TacCOM – Vendor QuestionsSubject: RFP#: HSSS01-11-R-1001
Department of Homeland SecuritySeptember 29, 2011
Question No.

Question/Request
1
SF 1449 – Chapter B – Continuation of SF 1449
Section B; Schedule of Supplies/Services
Pages 5-6
Section B, Schedule of Supplies/Services, provides the CLIN structure for the ID/IQ contract for the base period and options. This CLIN structure reflects two sub-CLINS, AA for Commodities and AB for Services.

For contract administration and reporting it may be beneficial for the sub-CLIN structure to correspond to the 5 Technical Categories (TCs) (i.e. AA: Subscriber equipment, AB: Infrastructure Equipment, AC: Infrastructure (Implementation) Services, AD: O&M Services, AE: Test Equipment.

Q: Would the Government consider modifying the proposed CLIN structure to reflect sub CLINS that correspond to the TCs?

Concur. The RFP will be modified.

SF 1449 – Chapter B – Continuation of SF 1449; Section H – Special Contracting Provisions
Section H.10 –

Travel

Page 49
Section H.10 provides in part that “All travel related expenses including but not limited to airfare, local travel, lodging, meals, rental cars, and incidental expenses incurred by the successful offerors as a result of performing the services in the statement of work shall be reimbursed in compliance with the Federal Travel Regulation System, 41 CFR Chapter 301 and FAR Part 31.205-46. Airline travel expenses will be reimbursed for airfares booked at the lowest customary standard coach or equivalent airfares offered during normal business hours in accordance with FAR 31.205-46(d).

In response to a separate question under Section B.3 (Pricing), section B-3 was modified to provide that under a T&M order, labor, material and travel will be reimbursed pursuant to FAR 52.212-4 Alt 1.

Neither 52.212-4 nor 52.212-4 Alt 1 contain references to the FAR Part 31 cost principals. In addition, Cost Accounting Standards (CAS) do not apply to contracts and subcontracts for the acquisition of commercial items and it seems logical that these FAR Part 12 contracts should likewise not be subject to the FAR Part 31 Cost Principles.

Q: Would the Government consider deleting the references to the cited sections of FAR Part 31 in clause H-10? Alternatively, would the Government consider having these cited FAR Part 31 sections apply only to T&M orders?

Agreed. The RFP will be modified.

SF 1449 – Chapter B – Continuation of SF 1449; Section H – Special Contracting Provisions
Section H.10 –

Travel

Page 49
Section H.10 provides in part that “All travel must be approved by the DO COTR in advance….The locations and durations of this travel will be determined as needed by the Government. ….All travel shall be subject to the prior approval of the DO COTR.

Obtaining prior approval for travel makes sense in T&M orders, because the Government can use this approval to manage the costs incurred on a T&M project. However in a fixed priced order, the Contractor has the risk of performing required travel within the value of the fixed priced order and advance approval of travel by the Government seems to provide no cost benefits. In addition this provision adds requirements to both the Contractor and Government to request and approve multiple travel requirements under potentially multiple concurrent projects.

Q: Would the Government consider making the requirement for advance approval of travel only apply to T&M orders.

Agreed. The RFP will be modified.

Part 2
2.7(d)

Part 2 Instruction 2.7 (d) Paper Copies state that “paper copies of voluminous commercial catalogs or GSA schedules need NOT be provided as long as they are available electronically”. Is the intent to electronically submit large Catalogs and GSA Schedules on CDs and email or can we just submit them on the CDs?

“Available electronically” referred to documents available on an internet site where the catalog or GSA Schedule may be viewed (you would simply provide the internet address). If your document is not available on an internet site you may submit a copy on a CD. Attempts to email the document will probably failed due to size restrictions (5MB per email) so we will work with documents on the internet (preferred) or submitted on a CD.

1. Repeating a previously submitted question – “Will the Government please confirm that it is their intent to have bidders use GSA Schedules to establish a baseline for price reasonableness purposes only?” It is important to determining if task orders awarded on DHS TacCom are not considered as “buying off of a GSA Schedule” and that the collection and payment of the Industrial Funding Fee (IFF) is not applicable. Or, is it DHS’ intent that for services (labor categories) and products having pricing derived from a vendor’s GSA Schedule(s) for DHS TacCom, that the sales of these items on any subsequent task order be considered a GSA Schedule sale? If so, it is imperative that contract and task order pricing distinguish between Schedule and non-Schedule items. Additionally, for price evaluation, it is necessary to consider that some vendors using the DHS preferred GSA Schedule pricing will have the IFF included in their rates, while vendors using some other pricing approach will not. All schedule vendors must embed within their published Schedule prices a 0.75% fee that the vendor then collects from the ordering offices and refunds to GSA on a quarterly basis.

