09C. ADJUSTING PAYMENTS FOR CONTRACTOR PERFORMANCE
1. Deductions for Failure to Provide Man-hours
a. To compute labor-hour deductions the Contracting Officer's Representative will compare the man-hours reported by the Contractor through the Post Tracking System (PTS)(PTS is further defined in the SOW), with the DHS Form 139, Record of Time of Arrival and Departure from Buildings, or other approved Sign-in/Sign-out methods as prescribed by the contract.
b. The Government will pay the contractor for the number of labor hours actually performed as documented by the contract prescribed sign-in/sign-out method. (e.g.
PTS, DHS Form 139 etc.)
c. In the event the Contractor invoices for more hours than are documented by the contract prescribed sign-in/sign out method (e.g. PTS, DHS Form 139 etc.) the contract prescribed method will prevail. For example: If the invoice submitted by the Contractor indicates that an employee worked 8 hours and the sign-in/sign-out form shows that employee as having been in the building 5 hours, a deduction will be taken for the 3 hours not furnished. In the event the Contractor, for any reason whatsoever, fails to provide the manpower specified for labor, deductions will be made at the current fully weighted hourly rate.
d. The Government may assess price deductions for each post hour where services are not rendered in accordance to the provisions of the contract (e.g. PSO on post but not properly equipped, certified or licensed).
e. In accordance with Paragraph 6.7.3.4 of the SOW, PSOs must perform, at a minimum, 8 hours of x-ray machine operation, to screen for weapons and explosives every 60 days to maintain certification requirements. If these requirements are not met, maintained and/or properly documented, the PSO must successfully complete 8 hours of NWDTP refresher training prior to performing screener duties. The Government may assess a price deduction in the amount of $550 each time a PSO is required to complete the 8 hours of NWDTP Refresher Training as a result of failing to meet the requirements of SOW paragraph 6.7.3.4.
f. Use of deductions does not preclude the use of any other remedies. The Government reserves all contractual rights and remedies. Nothing in this section shall be interpreted to allow the contractor to knowingly fail to provide the manpower specified for labor and/or render services that are not in accordance with the provisions of the contract.

6.7.3 National Weapons Detection Training Program (NWDTP)
6.7.3.1 PSOs assigned screening post duties, and PSOs assigned as uniformed supervisors that have oversight for screening posts, must successfully complete a sixteen (16) hour curriculum for weapons detection training prior to performing or supervising screener duties.
6.7.3.1.1 Screening Post Defined. Any post, which post orders articulate the use of magnetometer(s)
(hand held or walk through), x-ray machine, and/or other device(s) used to screen for potential presence of weapons or explosives.
6.7.3.2 PSOs must take and pass a Government-administered written examination and complete and pass a practical exercise to demonstrate an ability to perform screener duites in accordance with Exhibit 4G.
6.7.3.3 If the PSO does not pass the written exam and/or graded practical exercises on the first attempt, the PSO cannot provide services at a screening post until successfully passing the written exam and/or graded practical exercise. This will not preclude the PSO from providing services at non-screening posts.
The PSO will have one (1) additional attempt to pass within 90 days from initial attempt. PSO must complete requirements in accordance with 6.7.3.1 and Exhibit 4G.
6.7.3.3.1 If PSO exceeds time requirements identified in 6.7.3.3, PSO must wait one (1) year from initial attempt to rescheduled and/or recomplete training. This will not preclude PSOs from providing services at a non-screening post.
6.7.3.3.2 If the PSO does not pass the written exam and/or graded practical exercises on the second attempt, PSO must wait one (1) year from date of second unsuccessful attempt to retrain and re-take exam and practical exercises. This will not preclude PSOs from providing services at non-screening posts.
6.7.3.4 PSO must perform, at a minimum, 8 hours of x-ray machine operation, to screen for weapons and explosives every 60 days to maintain certification requirements. The contractor will be solely responsible for ensuring the minimum 8 hours of x-ray machine operation. Any costs associated (re-training) with not meeting this standard will be the responsibility of the contractor. In addition, the contractor will be responsible via a price reduction to compensate the government for any re-training time. (Time must be recorded on Form 139 or within an FPS approved Post Tracking System.
6.7.3.4.1 If requirements identified in 6.7.3.4 are not met, maintained, and/or properly documented, PSO must successfully complete NWDTP Refresher Training, in accordance with 6.7.4 and Exhibit 4H, prior to performing screener duties.

