QUESTIONS & ANSWERS
AS OF 5/07/09
Q1. Section C.3 and subsection C.3.10 state the contractor shall include “LEEDS Process” within the proposed Preconstruction Phase fee. We assume this to include attending a one day charette with the team and providing estimates on various items arising from the charette. In Section C.4.3, the contractor is required to provide LEEDS compliant waste disposal.
Beyond the items noted above, we assume that other consultants and/or design professional hired by the government will take care of all other LEED requirements (i.e. energy calculations, LEED documentation, LEED point tracking, LEED registrations and certifications, etc) Please confirm that the above assumptions are correct?
A1. Reference Amendment 0003, Questions 13, 14, and 24. It is anticipated that a 1 -2 day meeting regarding LEEDS will be conducted early in Schematic Design. The CMc should certainly plan to be represented at that meeting. Constructability reviews should include review of the LEEDS process. Additionally, LEEDS will be a topic of conversation during regularly scheduled design review meetings. Beyond that, there is not much additional effort expected from the CMc during the Preconstruction Phase regarding LEEDS.
Q2. Section L.14.e (2) - Project Milestone Schedule and Section F.2 Project Milestones:
We have many creative strategies to shorten the proposed duration of the project schedule published in section F.2. We are willing to discuss and share these strategies with the Government and will have illustrated some of these ideas throughout our submission. Due to the complexity and technical nature of the NBAF project and given the current status of design, we assume these schedule strategies are best developed and confirmed in conjunction with all team members including the DHS team, Design team and CMc team. In order to provide a fair and equal evaluation amongst all bidders, please confirm from a pricing standpoint that all CMc's should bid the full project schedule noted in section F.2.
A2. Offerors should base their proposals on the milestones as presented in Section F, Paragraph F.2 (as revised by Amendment 0003). Reference is also made to Provision L.14.e.(2), Project Milestone Schedule, which requires submittal of a Critical Path Method (CPM) Milestone Schedule for the project, describing your plan for meeting or improving the project schedule in Section F. It also states, “If you propose to improve the schedule, describe the impact on quality of services, materials or workmanship that may occur.” Any changes or improvements in schedule will be an item during discussions.
Q3. Section C1.1.B states "The services requested of the CMc shall cover a wide range of design and construction activities ....". Although the CMc will be fully engaged in supporting DHS and the Design team throughout the project and will also perform the duties noted in the Solicitation documents, please confirm that the CMc will not have specific responsibility for the design of the project.
A3. The A-E is primarily responsible for the design of the project. The A-E contract contains the FAR Clause 52.236-23, Responsibility of the Architect-Engineer Contractor. Keep in mind;
however, that one of the primary reasons for awarding the CMc contract early in the design process is to draw on the expertise of the CMc, particularly in the area of Constructability Reviews, as described in Section C, Paragraph C.2.3. Paragraph C.1.2.m also requires the CMc to establish a design assist program and engage key subcontractors (Mechanical, Electrical, and Plumbing) during the design process. In fact, the key subcontractors must be identified in the proposal. In the sense that the CMc is fully engaged during the design process, they must share some responsibility in the design. Paragraph C.1.2.b.4 defines “Continuation of Design” which further places some responsibilities on the CMc to perform work that was reasonably inferable from the Contract Documents at no additional cost to the Government.
Q4. Is the intent during the pre-construction phase to have the CxA team develop the Cx Specifications in conjunction with the design specifications as well the Cx test forms, such as Component Verification Forms, System Tests, Integrated System Tests?
A4. Yes.
Q5. Typical for most Cx efforts of this magnitude is the implementation of a Web-enabled Cx database that is implemented during the design phase to streamline and make the Cx process more effective. Is it the intent to have the CxA implement this process during the pre-construction phase which can then carry over the construction phase?
A5. Yes.
Q6. In reference to Q66 and A66, please see DOL "All Agency Memorandum No. 131".
According to this, there can be additional wage determinations. Please advise.
A6. You are correct that in certain instances it would be appropriate to include more than one Wage Determination in a contract. I have read DOL “All Agency Memorandum No. 131”, which states, in part, “Only one schedule is issued if construction items are incidental in function to the overall character of a project….” Site work is normally considered incidental if it constitutes less than 20% of the total project cost. In the case of NBAF, site work is considerably less than 20%. I posed this issue to the DOL Washington Office and their position is that we should include only the Building Wage Determination. They also stated they were unaware of any other established area practice in Kansas. Reference is also made to the Solicitation Provision L.10, which states, “Attachment 23, Request for Authorization of Additional Classification, Standard Form 1444, will be used by the contractor to request additional classifications not included in the Wage Decision. There will be ample time between the award of the CMc contract and actual start of construction to process the request for any needed classifications not included in the Building Wage Determination.
Q7. We noted that pages are to be sequentially numbered in the proposal.
Does this apply to section II, specifically the transmittal letters and tracking records?
A7. Section II does not need to be consecutively numbered.
