The Government has a requirement for a telecommunications intercept solution that is compliant with the aforesaid authorities, as specified in the Statement of Work (SOW).
2. PROPOSED CONTRACT TYPE: It is anticipated that this contract shall be structured as a Firm Fixed Price Contract. The Contractor shall provide exact and definitive pricing to complete this SOW as inclusively specified throughout the document. Upon award, the Contractor is responsible to meet all requirements and specifications as presented in this document as well as the associated contract.
3. SPECIAL EVALUATION TECHNIQUES: Oral presentations will be conducted as a part of evaluations.
4. PERIOD OF PERFORMANCE (POP): The anticipated POP is June 15, 2013, through June 14, 2014, plus four (4) one-year option periods. Contract completion expected June 14, 2018 (with the option to extend an additional six months on a per order basis in order to align service end dates).
SECTION II: PROPOSAL INSTRUCTIONS, PREPARATION, and SUBMISSION
A. GENERAL INSTRUCTIONS:
The content of each volume must provide sufficient detail and scope to clearly demonstrate the Offerors’ expertise, experience, and capability.
Offerors shall examine and follow all instructions. Failure to do so will be at the Offeror's own risk. Offerors’ responses shall be prepared in accordance with this section. To aid in the evaluations, all proposal documents shall be clearly and concisely written, neat, indexed (cross-indexed as appropriate) and logically assembled.
All Capability Statements must clearly and convincingly demonstrate that the Offeror has a thorough understanding of the requirements and has the technical experience and resources necessary to meet the requirements of this solicitation.
Offerors shall respond to all requirements of the solicitation document. Offerors are cautioned not to alter or disassemble the solicitation or to inflate performance capabilities that cannot be supported either in writing or through oral presentation.
In the event any person who is not a bona fide employee of the Offeror participated in the creation, formulation, or writing of any portion of the response, a certificate to this effect shall be included in the quote, which shall be signed by an officer of the company. Such certificate shall identify the name of the person who is not a bona fide employee, that person’s employment capacity, the name of the person’s firm, the relationship of that firm to the Offeror, and the portion of the response in which the person participated.
1. CONTENT GENERALLY: In responding to this solicitation, it is the Offeror’s responsibility to provide current, complete and accurate information. If Government identifies or otherwise learns that the provided information is not accurate or misrepresents the Offeror’s status or capabilities, that information may be used by the CO as part of the Offeror’s responsibility determination and may render the Offeror ineligible for selection.
In presenting material in your response, you are advised that quality of information is more important than quantity. Clarity, brevity, and logical organization should be emphasized in preparing your response. There is no need to repeat information in more than one volume if an overlap exists;
the detailed information must be included in the most logical place and summarized and referenced in other areas. It is the responsibility of the Offeror to present enough information to allow the various work efforts, support, and management approaches, as well as price, to be meaningfully evaluated without discussions. Include any data necessary to illustrate the adequacy of the various assumptions, approaches, and solutions to problems. The Government reserves the right to request additional information after receipt of an Offeror’s Capability Statements, and before issuance of Step Two of this solicitation.
Prospective Offerors are asked to bear in mind that all material submitted should be directly pertinent to the requirements of this solicitation. Extraneous narratives, elaborate brochures, uninformative "PR" material and so forth, must not be submitted. Brochures and other presentations beyond those sufficient to present a complete and effective response are neither necessary nor desired.
2. FORMAT: Proposal responses should be single spaced, with attachments as required for drawings, illustrations, charts, etc. Each page must have no narrower than one-inch margins at the top, sides, and bottom, excluding page number of each page. Header/footer information (which does not include any information to be evaluated) may be included in the 1" margin space. The font (typewritten or printed letters) must be 12-point Times New Roman. No reduction in font or print size is permitted except for organization charts, tables, figures, or other graphic illustrations. In those instances where reduction is allowable, Offerors shall ensure that the print is easily readable;
no less than 8-point font on graphs and 10-point font on tables. When attachment pages are used, they must not exceed 11 x 17 inches (i.e. legal size) and will count as two pages. Pages shall be consecutively numbered. The cover sheet, table of contents (not to exceed one page), blank pages/page breaks will not count toward the page limit.
The Offeror shall provide only electronic copies of the proposal. All documents shall be delivered via email. Offerors’ responses found to be non-compliant with proposal instructions will not be evaluated and will be eliminated from further consideration.