6.7.4.1.2 If PSOs do not pass the written exam and/or graded practical exercises on the first attempt, the
PSO cannot provide services at a screening post until successfully passing the written exam and/or graded practical exercise. This will not preclude the PSO from providing services at non-screening posts. The
PSO will have one (1) additional attempt to pass within 90 days from initial attempt. PSO must complete requirements in accordance with 6.7.3.1 and Exhibit 4H.
6.7.4.1.3 If PSO exceeds time requirements identified in 6.7.3.3, PSO must wait one (1) year from initial attempt to rescheduled and/or recomplete training. This will not preclude PSOs from providing services at a non-screening post.
6.7.4.1.4 If the PSO does not pass the written exam and/or graded practical exercises on the second attempt, PSO must wait one (1) year from date of second unsuccessful attempt to retrain and re-take exam and practical exercises. This will not preclude PSOs from providing services at non-screening posts.

C. Staffing:
1. Staffing Plan.
a. The solicitation includes estimated Basic PSO Service hours that may be ordered by the Government, which exceed the initial known basic PSO Service hours reflected in the post exhibits. Similarly the solicitation includes estimated hours that the Government may order for TAS and ESS. The Government may order these additional hours at anytime during the performance period of this contract and may do so without providing for a “phase-in” period.
The offeror shall describe their staffing plan. Offerors, at their discretion, may include information to enhance the Government’s understanding of the proposal, such as the number of PSO full time equivalents (FTEs) to be assigned to this contract, staffing of TAS and ESS requirements, and the contractor’s ability to permanently staff additional posts with licensed/trained/certified and suitably cleared PSOs with little advance notice.
b. Minimum Submission Requirements Staffing Plan: Offerors shall submit as a minimum the following to demonstrate the above:
Offeror shall describe their staffing plan.
2. Relief Plan.
a. Offerors shall provide a detailed plan indicating their approach to providing relief.
Descriptions of relief plans that do nothing more than restate the SOW requirements or assert the intent to comply with applicable laws and regulations such as “relief shall be provided in accordance with the applicable Collective Bargaining Agreement or applicable Department of Labor regulations” may adversely impact your evaluation under this technical factor. Aspects of the relief plan that Offerors may address at their discretion to enhance the Government’s understanding of the proposal, include their policy for providing meal and break periods and whether these periods are paid or unpaid, the number of annual relief hours that will be required to fill all posts requiring continuous coverage during meal/break periods, the number of personnel that they will provide to perform annual relief hours, and whether the personnel are dedicated full time equivalents for provision of relief or if they will perform under the contract in other capacities in addition to relief. Offerors are reminded that patrol (rover) and supervisory PSOs shall not be used to provide breaks/relief while simultaneously performing the rover or the supervisory function. If using supervisory personnel to provide relief, a plan should be in-place to ensure that this does not impact your proposed level of supervision.
b. Minimum Submission Requirements Relief Plan: Offerors shall submit as a minimum the following to demonstrate the above:
Offerors shall provide a detailed plan indicating their approach to providing relief.
3. National Weapons Detection Training Program (NWDTP) Training Plan
Typewritten Text Replacement Section C
a. The SOW requires PSOs assigned screening post duties and PSOs assigned as uniformed supervisors that have oversight for screening posts to complete a sixteen (16) hour curriculum for weapons detection training prior to performing or supervising screener duties.
b. Minimum Submission Requirements NWDTP Training Plan: Offerors shall submit as a minimum the following:
Offerors shall identify the total number of Protective Security Officers (PSOs) and the total number of Supervisors proposed to complete the NWDTP training requirements outlined in Section 6.7.3 of the Statement of Work (SOW).
Notice to Offerors: Submission of information under the “Management Approach” factor in response to the solicitation does not take the place of or otherwise diminish the successful contractor’s requirement to submit detailed related contract deliverables (e.g., Transition Plan, Quality Control Plan, etc.) after contract award. Rather, the information provided in response to this factor should be detailed enough (without exceeding prescribed page limitations) to present the offeror’s strategy and/or innovative solutions to delivering the highest quality security services in full compliance with all contract requirements. After award of the contract, the successful contractor's Management Approach will be incorporated into the contract. Notwithstanding this incorporation, the successful awardee will be required to submit detailed contract deliverables which not only provide greater detail than what is provided with the quote or proposal, but also fully delineates the planned implementation of the promised approach(s) and plans for communicating results to the COR throughout contract performance.
