NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation.

OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.

Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing for urgent and compelling reasons or is determined in writing to be in the best interest of the Government.

The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer of by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

The Ombudsman Hotline telephone number is (202) 372-3695.

B.1 DESCRIPTION OF SUPPLY

The Contractor shall provide all material, equipment, labor, supervision, tools, transportation, and other items or services (except as stated herein) necessary for the fabrication and delivery of polyurethane foam-filled, unlighted steel river buoys in accordance with the U.S. Coast Guard Ocean Engineering Specifications No.455, Revision E, and related specifications and drawings. The buoys are manufactured of steel and filled with polyurethane foam. The buoys are classified into six types according to their size and design attributes. The buoys are polyurethane foam filled, unlighted radar reflective or tall type, 4th or 6th class, including Nun and Can Buoy shapes, which can be red or green in color.

The Contractor shall perform in accordance with the awarded contract and comply with all applicable federal, state, local and municipal laws, regulations and requirements; all industry standards/references; and, all Government and Coast Guard Regulations, attachments and exhibits listed herein applicable to the performance of the contract and to contractor personnel. The Contractor shall instruct and guide its employees regarding any directives provided by the U.S .Coast Guard. The Contractor shall provide the necessary program management oversight to assure that all delivery schedules are met and that any subcontracted parts and services meet all requirements of the contract.

B.2 DELIVERY ORDERS

Fixed unit price delivery orders will be issued when the items are required by the Government. The Government does not guarantee the purchase of any estimated quantities. Delivery Orders will be issued on an Optional Form 347 (OF-347), “Order for Supplies or Services” (or other equivalent form). Individual Delivery Orders will specify the CLIN, product, quantity, unit prices, and total amount of order, the required delivery date, delivery destination, and any other pertinent information. Delivery Orders may be issued by facsimile, by electronic commerce (e.g., e-mail), or by mail. The Contractor is not authorized to provide supplies prior to the issuance of a Delivery Order.

*Buoys and related products: Fixed Unit Prices shall include all costs to construct the products, which includes, but is not limited to, the cost of materials, direct and indirect labor, overhead, general and administrative (G&A) expenses, profit, and all applicable Federal, State, and local taxes and duties. Note:

The Economic Price Adjustment (EPA) Steel Clause of this contract is only applicable to the cost of steel.

*Transportation: Fixed Unit Prices shall include the cost for packaging, loading and all delivery charges.

The contractor shall not levy any charges on the transportation costs (i.e., overhead, G&A, profit, etc.) Note:

The Economic Price Adjustment (EPA) Diesel Fuel Clause of this contract is only applicable to the cost of diesel fuel for the purpose of transportation.

B.3 FIRST ARTICLE TESTING REQUIREMENT

The Contractor shall be required to submit for approval a first article lot production in accordance with FAR Clause 52.209-3 included in Section I of this contract. The first article lot shall include 10 of the following buoy types (4NR, 6CR, and 6NT) per Paragraph 4.3 of the Specification No. 455, Revision E. Approval as used in this paragraph means the Contracting Officer’s written notification to the Contractor accepting the test results of the first article. The initial delivery order expected to be awarded at the time of the contract award, or shortly thereafter, will execute the first article testing requirement.

In accordance with FAR Clause 52.209-3(h), the Government may waive this requirement if supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.

B. 4 ESTIMATED QUANTITIES

The estimated total quantities are listed in the Price Schedule provided as Attachment 1, and the Price Schedule includes Base Year and all Option Periods.

The Contracting Officer has stated realistic estimated total quantities in the solicitation. These estimates are not a representation to an Offeror or Contractor that the estimated quantities will be required or ordered, or that conditions affecting requirements will be stable or normal. The Contracting Officer obtained the estimated quantities by reviewing the records of both current and past requirements. Therefore, this estimate is not a representation that the estimated quantities will be ordered in full, as the need is based upon the unpredictable impact of the environment, seasonal river conditions, and local weather events.