All documents shall be compatible with the following: MS Word: Version 14 or earlier, supporting .doc or .docx file extensions; Excel: Version 14 or earlier, supporting .xls or .xlsx. Adobe Acrobat:
Version 9.3.1 or earlier. Email attachments will be opened as quickly as possible once received to ensure that they are able to be opened; the contents of attachments will not be reviewed at that time. In the unlikely event that a file cannot be properly opened, the offeror will be notified via email, but additional time for offer re-submission will not be granted. Please allow a reasonable amount of time to have your offer received and opened.
3. PROPOSAL PACKAGING: The Offeror must email proposal information using the following subject line wording: “(FOUO) USSS Solicitation # HSSS01-13-R-0022, [Vendor Name]”. Any proprietary information should be labeled as such in footer sections of the respective documents. Due to email size limitations of 5MB per file, Offerors may submit their proposals in separate emails. Each email must be labeled as stated above, but “1 of 3,” for example, must be added to clearly indicate that the proposal is being submitted in multiple emails. All files must be received by the due date.
4. CLASSIFIED DATA: All proposals must be UNCLASSIFIED. Offerors are advised to submit only
UNCLASSIFIED material in response to this solicitation.
5. SOLICITATION AMENDMENTS: An amendment will be posted directly to the http://www.fedbizopps.gov website should any changes and/or additional information be required.
Offerors are instructed to monitor FBO for any amendments as the Government will not guarantee that Offerors will be directly notified.
6. QUESTIONS: Questions and comments concerning this solicitation or requests for clarification shall be made in writing via electronic submission to the USSS Contract Specialist identified in this solicitation. Electronic mail attachments, if included, shall be prepared using Microsoft Office. The USSS Contract Specialist contact information is:

2. VOLUME 1, SECTION 1 - TECHNICAL APPROACH
Fulfillment of the Statement of Work (SOW) Requirements: The Technical Approach shall specifically and in detail describe the Offeror’s proposed technical approach. It shall allow the Government to make a complete evaluation of the proposed solution(s) for satisfying all of the requirements but may propose solution(s) that exceed the requirements. Offerors will need to assess for themselves their internal price/technical trade-off:
while the Government welcomes novel technical approaches, Offerors need not propose solutions that far exceed the requirements at a significant price premium to the Government. The Technical Approach must not contain any cost information. The Technical Approach must include any descriptive literature, written narrative, or supplemental data necessary to show compliance with the SOW’s minimum requirements to include delivery and warranty terms.
i. Oral Presentations:
a. Eligibility: Upon written request of the CO, Offerors shall demonstrate their ability to support the needs of this requirement by making a detailed oral presentation.
Whether an Offeror participates, having been invited by the Government, is within the discretion of the Offeror; the Government will evaluate a non-participant’s offer on the strength of the written proposal solely in the case of absence.
b. Scheduling: The order of presentations will be determined by a random drawing of names of all Offerors, and they will commence approximately one (1) week after the closing date for the receipt of proposals. Rescheduling will be accommodated at the sole discretion of the Government upon substantiated, written request. The Government reserves the right to reschedule any and all presentations, with advanced notice, at its discretion.
c. Notice: The CO will notify Offerors of their scheduled date and time at least five (5) working days prior.
d. Forum: Presentations will be made in-person at the USSS Headquarters in Washington, DC. Submission of videotapes or other forms of media are not authorized. Off-site presenters using speaker phones, VTC, etc. are not authorized.
e. Recording: The Government will record all presentations using video equipment, which will be furnished by the Government for its use. The Government will retain all media produced.
f. Offeror Employee Participation: Offerors may bring no more than four (4) representatives to any oral presentation, one of whom will be the proposed primary manager for the award. At least 48 hours prior to the scheduled start time, the Offeror shall provide the Government with a list of participants’ names and titles for security purposes; presenters that do not complete and clear security checks will not be allowed access to the building; presentations will continue in the absence of any/all team members. Personnel may only participate (and attend) in the oral presentation of one Offeror team.
g. Time and Limits: Oral presentations shall not exceed one (1) hour per Offeror;
Offerors are not obliged to fill their entire time allotment but are afforded the time nevertheless.
h. Supplies: The Government will provide a laptop and monitor and/or projector and screen for presentations. All other materials are the responsibility of the Offeror.
i. Clarifications: The Government may request clarification of any of the points addressed and may ask for elaboration on any point which was not adequately supported in the presentation. Clarification will not serve as an opportunity for an Offeror to revise or otherwise modify its proposal or to engage in conversation not relevant to the proposal.
j. Deliverables: All Offerors shall document the main points of the oral presentation by submitting at least one (1) hardcopy handout and providing at least one (1) compact disc of any materials presented, e.g. PowerPoint slides, for retention by the Government. Offerors are directed to FAR 52.215-1(e), Restrictions on Disclosure and Use of Data, and should mark all materials appropriately.
k. Further Prohibitions: Offerors are forbidden from and are strongly cautioned against mentioning costs and/or price; only relevant technical information shall be provided.
