Authorized Deviations in Provisions (Apr 1984)
(a) The use in this solicitation of any Federal Acquisition Regulation (48 CFR Chapter 1) provision with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the provision.
(b) The use in this solicitation of any Homeland Security Acquisition Regulation (48 CFR Chapter 30) provision with an authorized deviation is indicated by the addition of “(DEVIATION)” after the name of the regulation.
(End of provision) FAR 52.212-2 Evaluation of Commercial Items (Oct 2014) is not applicable to this solicitation.
Quotes will be evaluated using the Lowest Price Technically Acceptable (LPTA) evaluation method. The lowest price will be identified and evaluated for technical acceptability. Should the lowest priced quote not receive a technical acceptable rating, the next lowest price will be evaluated for technical acceptability and so forth. The successful offeror must also have an acceptable confidence rating under past performance to be considered for award. Quotes shall be Firm-Fixed Prices that are not subject to adjustment except under conditions that are stated in the Statement of Work (SOW). If deemed necessary other than cost and price data will be requested from the offeror.
Factor 1: Technical Acceptability Quotes will be evaluated to assess the offeror’s ability to perform the repair work in accordance with the OEM Manual and perform tasks specified in the SOW. Quotes shall describe how OEM Manuals, updates, service bulletins and engineering changes will be obtained and describe the offerors ability to perform the repair work In Accordance With (IAW) the OEM Manual including updates and the ability to incorporate service bulletins and engineering changes.
Factor 2: Price Offerors shall provide pricing using the Excel spreadsheet Attachment 1, Schedule, HSCG38-17-Q-200001. Offers shall be submitted on the basis of F.o.b. Destination only. Offers submitted on any other basis will be rejected as non-responsive.
Prices will be evaluated to determine fair and reasonableness. However, offerors are advised if a price appears to be extremely low, prices will be evaluated to determine realism. Prices that are extremely low may be judged as unrealistic and may indicate the offeror has misunderstood the nature of the work. The Government will evaluate prices for each contract period of performance including escalation rates between contract periods. The Government may determine that a quote is unacceptable if the option period prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option.
It is DHS policy that pricing for competitive negotiations should be based on adequate price competition. However, in the event only one responsible Offeror is obtained as a result of this solicitation, that Offeror may be required to submit either certified Cost or Pricing Data (FAR 15.403-4) or Data Other than Certified cost or Pricing Data (FAR 15.403-3) to support price negotiations.
(End of provision) Factor 3: Past Performance Past Performance will be evaluated to assess the Government’s confidence in the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of relevant performance in performing the required services and will consider areas of quality, meeting delivery schedules, compliance with contractual requirements and customer satisfaction. Relevant is defined as performing repairs on the same or similar Dynamic Components stated in the solicitation.
References are not required. The Government intends to use information available from the Past Performance Information Retrieval System (PPIRS) and the Contractor Performance Assessment Reporting System (CPARS), previous contracts/purchase orders with the USCG and any information found using Federal as well as state and local Government sources. An offeror must receive an Acceptable Confidence Rating to be considered for award. Offeror’s will be given the opportunity to address/comment on adverse past performance information that may result in an Unacceptable Confidence Rating.
If an offeror does not have a record of relevant past performance or past performance information is either unavailable or so sparse that no meaningful rating can be reasonably assigned, the offeror may not be rated favorably or unfavorably. Therefore the offeror shall be determined to have unknown past performance which for purposes of the LPTA source selection process is acceptable.
FAR 52.212-3 Offeror Representations and Certifications-Commercial Items (Jul 2016) Alternate I of 52.212-3 (Oct 2014) The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(End of provision) FAR 52.212-4 Contract Terms and Conditions – Commercial Items (May 2015) applies to this acquisition. The following Clauses are incorporated as addendum to FAR 52.212-4:

The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued IAW the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued IAW the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(c) The estimated quantities are not the total requirements of the Government activity specified in the Schedule, but are estimates of requirements in excess of the quantities that the activity may itself furnish within its own capabilities. Except as this contract otherwise provides, the Government shall order from the Contractor all of that activity’s requirements for supplies and services specified in the Schedule that exceed the quantities that the activity may furnish within its own capabilities.
(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.
(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.
(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after determined at time of award based on six (6) months after expiration date of ordering period. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
FAR 52.217-9 Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires.
