FAR 52.212-2 - Evaluation – Commercial Items (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers and are listed in descending order of importance. Non-price factors, when combined, are more important than price.
Factor 1: Technical Acceptability
Technical Acceptability will be evaluated by evaluating the ability of the SFI to meet the minimum physical and functional requirements as identified throughout the SOW. Quotes shall provide a product description that explains in detail how their SFI system meets the minimum physical and functional requirements and complete the attached Technical Acceptability Compliance Matrix (Attachment 5). Failure to meet any of the minimum requirements will result in the quote being removed from further consideration.
Factor 2: Sustainment and Repair Capability
The Sustainment and Repair Capability evaluation will assess the offeror’s ability to comply with quality control measures and repair requirements identified in the SOW. Quotes shall explain in detail how their SFI system complies with the quality control measures identified in the SOW, their repair capability, repair turnaround time, and include the completed Sustainment and Repair Capability Compliance Matrix (Attachment 6). Failure to meet any of the minimum requirements will result in the quote being removed from further consideration.
Factor 3: SFI Objective Capabilities
SFI Objective Capabilities will be evaluated to see if the SFI system exceeds or is capable of exceeding physical and functional minimum requirements and provide additional desired objectives identified in the SOW. The SFI Objective Capabilities Compliance Matrix (Attachment 7) shall be completed if any of the abilities of the quoted SFI system exceeds physical and functional minimum requirements or contains any of the additional desired objectives. Quotes shall describe in detail how their SFI system exceeds physical and functional minimum requirements or additional desired objectives, as required. Quotes cannot be negatively rated for this factor.
Factor 4: Past Performance
Past Performance will be evaluated to assess the confidence in the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of relevant performance in providing quality SFI systems, performing repair and sustainment services and will consider areas of quality, meeting delivery schedules, compliance with contractual requirements, and customer satisfaction. Relevant is defined as providing SFI systems and SFI repairs and sustainment as stated in the solicitation to other customers.
References are not required, however quotes shall provide a list of all customer aircraft their SFI system is currently installed in as well as their SFI system quality/scrap rates. Failure to meet this requirement will result in the quote being determined incomplete and will not be further considered for award.
The Government intends to use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s Asset Logistics Management Information System (ALMIS) system, and any information found using sources such as State Government, Local Government, and Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS).
If an offeror does not have a record of relevant past performance or past performance information is either unavailable or so sparse that no meaningful rating can be reasonably assigned, the offeror will receive a Neutral Confidence rating.
Factor 5: Price
The preferred FOB point for shipments under this requirement is FOB destination. Quotes submitting FOB Origin terms should include all applicable customs, duties, taxes, and shipping charges. Any quote providing FOB Origin terms that does not provide this information will be removed from consideration for award.
Prices will be evaluated to determine fair and reasonableness. However, offerors are advised that if a price appears extremely low, prices will be evaluated to determine realism. Prices that are extremely low may be judged as unrealistic and may indicate the offeror has misunderstood the nature of the work. The Government will evaluate prices for each contract period of performance including escalation rates between contract periods. The Government may determine that a quote is unacceptable if the option period prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option.
It is DHS policy that pricing for competitive negotiations should be based on adequate price competition. However, in the event only one responsible Offeror is obtained as a result of this solicitation, that Offeror may be required to submit either certified Cost or Pricing Data (FAR 15.403-4) or Data Other than Certified cost or Pricing Data (FAR 15.403-3) to support price negotiations.
(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
52.212-3 Offeror Representations and Certifications-Commercial Items (JUL 2016)
ALT 1 (OCT 2014)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within fifteen (15) days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons.