The items specified in the First Article Lot Production are included in the schedule. Actual quantities of river buoys ordered will vary from year-to-year based solely on the Coast Guard units’ operational needs.

B. 5 PRICING OF DELIVERY ORDERS

The pricing of individual delivery orders will be governed by the rates in effect on the day of issuance of the order and those rates will govern until the end of the performance under that order.

F.8 BUOY DELIVERY SCHEDULE

Buoys may be delivered on a continual basis from the date the order is issued through the specified time of delivery. All buoys are required to be delivered no later than the time of delivery specified in each order.

The time of delivery may be specified in terms of calendar days after date of order or converted to a specific date (i.e. May 20, 2018) based on the date of award of the delivery order. The time of delivery for each order will be determined as follows:

(a) Production Time. The following production rates are used to calculate the buoy production time per order:

4 NR/4CR 6NR/6CR/6NT/6CT

30 per day 50 per day

(b) Start Up.

1) If an active order for any class of buoy is not in effect on the day an order will be issued, a start-up period of 60 calendar days shall be allotted for obtaining raw materials and initiating the production line.

2) If an active order is in effect on the day an order will be issued and 60 or less calendars days remain until the time of delivery under the previous order, then a start-up period of 60 calendar days shall be allotted.

(c) Alternate Period. If an active order is in effect on the day an order will be issued and more than 60 calendar days remain until the time of delivery under the previous order, then an alternate period equal to the number of calendar days remaining shall be allotted to consider the buoys still to be produced under the previous order and start up period.

(d) Time of Delivery. Calculate production time by dividing the total number of buoys per type by the respective production rate and adding the results. Add the total production time to the start-up period or alternate period to determine the time of delivery in terms of calendar days after date of award of delivery order.

The following scenarios are provided for illustrational purposes:

(1) There are no active delivery orders in effect.

Proposed buoy order: 900 4NR 500 6NR 250 6NT

900 4CR 500 6CR 250 6CT

Date of Delivery Order: January 1, 2018 River Buoy Order:

1,800 4th class buoys divided by 30 per day = 60 calendar days

1,000 6th class buoys divided by 50 per day = 20 calendar days

500 6th class buoys divided by 50 per day = +10 calendar days Production time = 90 calendar days Start-up period = +60 calendar days

Time of delivery = 150 calendar days after date of delivery order

The time of delivery specified in the order would be 150 calendar days after January 1, 2018, or May 30, 2018.

(2) There is an active delivery order in effect with a delivery date of May 30, 2018.

Date of new Delivery Order: March 1, 2018 River Buoy Order:

1,200 4NR 1,000 6NR

1,200 4CR 1,000 6NR

2400 4th class buoys divided by 30 per day = 80 calendar days

2000 6th class buoys divided by 50 per day = +40 calendar days Production time = 120 calendar days Alternate period = +90 calendar days Time of delivery = 210 calendar days after date of delivery order

The time of delivery specified in the order would be 210 calendar days after March 1, 2018 or September 27, 2018.

(3) There is an active delivery order in effect with a delivery date of September 27, 2018.

Date of new Delivery Order: September 15, 2018

River Buoy Order:

750 4NR 150 6NT

750 4CR 150 6CT

1500 4th class buoys divided by 30 per day = 50 calendar days

300 6th class buoys divided by 50 per day = +6 calendar days Production time = 56 calendar days Start-up Period = +60 calendar days

Time of delivery = 116 calendar days after date of delivery order

The time of delivery specified in the order would be 116 calendar days after September 15, 2018 or January 9, 2019.

(e) If the maximum order limitation set forth in FAR clause 52.216-19 Order Limitations (OCT 1995), is anticipated to be exceeded, then the time of delivery as calculated in this clause may be extended by mutual agreement prior to issuing an order. The order shall reflect the mutually agreed upon delivery schedule.