3. VOLUME 1, SECTION 2 – PAST PERFORMANCE
The Offeror shall provide no fewer than three (3) but no more than five (5) examples of Past Performance information for active or complete “relevant/recent” contracts/task orders and/or subcontracts directly related to the technical requirements described in the SOW. At least two (2) examples must be provided with the Offeror as Prime Offeror. “Recent” means within the last three (3) years from the date of release of this solicitation.
“Relevant” means work which is the same and/or similar in complexity and scope to the work described in the
SOW.
The Offeror shall provide information to demonstrate its Past Performance substantiating its ability to successfully meet solicitation requirements. The Offeror shall provide a detailed explanation demonstrating the relevance of the examples of Past Performance to the requirements of the solicitation. Past Performance information is comprised of two elements:
a. A brief narrative statement on each relevant Past Performance example that demonstrates a favorable experience for the customer and how it is an indication of expected quality technical work to meet the requirements of the SOW. The example shall include a summary of the Offeror’s Past Performance regarding meeting technical, schedule requirements, and a description of the internal controls that ensured Offeror did not exceed the contract cost/price performed during previous relevant efforts. Each Past Performance example cited shall include the following information:
i. Contractor’s Name/CAGE Code/ DUNS # and Place of Performance
ii. Title of contract and award date
iii. Name and address of Contracting Activity/Agency
iv. Contracting Activity Point of Contact, including name, telephone number, and email address
v. Description of product and/or service
vi. Award number and type, e.g. FFP
vii. Period of Performance
viii. Total Award Dollar Value (at time of award and at close-out, if different)
ix. CPARS/PPIRS: indicate whether any Government Past Performance ratings have been completed and identify the last completion date X. Identify whether Prime or Subcontractor for past award
b. A completed Past Performance Questionnaire submitted by each of the references cited. Upon submitting your Past Performance information to the USSS, the USSS will forward a copy of the Past Performance Questionnaire to the named references, which may include the Administrative Contracting Officer and Program Manager for the contracts/orders. The Past Performance Questionnaire is provided as an attachment to this solicitation for your reference only—so that you may see what questions will be asked of your Past Performance references.
Offerors are not to follow-up with persons providing Past Performance information. The Government will contact Offeror’s references to ensure that they have been afforded reasonable opportunity to submit a completed questionnaire. Other related Past Performance information may be sought and used for evaluating completeness and accuracy of the Offeror’s proposals; the Government reserves the right to contact end-users identified through the Past Performance Questionnaire and to solicit further information about performance in regard to quality, timeliness, and cost.
The accuracy of Past Performance data, including phone numbers of the points of contact are the responsibility of the Offeror and inaccuracy may result in non-consideration of the reference. Past Performance information may be obtained from a variety of sources including other governmental agencies and the Past Performance Information Retrieval System (PPIRS).
4. VOLUME 1, SECTION 3 - EXCEPTIONS, AND DEVIATIONS
All exceptions, deviations, and waivers must be addressed in Section 3. If no deviations exist, a one page statement may be placed in this section and referenced in the Executive Summary.
This section must contain a certification that it contains all exceptions and deviations that the Offeror takes from the provisions to the solicitation and its applicable documents. An exception is where an Offeror states it will not comply with a requirement, usually involving contract terms and conditions. A deviation is where an Offeror states it will not comply with a requirement but proposes an alternative to meet the intent of the requirement, usually involving a specification.
Exceptions and deviations may cause proposals to be considered unresponsive. A mere assumption or condition shall not be considered an exception or deviation as defined herein. Offerors shall provide a detailed description of each exception or deviation; specifically identify the portion of the solicitation and the proposal that are affected; indicate the difficulty with the applicable requirement as stated by the Government; and, provide a proposed solution.
5. VOLUME 2, SECTION 1 – PRICING INFORMATION
NO COST / PRICE INFORMATION, (E.G. DOLLAR VALUES AND HOURLY RATES) SHALL BE
INCLUDED ANY PLACE OTHER THAN IN THE “PRICE VOLUME.”
The information required in these price instructions applies to both the Offeror and all principal subcontractors.
Offerors are responsible for submitting sufficient information to enable the Government personnel to fully evaluate their price proposal as stated in Evaluation Criteria. The pricing approach of all proposals should include sufficient detail to ensure the estimates are complete and reasonable.
Your proposal is presumed to represent your best efforts to respond to the solicitation. Any inconsistency, whether real or apparent, between promised performance and price should be explained in the proposal.
