations.

• Container leasing and storage without detention.

• Singapore Customs clearance.

• HAZ MAT spill management and clean up.

• Cargo documentation/accountability including HAZ MAT and sensitive cargo.

c) Approach demonstrates Offeror’s ability to maintain accountability and tracking of all DoD-sponsored cargo offered for shipment.

d) Approach demonstrates Offeror’s ability to plan and schedule all operational activities to load/discharge cargo on/off multiple vessel types to include proper stow location, nesting/de-nesting, secondary loads, etc.

B. Factor II: Price.

(1) Completing the pricing schedule will require Offeror to have a good working knowledge of the Microsoft

Excel program. Offeror shall complete and submit the Pricing Schedule, Attachment 2. Offeror shall submit the price proposal as an attachment to an e-mail with no hidden formulas or external links. Government will utilize the

Excel (.xlsx) spreadsheet to capture pricing and calculate the Total Evaluated Price (TEP) for evaluation and award purposes. Thus, the TEP is calculated using the rates proposed in all cells where proposed unit pricing is required, for the base and all option periods, to include a 6 month extension of services. Summation of the base, all option years, and the six month extension of services will constitute the TEP with any proposed escalation. Government will consider Offeror ineligible for award if all required pricing is incomplete.

Government shall utilize this information to analyze Offeror’s rates. Upon contract award, this data will form the basis for any price adjustments pursuant to the Revision of Prices clause, DFARS 252.247-7002, and, as such, must provide the means of determining application of any requested adjustments and calculating revised unit prices.

(2) For award consideration, Government will determine if price is fair and reasonable and balanced (or if unbalanced pricing exists, that it does not pose an unacceptable risk to the Government) using one or more techniques set forth in FAR 15.404-1(b)(2).

(e) Government reserves the right to award no contract at all depending on the quality of proposals submitted and availability of funds for the requirement. Government intends to evaluate proposals and award a single IDIQ contract without discussion. Therefore, Government will advise Offerors that their initial offer should contain the most favorable terms and reflect their best possible performance potential. Government reserves the right to clarify aspects of the proposals and hold discussions, as allowable under FAR Part 15 procedures.
