RFP HSHQDC-13-R-00047 – Amendment 000004
Vendor Question Government Response
1. For question 87d, it states that “The Bidder is required to price PKI as part of software licenses under Task 1.“ Is this response referencing certificates required for the infrastructure and websites or does this also include certificates that are placed on the PIV Smart Card?
PKI certificates that are loaded onto the PIV Cards
2. Now that you have clarified that the “production test environment” will be housed at the contractor site, do the terms and conditions from RFP section 3.11.21 (Required Protections for DHS Systems hosted in non-DHS Data Centers) apply to the production test environment?
Yes. The incumbent’s test environment is hosted in a non-DHS data center and they follow these terms and conditions.
3. In the pricing table (Evaluation Tab) for Amendment 2, rows 59-66 were dedicated to Task 8 for Option Years 1-9. In Amendment 3, Task 8 was removed in its entirety, but the requirements remain in the PWS. Is it expected that the government will re-issue Task 8 as a separate task order under this IDIQ? If not, will another amendment be issued to remove Task 8 from the PWS?
Task 8 will be accomplished through separate task orders. Deliverables from Task 8 will become a part of the IDMS Core Infrastructure.
4. RFP Section 2. The referenced FAR clause, 52.227-17, specifies that the Government must be granted the same rights to software (data) not first developed under the contract as the Government would have to software first developed under the contract (subparagraph (c)(2)). This may not be possible for commercial software packages (e.g., database management engine, Windows operating system, etc.). We recommend allowing delivery of commercial software under the terms of FAR clause 52.227-19, and existing works under FAR clause 52.227-18.
After consideration, DHS has determined it to be in the Government’s best interest to keep FAR clause 52.227-17 in RFP HSHQDC-13-R-00047. In order to address the concerns outlined in this question, DHS has added FAR 52.227-15 (see RFP Section 4) and additional data rights language (see RFP Section 2).
