Included herein is the continuation to the Standard Form (SF) 30, Amendment 000001 to solicitation HSHQEH-13-R-00004.
Part 1 –Solicitation Questions & Responses Q1: Are the quantities listed in Attachment 1 guaranteed purchases during each period?
A1: No, the quantities listed in Attachment 1 are not guaranteed to be ordered. See Attachment 3- Terms and Conditions, pages 11-12 referencing FAR 52.216-19 and FAR 52.216-22.
Q2. How much space will be made available at FLETC for the contractor provided equipment described in section 1.6 of the SOW?
A2: The exact space has not yet been determined although it is estimated that one of the following will be utilized: a 50’ X 100’ trailer or a 24' x 12' large office area.
Q3. In section 1.8.3, wouldn't it be more desirable to update allowances available at order time vs. at shipment time as is stated in the SOW? If not, wouldn't that allow ordering using incorrect allowance amounts?
A3. The vendor must have a system in place which can track how much each LEO is ordering and that these amounts do not exceed the value of the current Task Order obligated funding. The vendor may choose when tracking is appropriate to perform this function. However, invoicing will not be permitted until shipment is complete.
Q4. How much is the annual allowance per individual?
A4. $800 for Inspectors and $400 for Special Agents. Vendor is cautioned to note that the allowance is not actual funding. Amounts are used for tracking mechanism only.
Q5. When would the yearly allowance be given to employees? How many times would the allowance be given during the 3 periods covered in this contract?
A5. Over the life of the 18 month contract, allowance would be given no more than 2 times per employee.
Q6. How many FPS officers receive an annual allowance?
A6. Approximately 950 LEOs. This is subject to change based on budget fluctuation.
A7. Do IP employees receive an allowance? If so, how many IP employees are there?
A7. Yes, there are approximately 132 employees with IP.
Q8. In order to estimate the amount of freight expense to be incurred, can you furnish a breakdown of the number of uniformed personnel that are at each of the 14 locations listed in section 1.9 who would be eligible to order?
A8.

· Region 1 - 10 Causeway Street, Boston, MA 02222 - Approximately 49 Uniformed Personnel

· Region 8 - One Denver Federal Center, Bldg. #44, Denver, CO 80225 - Approximately 54 Uniformed Personnel
Q9. Can individual credit cards be accepted for order amounts that exceed the allowance amounts available per person?
A9. Individuals with uniform needs exceeding those quantities covered by task orders placed under this contract may purchase items directly from the successful awardee. However, any purchase by FPS or IP personnel using a personal credit card or any other payment method will be an agreement between the individual and the vendor and in no way be affiliated with FPS, IP, or this contract. If an individual wishes to order items from the successful awardee using his or her personal funds, that order must be processed as a completely separate order. The successful awardee may not process as a single order funded partially by government funds and partially by the individual personal funds of employees.
Q10. Can individual orders be made via credit card only?
A10. See answer A9 above. The method of payment for purchases made by individuals, outside the scope of this contract, is between the individual and the vendor.
Q11. It is noted that no LEO classes are scheduled at this time. When does FPS anticipate that LEO classes will be scheduled during the contract period?
A11. Tentative classes scheduled for October 2013 and February 2014. Not Guaranteed.
Q12. How many classes are anticipated during the contract period?
A12. Unknown beyond the tentatively scheduled classes listed above.
Q13. How many students are normally in a class?
A13. Classes typically range from 12 to 24 persons.
Q14. In order for shipments to occur within 30 business days (7 for new hires), the contractor will be required to carry inventory, which will likely require significant financial outlay. Will the agency buy out all remaining inventory at the end of the contract period?
A14. No, the agency will not buy out any remaining inventory at the end of the contract period. See Attachment 3- Terms and Conditions, pages 11-12 referencing FAR 52.216-19 and FAR 52.216-22.
Q15. In section 1.14.3, you indicate that there is a limited quantity of patches available. Can you furnish an inventory of each patch so that it can be determined how many need to be planned for inventory and how much the contractor's initial financial outlay might be?
A15. Attachment 2 – SOW Section 1.14.3 has been updated. FPS will supply all patches required under the contract and will ship to the vendor at no cost.
Q16. On the schedule of supplies item list on attachment 1, twenty (20) items are listed as "Brand Name or Equal". 19 of the 20 (95%) are actually not compliant with the Kissell amendment due to their countries of origin. How does FPS reconcile the desire for these brand names with the Kissell requirement? Does FPS anticipate waiving the Kissell requirement for these items since they are specifically stated in the RFP?
A16. This is a Brand name or Equal requirement. In responding to the requirements of this solicitation the vendor shall quote items that meet the salient features of the products specified within the scope of work while being in compliance with the set forth terms and conditions. The vendor shall determine whether the brand name items are complaint with the Kissell amendment and if determined non-compliant propose an item which does meet compliancy.
Q17. It appears, based upon the contracting officer checks on pages 5 and 6 of 42 in attachment 3, that the Buy America Act applies but that Buy America Act - Free Trade agreements and Trade Agreements do not. Also, it is clear that the Kissell Amendment does apply. This is a bit confusing. Can FPS clarify which countries of origin are allowed to be offered under this solicitation?
A17. The Solicitation is clear in its face as is described in Attachment 3 – Terms and Conditions Pages 5,6, and 12.
Q18. NPPD/FPS was part of the recently closed solicitation # HSBP1013R0003 for U.S. Customs and Border Protection and components. Does this solicitation supersede that one? Does this solicitation void the NPPD/FPS portion of that solicitation?
A18. No, this solicitation does not supersede HSBP1013R0003 and does not void the NPPD/FPS portion of that solicitation.
Q19. Assuming this FPS contract is awarded, is there a chance NPPD would revert to the contract contemplated by HSBP1013R003 described above? If so, what would be the determining factors?
A19. Yes. FPS will have the option to utilize the CBP contract once ordering authority is provided by CBP. This timeline is currently unavailable to FPS.
Q20. What are some examples of the Other Direct Costs listed in Attachment 1 item #0082? What are some examples of the Indirect Costs listed in the same item # (0082)? Can you explain how the indirect rate % is applied?
A20. The Solicitation is clear on its face as described in Attachment 1 – SF 1449 CLIN 0082. CLIN 0082 represents Travel. Travel is the ODC cost in this case in the not to exceed amount of $5,000.00. Indirect costs are the costs associated with your travel. The Government cannot determine your percentage of that cost and asks that you purpose a percentage.
Q21. Clause FAR 52.219-6 is included in the solicitation, but Alternate I is not included. Can you clarify if products from large manufacturers will be allowed, as some of the items requested by brand name are from large manufacturers? Also, will the Government include Alternate I to this clause based on the nature of the items requested?
A21. Alternate I will not be added as the Government is not aware of a known waiver that was granted by SBA for these items. In responding to the requirements of this solicitation the vendor shall quote items that meet the salient features of the products specified within the scope of work while being in compliance with the set forth terms and conditions.
Q 22. Regarding line item 0009 through 0012 all indicate either “police” or “Special Agent”. Are these to be screen printed or is just pricing of the polo required?
A22. Pricing of the Polo is necessary. The differences among the line items are that the finished end product will either have police or special agent badges affixed. No screen printing is necessary.