3. Please confirm that it is permissible for a single vendor to have some labor categories and products priced using multiple GSA Schedules, others from commercial price lists, and still others being derived from cost build-up.

1 & 2. TacCom orders are not considered GSA Schedule Orders – the IFF is not applicable.

3. The source of pricing is the offerors determination – GSA Schedules (discounted) were cited as a preference to facilitate pricing now and during the out-years. Although a preference, if available, it is not required.

May we submit pricing contained in GWAC contracts along with GSA schedules for the subject solicitation.
Yes.

Question: Per FAR 19.5 and attached supporting documents, the government has been made aware that there is a reasonable expectation that two or more small businesses can meet the minimum requirements set forth in this RFP and therefore request the implementation of a small business track inside of TC2.

Based on review of the company profiles submitted, we find that all identified firms are resellers and not manufacturers. The FAR states at 19.502-2(c), “[F]or small business set-asides other than for construction or services, any concern proposing to furnish a product that it did not itself manufacture must furnish the product of a small business manufacturer unless the SBA has granted either a waiver or exception to the nonmanufacturer rule…” Review of SBA’s listing of waivers (updated September 20, 2011); the only waiver under NAICS code 334220 is for Product Service Code 5820 - Televisions. Based on our information, that neither a waiver nor exception exists for the equipment required in TC2 and the rule of two not being met, there is no basis for a small business set aside in TC2.

Chapter E, Part 2
2.6(6)(ii)
87
Is the required email submission for Attachment 4 Pricing templates in addition to required email for Attachment 2 (Volume 2) also queried below as Chapter E, Part 2, 2.8.3, page 90?
No - we only need on email submission
9
Chapter E, Part 2
2.7 and 2.9
87 and 90, respectively
RFP Section 2.7(a) references "the page maximum of 75 pages for Volume 1." Based on RFP Section 2.9, offeror assumes that DHS reference to a page maximum of 75 pages would be based only on response to one Technical Category (TC), and that additional TC responses including TC3 and TC4, would have an additional 40 pages for each additional TC for Non-Price Part 3. Please confirm.
Confirmed
10
Chapter E, Part 2
2.7(c )
88
With respect to third sentence, please confirm we are to submit one original, one copy of each volume.
Confirmed
11
Chapter E, Part 2
2.8.1(b)
88-89
If we are using combined proposal sections for Corporate Experience, Past Performance, Management and Organization and Subcontracting Plan that are identical for both TC 3 and TC 4, can these only appear once in the proposal binder under a separate Tab, or to assure evaluation by both the TC3 and TC4 review panels do we need to include this material in both the TC3 and TC 4 Tabs?
You may submit only one copy of the combined proposal sections.
12
Chapter E, Part 2
2.8.3
90
Please confirm correct labeling of email submission for each Volume to include the following: (1) Attachment 1 (zip file) (a) Volume 1 Non-Price Proposal (Word file) (to include Tabs 1-6); (b) Tab 2 Proposal Compliance Checklist (Attachment 8) (Excel file); and (c) Tab 3 Attachment 1 (for each technical category being proposed (Excel file). (2) Attachment 2 will include: (a) Volume 2 Price Proposal (MS Word) and (b) Tab 5: Tab 5a Pricing Tables (Attachment 4) (Excel); Tab 5b Price Evaluation Matrix (Excel file); and Tab 5c Price Lists (pdf file).
Refer to paragraphs 2.9 and 2.10 and their subparagraphs. Your list seems to be missing some items like the sub-contracting plan (if you're a large business).
13
Chapter E, Part 2
2.9, 2.9.3.1, and 2.9.3.2
90-92
Will the government please confirm that the Non-price Tab 3 response is 40 pages for TC3 and 40 pages for TC4?
Confirmed. The solicitation will be amended to clarify.
14
Chapter E, Parts 2 and 3, and Attachment 9
2.9.3.2 and 3.2, respectively and Attachment 9
92, 98
In the revised RFP, the Offeror assumes that the requirement for a completed Attachment 9 Security Standards worksheet in RFP Section 2.9.3.2 instructions for Service Offerings is an error. RFP Section 2.9.3.2 states that Service Offerings (TC3 and TC4) are required to provide "a completed... Security Standards worksheet," referencing RFP Attachment 9. Attachment 9 seeks information on equipment security standards. Attachment 9 states that it is to be completed for "offerors proposing on TC1 Subscriber Base, TC2 Infrastructure, or TC5 Test Equipment." Attachment 9 is not included in the evaluation criteria for TC3 and TC4 (RFP Chapter 3, Part 3, Section 3.2, page 98). Please clarify.
Correct. We will amend the solicitation to remove the security worksheet requirement for TC 3 and 4
15
Chapter E, Part 2, Section 2.9.4
1
92
Please clarify DHS' definition of "two largest subcontractors" in the third sentence.
Offerors' have the latitude to define this term in a manner to best present their capabilities. For example, it may be based on dollar value, significance of contribution to contract performance (e.g., provided an essential capability), a long standing relationship covering multiple contracts.
16
Chapter E, Part 2 and Chapter B, Sections C, F, and H
2.9.6; C.7.5.1(b); F.7(g); H.19(e) and H.20
93, 12, 29, and 52-53, respectively
With respect to the subcontracting plan reporting requirements, paragraph F.7(g) refers to subsection C.7.5.1. C.7.5.1(b) further refers to subsection H.19(e). Will the government please confirm H.20 Subcontracting Plan is the correct reference?
Confirmed - H.20 is the correct reference. The solicitation will be amended.

