52.212-2 ADDENDUM
Paragraph (a) is hereby replaced with the following:
Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible quoter on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-price factors. The following factors shall be used to evaluate Quotes:
• Factor I: Technical
• Factor II: Price
Contract award will be made to the quoter provided its technical response conforms to the requirements of the solicitation; its price is determined to be fair and reasonable by the contracting officer; and the contracting officer determines the quoter is responsible.
Technical capability will be evaluated based on the contractor’s quote. The Contractor shall detail how the requirements will be fulfilled for the Specific Task outlined in the PWS. The Government will evaluate whether the Quoter has demonstrated in their technical/management plan that it meets all minimum requirements of this solicitation.
Quotes that do not demonstrate the quoted services meet all requirements will not be considered further for award.
If an quoter does not indicate whether its quoted services meet a certain minimum requirement, the Government will determine that it does not.
PROCESS FOR AWARD:
• Impartial consideration will be given to all Quotes received in response to this solicitation. Each quote will be evaluated strictly in accordance with its content and the Government will not assume that performance will include areas not specified in the quote.
• Prior to evaluation of Quotes, the Government will conduct a compliance review to determine if each quote meets all submission requirements as outlined in 52.212-1 and Addendum to 52.212-1. If a quote is found to be non-compliant, no further consideration will be given.
• All Quotes received in compliance with this solicitation will receive an evaluation as outlined below, FACTOR 1: TECHNICAL. The Government will evaluate Technical Performance for merit. HT001427QE004
BASIS FOR AWARD.
EVALUATION:
FACTOR I: Overall Technical Evaluation. A combination of the technical merit and past performance subfactors.
Technical merit demonstrates the ability to meet the requirements of the solicitation and past performance rating demonstrate the probability of meeting the minimum past performance solicitation requirements.
Overall Technical Acceptable/Unacceptable Ratings Acceptable Proposal meets acceptable ratings for both Technical Merit and Past
Performance sub-factors.
Unacceptable Proposal does not clearly meet the minimum requirements for either the Technical Merit or Past Performance sub-factors.
SUB-FACTOR 1A. Technical Merit. Technical merit ratings reflect the Government's confidence in each offeror's ability, as demonstrated in its proposal, to perform the requirements stated in the Performance Work Statement (PWS) and solicitation. In evaluating the proposal risk, the Government will make an independent judgment of the probability of success, the impact of failure and the alternatives available to meet the requirements.
The following adjectival ratings will be used in evaluating each offeror's technical merit of their proposal.
Technical Merit Acceptable/Unacceptable Ratings Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Note: To receive consideration for award, a rating of acceptable must be achieved for the technical merit sub-factor.
SUB-FACTOR 1B. Past Performance. The past performance evaluation is an assessment of the offeror's probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror's record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
Sources of Past Performance Information for evaluation are as follows:
• Past performance information provided by the offeror, as solicited;
• Past performance information obtained from any other sources available to the Government, to include, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.
• In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be agency’s assessed favorably or unfavorably on the evaluation criteria and will therefore receive a neutral rating under Past Performance.
The following adjectival ratings will be used in evaluating the past performance for each offeror.
Past Performance Acceptable/Unacceptable Ratings Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.
Unacceptable Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: To receive consideration for award, a rating of acceptable must be achieved for the past-performance sub-factor.
FACTOR II: PRICE.
Price Analysis will be conducted. Quotes will be evaluated for price reasonableness, balance, and completeness.
The quoted price will be evaluated for the entire effort. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. Some of those techniques are, but not limited to, comparison of quoted prices received in response to the solicitation and/or comparison of quoted prices with the Independent Government Estimate. Price must be determined to be fair and reasonable.
Within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept an quote (or part of an quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