Assumptions
An explanation of all assumptions that affect the price estimates shall be provided. Topics to be addressed include, but are not limited to, investments, cost/price sharing, and programmatic variables (e.g., inflation/escalation, location, make/buy/lease decisions, prime/subcontractor relationships, and business base concerns).
Contract Price
For each contract line item number (CLIN), provide information other than certified cost and pricing, as applicable:
1) Labor: Demonstrate that the prices provided are commensurate with the work required by the solicitation, including any installation work and training, and the technical approach identified in the Technical Approach of the proposal.
2) Material: Provide for each CLIN an estimated total material cost which details the material and equipment (including quantity and type) to be purchased thereunder.
Identify additional/reduced prices, if any, that would be incurred in the performance of this effort that have not been identified in the solicitation.
Proposed Government Furnished Equipment or Facilities
The Government will NOT furnish equipment or facilities. Note: certain equipment will be utilized by the Government, per the SOW, but this equipment will not be furnished to contractor. Any request to use Government-owned facilities must be included in the Offeror’s proposal and approved in advance by the cognizant Government official. After contract award, requests to use Government integration, test, and facilities will be considered on a case by case basis based on availability and justification of need. The Government is not responsible for any schedule fluctuations resulting from Offeror requests.
SECTION III: EVALUATION FACTORS FOR AWARD
Award will be based on a best value/trade off evaluation, price and other factors considered, in order to award a firm-fixed price order to the Offeror presenting, in the judgment of the Government, the most advantageous offer to the Government. The order award will be based upon an integrated assessment of each Offeror’s ability to satisfy the solicitation requirements. The Government anticipates awarding on initial offers but reserves the right to conduct discussions with Offerors if necessary, hence, the Government reserves the right to make award without discussions. The Government will make award to that responsible Offeror’s proposal, conforming to the solicitation that is most advantageous to the Government, price and other factors considered. Offerors are advised that a proposal meeting the solicitation requirements with the lowest price may not be selected if award to a higher priced Offeror is determined to be more advantageous to the Government.
Best value evaluation is, in and of itself, a subjective assessment by the Government of the proposed solutions in order to acquire the most advantageous result for the Government, price and other factors considered.
Subjectivity is inherent in the process. The evaluation factors represent key areas of importance to be considered in the selection decision. The evaluation factors will be used to support meaningful comparison and discrimination between and among competing Offerors’ responses.
All evaluations factors other than cost/price, i.e. Technical Approach (to include any Exceptions/Deviations) and Past Performance, are less important than cost/price. Technical Approach is more important than Past Performance.
The Government will evaluate offers for award purposes in accordance with FAR Clause 52.217-5 Evaluation of Options. (JUL 1990).
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
FACTOR 1: TECHNICAL APPROACH
The Offeror's technical approach will be reviewed to determine if it is consistent with the price proposal and reflects a clear understanding of the scope of work necessary to meet the solicitation requirements. Where, in the determination of the Government, one’s technical approach does not reflect such an understanding, the proposal will be rated Unsatisfactory (per below).
For the Technical Approach factor, a proposal rating will be assigned. The proposal rating will be informed by the Government’s assessment of whether the proposal meets the solicitation’s technical requirements; an offer will be rated one of the following: Outstanding, Highly Satisfactory, Satisfactory, Marginal, or Unsatisfactory.
Exceptions and Deviations from this solicitation are not required. Offeror’s may submit a statement that no exceptions or deviations are proposed. However, Offerors must substantiate any exception or deviation from the requirements of this solicitation to the best of their ability. Any exceptions/deviations will be evaluated under the Technical Approach factor.
FACTOR 2: PAST PERFORMANCE
The Past Performance factor is defined by the relevant experience the Offeror has gained under specific contracts within the three-years immediately preceding the date of this solicitation. The Past Performance factor enables the assessment of how well the Offeror has performed, subjectively evaluated, during the course of a contract.
The Past Performance evaluation will consider the extent to which the Offeror’s Past Performance demonstrates its capability and capacity to deliver high quality service and solutions to meet the requirements of this SOW. The evaluation will consider the extent to which the Offeror has demonstrated the relevant Past Performance in performing work of the same or similar complexity and scope as that described in the SOW.
The following areas will be considered in the evaluation: 1) Relevance; 2) Meeting technical requirements; 3) Meeting schedule requirements; 4) Controlling contract costs; and 5) Managing the contracted effort. The Government will evaluate the quality of the Offeror’s performance of similar work as described in the SOW.
