H-16, (c) “The contract expected to result from this solicitation contains the Clause 52.219-9, I-5, (d)(1) “”Goals, expressed in terms of percentages of total planned subcontracting dollars, …

25. Solicitation Reference: RFP section I: reference FAR 52.230-2 Cost Accounting Standards.

RFP section L.2: reference FAR 52.215-20 Requirements for Certified Cost or Pricing Data and Data Other than Certified Cost or Pricing Data Alternate IV (1997) states “(a) Submission of cost or pricing data is not required.”

One of the exemptions from Cost Accounting Standards is CAS 48 C.F.R.

CAS is applicable; FPAF is not an exempt contract type.

9903.201-1 CAS applicability “(15) Firm-fixed price contracts or subcontracts awarded on the basis of adequate price competition without submission of cost or pricing data.” This is identical to the exemption from cost or pricing data. In addition, the CAS Board exempted contracts where cost or pricing data are not submitted because if such data is not submitted, it is not possible to apply CAS because no baseline (a price proposal with cost or pricing data) for CAS compliance is established or available.

Question: Would the government please confirm that CAS is not applicable to this contract?

26. Is this contract exempt as per Cost Accounting Standards CAS 48 C.F.R.

9903.201-1 CAS applicability (exemption 15)?

28. Question 2.

A base fee is similar to the fixed fee paid to a contractor under a cost plus fixed fee contract that also does not vary with performance." Given that this is a Fixed Price contract, is the use of a base fee still applicable, if so how is the base fee construct envisioned?

See revised definitions in Award Fee Plan attached to Amendment 0003.

36. Solicitation Reference: Section L.10 Factor 5 Price Information page L-14 under Direct Labor Costs: “…The offeror also shall provide the complete labor breakout for each CLIN by offeror fiscal year in the cost breakdown described below. The contractor shall not use composite rates.”

Recommend SLINs that map to PWS/scope areas.

See revised paragraph H.2 of the RFP.

c. Page I-1- I-3; Section I.1 - 52.215-11, 52.215-13, 52.215-21, 52.230-2, 52.230-6.

Further, this section (c) states that wage rates and overheads shall be the basis for establishing the price of the Fixed Price work. Lastly, this section (d) States that DCAA will audit rates & overhead.
