TERMS AND CONDITIONS
HSCG38-15-Q-500009
Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) Clauses and Provisions
The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with FAR 13.004 constitutes acceptance of all terms and conditions contained herein.
The following clauses and provisions are included:
52.212-1 Instructions to Offerors - Commercial Items
Apr 2014
Period of Acceptance of Offers
(c) Prices must remain effective for 60 days after solicitation closes.
Delivery Requirements
F.O.B. Destination is requested as the F.O.B. point for all deliverables. All offers will be considered F.O.B. Destination unless F.O.B. origin is specified AND estimated shipping costs are included. All items shall be delivered within thirty (30) calendar days after receipt of order.
Evaluation Criteria
The provision at Federal Acquisition Regulation (FAR) 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below. Award will be made to the lowest priced, technically acceptable offer with acceptable or neutral past performance.
Price: The offeror shall provide pricing as requested in the attached spreadsheet titled “HSCG38-15-Q-500009 - Requirements”. Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable. For purposes of evaluating the price of making multiple awards, it is assumed that the administrative cost of awarding and administering a Blanket Purchase Agreement (BPA) is $500. For this reason $500 will be added to each offeror’s price quotation to determine the total price of the award to the Government.
Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. Technical Acceptability will be evaluated on the ability of the offeror to provide the brand name items specified from the Original Equipment Manufacturer (OEM) or an OEM approved source. The USCG will not accept, nor evaluate any alternate items for this BPA. All quotations must provide the ability of the company to meet the delivery requirements listed in the BPA.
Past Performance: The Past Performance evaluation will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s demonstrated Past Performance. The Government may use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS). The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the offeror.
52.212-3 Offeror Representations and Certifications-Commercial Items Dec 2014
X Alternate I of 52.212-3.
Oct 2014 An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certificates electronically via http://www.acquisition.gov . If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.