Where relevant performance records indicate performance problems, the Government will consider the number and severity of the problems and the appropriateness and effectiveness of any corrective actions taken (not just planned or promised). The Government may review more recent contracts or performance evaluations to ensure corrective actions have been implemented and to evaluate their effectiveness. It is incumbent upon the Offeror to explain the relevance of the data provided and substantiate that improvements from Past Performance problems are being made. The burden of providing thorough and complete Past Performance information rests with the Offeror. Problems not addressed by the Offeror will be considered to still exist.
However, consideration for discounting problems may be given when those problems are addressed through demonstrated systemic improvement.
FACTOR 3: PRICE
In evaluating the Price Volume, the Government will evaluate the Price Volume to determine price reasonableness, will assess any unbalanced pricing, and will review consistency with the Offeror’s technical approach. Offeror shall demonstrate a clear understanding of the solicitation requirements as evidenced in the total evaluated price. The total evaluated price will be the sum of the evaluated price for all CLINs, including optional function CLINs, based upon one (1) quantity purchased or service option exercised on every CLIN at the average of the per unit (average) maximum quantity discount price available for that CLIN and the price for a quantity of one (1) for that CLIN. For example:
CLIN 0001: Base Installation Package/Platform: Min. 1, Max. 5:
Evaluated Price = ((Unit Price, Qty. 1) + (Price, Qty. 5 / 5)) / 2
Ex. (($10,000) + ($40,000 / 5)) / 2 = $9,000
CLIN 3010: Option D1: Continued Service on CLIN 3001 – 3008 (12-months): No Min., Max. 4
Evaluated Price = ((Unit Price, Qty. 1) + (Price, Qty. 4 / 4)) / 2
Ex. (($5,000) + ($15,000 / 4)) / 2 = $4,375
The Government reserves the right to request additional data as needed to clarify offeror’s pricing methodologies/support proposal price/cost analysis. The Government may determine that an offer is unresponsive if the price(s) proposed are unbalanced between the line items or sub-line items. Evaluation of options shall not obligate the Government to exercise the options. No advantage will accrue to an Offeror who submits an unrealistically low-priced proposal. Such a proposal may be viewed as indicative of a lack of understanding of the desired objective of the Government. Reasonableness of price shall be assessed by performing comparative price analysis (e.g. comparing the prices received from multiple Offerors). The Government may utilize additional information to determine price reasonableness. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay when consideration is given to prices in the market. In no case can the Government justify a price that exceeds the commercial prices available for similar supplies and services. For evaluation purposes, adjustments the Government deems appropriate may be made to include Government costs required to accomplish the Offeror’s proposed approach, with the exception of those costs to the Government determines are equal across all Offerors. As part of the cost/price evaluation, the Government may consider DCAA audit information and other information the Government deems relevant.
SECTION IV:
A. AWARD ON INITIAL OFFERS:
FAR 15.209 permits contract award on the basis of initial offers without written or oral discussions. NOTE: Oral discussions are distinct from oral presentations. The winning proposal must have no deficiencies or significant exceptions to the terms and conditions of the solicitation.
B. IDENTIFICATION OF PROPOSAL DEFICIENCIES AND/OR AREAS NEEDING
CLARIFICATION/SUBSTANTIATION:
Clarifications may take place even when award on initial offers is contemplated. Clarifications are limited exchanges, between the Government and Offerors that may occur when award without discussions is contemplated. If award will be made without conducting discussions, Offerors may be given the opportunity to clarify certain aspects of proposals (e.g., the relevance of an Offeror's Past Performance information and adverse Past Performance information to which the Offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors. Clarifications may never result in a revised proposal (however, this does not mean they will not be documented, just that they may never give rise to a change in the Offeror's proposed approach to satisfying Government requirements).
Those areas requiring technical discussions with the Offeror will be identified and documented by the Government for use in written/oral discussions. The Government reserves the right to award without discussions.
C. COMMUNICATIONS WITH OFFERORS BEFORE ESTABLISHMENT OF THE COMPETITIVE
RANGE:
Communications are exchanges, between the Government and Offerors after receipt of proposals, leading to the establishment of the competitive range. If a competitive range is to be established, communications are limited to circumstances where a) Past Performance information is the determining factor preventing an Offeror from being placed in the competitive range and shall be limited to adverse Past Performance to which an Offeror has not had an opportunity to respond; and b) communications may only be held with those Offerors whose inclusion in or exclusion from the competitive range is uncertain.
D. DETERMINATION OF THE COMPETITIVE RANGE:
When award on initial offers is not possible, the Government will determine the competitive range following an evaluation of the cost/price and technical proposals. The competitive range shall be comprised of all the most highly rated proposals, unless the range is further reduced for purposes of efficiency pursuant to FAR15.306(c)(2).
