Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)

Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

Av-DEK HI-TAK Polyurethane Conductive Gaskets

AMC 3: Not flight critical, should be purchased from the actual manufacturer or approved source.

AMSC H: The government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than current source.

(4) Identification of the justification and the rationale.

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c )(1) as implemented by FAR 6.302-1 entitled “Only One Responsible Source and No Other Supplies Will Satisfy

Agency Requirements.”

(5) Demonstration that the nature of the acquisition requires use of the authority cited.

The Gaskets are used in conjunction with the various MH-60T electrical systems and sub-systems such as

FLIR, TCAS, and A800 and must be replaced during each aircraft PDM induction due to corrosion or damage. Av-DEC’s proprietary coating and manufacturing methods result in a Gasket with a combined corrosion resistant finish and surface contact technique which ensures the continuous operational electrical flow of the aircraft without interruption due to electromagnetic interference or external weather conditions. There are no other Gaskets that satisfy the Government’s requirements and ensure airworthiness of the MH-60T. The specifications, manufacturing drawings, data, test equipment, and tooling required for the manufacture of the Gaskets is proprietary. The USCG did not purchase rights to the proprietary data required to foster a competitive environment as part of any original provisioning for use on the MH-60T aircraft and the costs to procure this data would be cost prohibitive.

(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Sources Sought Notice HSCG38-15-S-J00009 was posted to the Government Point of Entry (GPE) on

October 17, 2014 and closed on October 31, 2014. No responses were received. This procurement forecast is posted as DHS – Acquisition Planning Forecast System (APFS) No. F2015025857 on http://apfs.dhs.gov. Prior to award, a notice of intent to award a sole source contract fulfilling the notice requirement of FAR 5.201 will be posted to the GPE via http://www.fedbizopps.gov. A copy of the approved J&A will be uploaded with the notice. Any quotations or capability statements received in response to the notice will be considered prior to award.

(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.

The Contracting Officer anticipates prices will be determined fair and reasonable using price analysis techniques including comparison of the proposed price with prices found reasonable on previous purchases and comparison of the proposed price to the Independent Government Cost Estimate (IGCE).

(8) Description of market research.

A Federal Logistics Information System Web Search confirmed that Av-DEC is the only approved source for the manufacture of the Gaskets. Further market research was performed using Federal Logistics

(FEDLOG), GSA Advantage, DOD-Emall, and historical information in the USCG’s database for the same and similar items. Additional sources were not identified. Market research confirmed Av-DEC is the only known source of supply for these Gaskets.