Attachment 8 and Question and Answer (Q&A) #30
Team Member data
2 of 8; 3 of 8
Please advise how we are to complete Attachment 8 Proposal Preparation Checklist, Team Member Information section, if we have more than four team members? Should we simply add additional columns and letters, e.g., Team Member (E), Team Member (F), for other team members?
Yes, add additional columns and letters.
Q&A #137 response states that offerors may not propose on both TC3 & TC4. This restriction was not noted elsewhere in the RFP and Chapter B, A.3 “Contract Coverage” it states that contractors may receive contracts in multiple technical categories.
Q #137: “…may not propose” was not intended to be a limitation. It may have been clearer if I’d said “…might not proposed”
Regarding the newly created section 2.9.3.2 [Services Offering (TC 3, 4)], the government is asking TC3 and TC4 offerors to provide a completed Vendor Capabilities Matrix and Security Standards worksheet for the applicable technical category. The requirement references Attachments 1 and 9. However, Attachment 9 (Instructions to Offerors) states that, "For offerors proposing on TC1 Subscriber Base, TC2 Infrastructure, or TC5 Test Equipment, complete this worksheet and submit with your proposal." We respectfully request that item 1 be reworded as follows, "A completed Vendor Capabilities Matrix worksheet is required for the applicable technical category (See Attachment 1)."
The requirements for a security standards worksheet for TC 3 and 4 will not be required. The solicitation will be amended.
In the last edit of Amendment 1, wording in Part 3 regarding the Security Standards has changed. Para 2.9.3.2 SERVICES OFFERING (TC3, 4) indicates that the Security Standards worksheet, Attachment 9, is required. Para 3.3.1.1 PRODUCT OFFERING SUB-FACTOR: SECURITY STANDARDS indicates that the Security Standard worksheet is required only for TC1, 2, 5. Similarly, Para 3.3.1.2 SERVICES OFFERING SUB-FACTORS does not indicate a need for the Security Standards worksheet. Please confirm that instructions for Para 2.9.3.2 are erroneous and that TC3 and TC4 do not need a completed Security Standards worksheet.
Concur. Paragraph 2.9.3.2 should not require the Security Standard worksheet at Attachment 9 for TC3 or TC4. This will be revised in an amendment to the solicitation.
If a sub-contractor were to send the Contractor Performance Customer Survey Questionnaire, which is entitled Attachment 6 of TacCom Request for Proposal, it would need to include its name in the space designated for the Company Name of Offeror. There is not a space designated for the prime contractor submitting the actual proposal. When your agency receives the questionnaire directly from that customer, how will your agency know which prime contractor’s proposal the questionnaire supports?
Ideally the subcontractor will indicate their status as a subcontractor and indicate the prime. Otherwise, we will have to call for clarification.
Also, the instruction on the Contractor Performance Customer Survey Questionnaire states that e-mail submission is preferred. Is it acceptable for us to alter the form so that it can be filled out and sent electronically? This would mean that the instructions to “circle the appropriate rating” and “circle one” would not apply. We would either add radio buttons or checkboxes to the form.
You may alter the form as long as whatever is sent arrives via email. The majority will be sent as scanned .pdf files attached to an email.

On the Contractor Performance Customer Survey, one of our customers seems to have a problem actually signing the survey, in past where signature is needed we would include their email address in the signature section, is that acceptable in this case?

The signature should provide the complete name – sometimes an email address is an initial and truncated last name. They may type their name in lieu of a signature.

Understanding that the small business track was added to include TC1 Subscriber Equipment, we wanted to make sure that language was added into the factors for award that was omitted above.

RFP amended

How will the unrestricted / small business tracks be utilized? Understanding that it is at the DO CO's discretion to chose with track to utilize, there was no language included that determines what/how much will be set-aside.
The DO CO will follow the direction provided at FAR Part 19 with specific attention to 19.201, 19.202, and 19.501 in determining when specific requirements are suitable for small business set-aside.
