Questions and Responses
Q1: Is there an incumbent contractor associated with this work? If so, please provide the name of the contractor and the contract number.
Response1: The incumbent contractor is Pen-Link LTD, 5936 VanDervoort Dr., Lincoln, NE 68516. The incumbent contract number is HSSS01-13-C-0012.
Q2: The RFP states that "A small business set-aside/reservation is not in effect. The applicable NAICS code is 511210, with an applicable small business size standard of $25.0 million." If a vendor does not fall under this NAICS code, and if it exceeds the $25.0 million small business size standard for this NAICS, would it still be eligible to respond to the solicitation?
Response2: A vendor would not be ineligible solely if it has does not fall within the stated NAICS code in this solicitation. However, FAR 52.219-28, Post-Award Small Business Program Rerepresentation, applies to an awardee regardless of the unrestricted nature of this solicitation; if the awardee represents itself as a small business in its proposal, it must comply with the requirements of rerepresentation. See solicitation Amendment 1.
