A. Please note that the District of Columbia Accrued Sick and Safe Leave Act (the Sick Leave Act, codified at D.C. Code Ann. § 32-131.01 et seq.) requires employers to provide their employees paid leave.
B. The SF1449 is deleted in its entirety and replaced with the revised SF1449, as attached. Be advised that the correct time for proposal submission is 1400 (2:00pm) EST on June 8, 2012.
C. CBA-2009-2768, Revision Number 2 is hereby deleted in its entirety and replaced with CBA-2009-2768, Revision Number 3, as attached.
D. The following questions and answers are hereby provided for informational purposes only. This answers all questions. Please note that no further questions will be entertained under this solicitation.
1) Contract Clauses, Subsection E-2, Technical Proposal (Non-price factors), Socio Economic Factor presents a chart that requires the bidder to provide the overall price of the contract as bid. Since this is a “technical” factor, how does the entry of the price data in the chart reconcile with the prohibition against placing price data in the technical proposal? Does the Government want a dollar value in the first block, or just a percentage value in the subsequent blocks of this chart?
Answer: The solicitation is clear on its face.
2) Statement of Work, Paragraph 5.3.1 Suitability Requirements, subparagraph 5.3.1.15 provides “Contractor is responsible for all costs associated with obtaining and renewing suitability clearances for employee associated with this contract.” Does this paragraph mean that contractors bear the administrative costs of requesting the suitability and the employee’s time spent completing the process online only and that the Government bears responsibility for the costs related to the suitability review? Generally this is our experience working under federal contracts.
Answer: See Amendment 0001, Paragraph Z.
3) Statement of Work, Paragraph 5.4.2 Security Clearance Requirements, subparagraph 5.4.2.6 provides
“Contractor is responsible for all costs associated with obtaining and renewing security clearances for each contract employee.” Does this paragraph mean that contractors bear the administrative costs of requesting the clearance and the employee’s time spent completing the process online only and that the Government bears responsibility for the costs related to the clearance process? Generally this is our experience working under federal contracts.
Answer: No security clearances are required under this RFP.
4) Please confirm that the 40 hour course identified in Exhibit 4C (4 hours Use of OC Spray, 4 hours Use of
Baton, 8 hours Firearms Maintenance, Safety and Handling, and 24 hours Initial Firearms Familiarization Fire) is required for both incumbent and new employees.
Answer: This would be for new employees and any FPS protective security officer who does not have documentation that the training was provided.
5) Are supervisors permitted to work in a capacity other than a supervisory capacity? If yes, are supervisors working in non-supervisory capacity permitted to stand post?
Answer: Supervisors shall not provide relief or stand post while working in a supervisory capacity (i.e. a supervisor shall not perform supervisory and productive PSO services simultaneously). In order to provide breaks and/or relief and/or stand post, a supervisor must sign-off as a supervisor, remove any supervisory insignia and sign-in as a productive PSO. Also, see Amendment 0001, paragraph B.
6) Are incumbent PSOs with current respiratory protection clearances required to take a respiratory protection examination during transition because the respiratory protection standards have changed or are new?
Answer: See Amendment 0001, Paragraph CC. The respiratory protection requirements are set by OSHA and NIOSH. If they update the requirements, contractors may be required to comply with the changes. It is the responsibility of the offeror to ensure each PSO meets the current requirements of the Statement of Work for this solicitation.
7) Is it permissible to price Supervisory and overhead in positions at a 5 year average instead of escalating wages each period?
Answer: It is at the discretion of the offeror on how to price supervisory and overhead positions.
8) Please clarify whether the initial two week supply noted in Exhibit 8D PPE is included in unit hourly rates or if it will be reimbursed under the separate Not-to-Exceed CLIN.
Answer: With the exception of TAS, the unit rates are monthly and not hourly. The initial two week supply noted in Exhibit 8D shall be included in the proposed monthly rates.
9) Typically, the government provides a Pricing Schedule as an attachment in Microsoft Excel format. Will the government provide a Pricing Schedule for Offerors to submit as part of their Price Proposal or will a completed SF 1449 suffice?
Answer: Contractors shall complete the SF1449.
10) CBA between SPFPA and Paragon as well as CBA between UUSG and Knight provide wage, health & welfare, and other benefit rates that do not account for the Base Year period of performance under this RFP (10/01/2012 – 03/31/2013). Will the government provide updated CBAs containing wage rates, health & welfare rates and other related terms and conditions applicable to the Base Year period of performance under this RFP (10/01/2012 – 03/31/2013)? If the government will not provide updated CBAs, are Offerors to use the most current wage, health & welfare rates and any other related fringe benefits outlined in the CBAs provided by the government for pricing purposes?
Answer: See Paragraph C. No other updated CBAs have been received by the Government, so offerors should use the most current wages and fringe benefits outlined in the CBAs provided by the Government for pricing purposes.
11) Does the Government require any guard mount time for any of the locations under this RFP? If so, how long does the Government require before and after each shift for guard mount at each of the four locations under this RFP?
Answer: The Government does not require guard mount time other than off-going PSOs shall provide a brief summary to on-coming PSOs. See SOW Section 9.3.5.
12) Exhibit 8E, Contractor-Provided Communication Equipment indicates 29 radios. Does the Government have a preference for a specific make, model and frequency of radio?
Answer: No.
13) Please confirm which one of the CBAs provided by the government “covers the greater portion of the work” under this solicitation and is therefore the only predecessor CBA applicable to the subject solicitation in accordance with 29 CFR 4.163(g).
Answer: Since all of the buildings are approximately the same size (i.e. have the same number of productive posts), not one of the CBAs covers the greater portion of the work.
14) The Pricing Schedule/Form SF1449 identifies a distinct CLIN for each building. Does the Government want Offerors to propose a distinct bill rate per building or one bill rate for all the buildings covered under this RFP?
Answer: Offerors shall not use a weighted average when pricing out each building/CLIN.
15) Amendment 1, Item J provides, “Please note that there is currently a 24/7 supervisory post at each of the following sites: DC0355, DC0375 and DC0395.” Further, Item W provides, “In relation to the post exhibit (Exhibit 1), all posts are armed to include all proposed supervision.” Are these supervisory posts already included in the Post Exhibit provided by the government? Or are these 24/7 supervisory posts in addition to the post coverage provided in the Post Exhibit?
Answer: The supervisory posts are not included in the post exhibit. Offerors shall propose supervision using Attachment 8 – Field Level Supervision Exhibit.
E. All other terms and conditions remain unchanged.

Minimum and Maximum Quantities:
As referred to in paragraph (b) of the "Indefinite Quantities" clause of this contract, the total contract minimum quantity is a total of $100,000.00 worth of orders at the contract monthly price(s). This minimum guarantee will be de-obligated from the resultant contract once a task order or task orders is/are issued with a value of $100,000.00 or greater through which the minimum guarantee will then be satisfied. The contractor can only invoice for the minimum guarantee as applied at the resultant contract level if task orders are never issued against the resultant contract and only at the end of the contract's period of performance (i.e. March 31, 2018). If task orders are issued, but do not amount to a value of $100,000.00, the contractor can invoice for the minimum guarantee minus the total value of the task orders issued under the resultant contract at the end of the resultant contract's period of performance (i.e. March 31, 2018).
Per FAR 52.216-18, orders under this resultant contract may be issued via electronic commerce methods.
Proposals shall be delivered to the address in Block 9.
Proposals shall be valid for a period of 120 days.
Emergency Security Services (ESS) which are included in Section 3.2.1.1 (page 11) and 12.4.3 (page 50) of the SOW are not applicable to this procurement.
