NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.
The Ombudsman Hotline telephone number is 202.372.3695.

SECTION C
DESCRIPTION/SPECIFICATION/WORK STATEMENT
C.1. GENERAL SCOPE OF CONTRACT
The Contractor shall provide all labor, material, equipment, transportation, supervision, disposal, and all other costs necessary to perform painting of interior surfaces (including but not limited to gypsum board and plaster ceilings, walls, and trim; concrete block, brick, wood, and metal walls and trim) and exterior surfaces (including but not limited to concrete, clay-masonry/CMU, aluminum/galvanized and ferrous metals, wood, plastic trim, and drywall) at the United States Coast Guard Academy, New London, CT. Spaces to be painted include but are not limited to on-station family housing, barracks, office spaces, medical facilities, training facilities, classrooms, auditoriums, dining facilities, as well as recreational facilities and maintenance facilities. This includes the temporary relocation of furniture, fixtures and equipment in those areas to be painted. A potential for lead paint removal exists. Contractor shall provide a comprehensive painting program that will ensure facilities are available to meet the needs of the government in a timely manner. Work consists of preparing and painting surfaces (i.e., walls, ceilings, doors, closets, kitchen, cabinets, trim, molding, and other areas). All work shall be accomplished in accordance with contract clauses, applicable wage rates, and specifications for Painting of Interior and Exterior Surfaces U.S. Coast Guard Academy New London, CT dated 23 July 2015.
The Government anticipates making multiple awards under this one solicitation. The contract provides for the award of individual task orders for the execution of various painting projects at the USCG Academy. The Contractor shall provide all labor, material, equipment, transportation, supervision, disposal, and all other costs necessary to fulfill the requirements of each individual task order.
Task Orders will be awarded by the Contracting Officer based on price alone or best value (considering such factors as past performance, quality of deliverables, ability to meet schedule requirements, relevant experience, cost control, and price or cost, etc.) Contractors are at liberty to offer lower unit prices than those established at time of contract award when submitting offers in response to post-award task order solicitations in an effort to be more competitive.
The contract period will be one (1) base and four (4) option years. All work shall be accomplished in strict accordance with contract clauses, applicable wage rates, and the specifications and drawings issued with each individual task order.
C.2. TERM OF CONTRACT
The contract period shall consist of one (1) base year and four (4) option years. There is no guarantee that the Government will continue performance beyond the initial one (1) year base period. Based on the criteria as set forth in Federal Acquisition Regulation (FAR) Part 17.207, option periods shall be exercised at the complete discretion of the Contracting Officer.
C.3. REQUIREMENTS
(a) As the need exists for performance under the terms of this contract, the Contracting Officer will notify the contractor(s) of an existing requirement by issuing a Request for Proposal (RFP) letter including the nature of the work to be performed, the location of the job, and the date of completion.
Specifications for individual task orders shall be of either the design or performance type.
A design specification is one which contains precise requirements, such as methods of construction, measurements, materials and equipment to be used, tolerances, and other detailed requirements. A design specification describes how the requirement is to be achieved.
A performance specification is one that states requirements in terms of the required results with criteria for verifying compliance, but without stating the methods for achieving the required results. A performance specification defines the functional requirements for the asset and/or component, the environment in which it must operate, and the interface and interchangeability characteristics. Performance specifications shall not describe how a requirement is achieved, require the use of specific materials, or parts or give detailed design or construction requirements beyond those needed to ensure interchangeability or interoperability with existing or proposed items. The performance specification establishes performance and acceptance criteria for the assets as complete entities.
(b) Upon receipt of Contractor’s proposal, the Contracting Officer, at his/her discretion, may hold discussions if determined to be necessary. The Contracting Officer will then issue a written task order to the successful Contractor authorizing it to proceed with the work.
(1) Work under this contract shall be ordered by written Task Orders issued on Standard Form OF 347 (Order for Supplies or Services) to the contractor by the Contracting Officer.
(2) Task Orders shall be firm-fixed-price and clearly define the specific services to be performed or the performance desired.
Each Order shall contain other clauses and provisions specific to that work. The Government shall not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed Task Orders.
(3) Method of submission for proposals will be defined in the Request for Proposal (RFP) letter for each individual Task Order.
(c) The Government intends to make multiple awards as a result of this solicitation. The majority of the task orders will be competed amongst the successful awardees. This shall be at the Contracting Officer’s discretion, time and other constraints considered. The Contracting Officer reserves the right to make award of a Task Order without competition based upon a determination that it is in the Government’s best interest or to meet minimum order requirements. The statutory exceptions to fair opportunity are as follows:
1. The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
2. Only one awardee is capable of providing the supplies or services required because the supplies or services ordered are unique or highly specialized.
3. The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
4. It is necessary to place an order to satisfy a minimum guarantee.
5. For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
6. In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirement identified in part 19 apply.
(d) Task Orders may be awarded by the Contracting Officer based on best value – considering such factors as past performance, quality of deliverables, ability to meet schedule requirements, relevant experience, cost control, and price or cost, etc. These factors are not all-inclusive and will vary by individual Task Order. The Contracting Officer also reserves the right to make award of a Task Order based solely upon price, upon a determination that it is in the Government’s best interest. Contractors are at liberty to offer lower unit prices than those established at time of contract award when submitting offers in response to post-award task order solicitations in an effort to be more competitive.
(e) “Oral Orders”. An oral order may be initiated by telephone in emergency circumstances by the Contracting Officer. If oral orders are placed the following conditions will apply.
(1) No oral orders will exceed $3,000.
(2) Award of task orders will be on a firm fixed price basis. Written confirmation on OF Form 347 Order for Supplies, will be issued within three (3) working days after the order is placed.
If an emergency oral order is placed, the contractor shall respond with a reasonable period of time, not to exceed 1 calendar day.
C.4. WAGE RATES
Applicable general wage rates shall be provided for each negotiated task order issued under this contract.
