A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. Evaluation Factors for Award
ADDENDUM TO FAR 52.212-2, EVALUATION - COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES
The award shall be made on a "Past Performance Price Tradeoff" basis. Past Performance will be significantly more important than Price.
The Government will first review quotes received to determine if they are compliant with the solicitation requirements. A compliant quote is one that meets all of the terms, conditions, and specifications in the solicitation. The Offeror must provide all documents listed and comply with all quote instructions in order for their quote to be considered "compliant" with this solicitation.
Only compliant quotes will be evaluated for award.
This evaluation approach may result in an award to a higher-rated (for past performance), but higher -priced offer if the Government determines that the past performance of the higher-priced offer outweighs the price difference. Price could become the determined factor if the proposals are determined to be essentially equal for Past Performance. The selection process is subjective by nature and professional judgement is implicit throughout the trade-off process. The purchase order will be awarded to the Offeror whose quote, based upon evaluation criteria, represents the best value to the Government.
Although the Government anticipates awarding without interchanges, the Government reserves the right to, and may conduct interchanges with some, none or all Offerors at its discretion.
Therefore, the offer should contain the Offeror's best terms and conditions.
EVALUATION CRITERIA: FACTOR 1 - PAST PERFORMANCE
Evaluation Process:
This factor is assessed with an overall Performance Confidence Assessment (PCA) rating which is based on an integrated assessment of the Offerors recent, relevant, and quality past performance. The resulting performance confidence assessment rating is determined at the factor level and represents an overall evaluation of contractor performance. Offerors without a record of recent, relevant, and quality past performance or for whom information on past performance is so sparse that no meaningful confidence assessment rating can be reasonably assigned will not be evaluated favorably or unfavorably on past performance and, as a result, will receive a "Neutral Confidence" rating for the Past Performance factor.
For Factor 1, Offerors must receive a rating of "Substantial Confidence," "Satisfactory Confidence," or a "Neutral Confidence" rating, in order to be eligible for award. Offerors receiving a "Limited Confidence" or "No Confidence" rating are not eligible for award.
Recency Assessment: An assessment of the past performance information contained in the Offeror's submittals will be made to determine if its recent. To be recent, the effort must be ongoing or must have been performed within the past three (3) years from the date of issuance of this solicitation.
Relevancy Ratings: The Government will use the following relevancy definitions/ratings when assessing relevant past performance.
TABLE 1. Relevancy Rating
Adjectival Rating Description Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
More relevant and more recent past performance may weigh more heavily than less relevant and less recent past performance in determining the PCA. The Government will use the definitions/ratings in Table 3. Performance Confidence Assessment when making an overall
PCA.
Performance Quality Assessment: The Government will consider the performance quality of recent, relevant efforts. For each recent, relevant past performance reference reviewed, the performance quality of the work performed will be assessed in the PPQs, PPIRS information, CPARS, interviews with Government customers and commercial clients. It may include interviews with DCMA officials or other sources known to the Government. The quality level assigned by the performance raters is shown in Table 2. Performance Quality Ratings:
Table 2. Performance Quality Ratings
The Government will use the following definitions/ratings in Table 3. Performance Confidence Assessment when making an overall PCA.
Table 3. Performance Confidence Assessment
Adjectival Rating Description
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
EVALUATION CRITERIA: FACTOR 2 - PRICE
