(c) Prices must remain effective for 90 days after solicitation closes.

Evaluation – Commercial Items

Evaluation Criteria:

It is anticipated that an indefinite delivery requirements contract will be awarded from this solicitation. All responses to this solicitation/synopsis will be considered for award and will be subject to the evaluation criteria below. The provision at Federal Acquisition Regulation (FAR) 52.212-2 Evaluation of Commercial

Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below. Quotes will be evaluated and contract awarded to the lowest priced technically acceptable quote.

Technical Acceptability:

Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or unacceptable”.

This will be determined by evaluating the ability of the offeror to meet all requirements listed in the SOW and demonstrates a thorough knowledge and understanding of the requirements.

Each Offeror must be an FAA Approved Repair Facility or equivalent European Aviation Safety Agency

(EASA) Approved Repair Facility for the components listed in the Schedule. Additionally, each Offeror must provide an Original Equipment Manufacturer (OEM) authorized repair facility certification in accordance with (IAW) paragraph 3.1 of the SOW. Offerors must provide proof with their quote (such as a letter from the OEM) stating that the offeror is approved to complete the repairs. If the offeror cannot provide the certification with their quote, the quote will not be considered technically.

Price:

The offeror shall provide pricing as requested in the attached spreadsheet titled “HSCG-38-15-Q-200097

Schedule”. Any quantity price discounts and discounts for prompt payment should be included in this section. Total price evaluation will be for the base and all four option periods. Failure to quote pricing for the base year and all respective option years on individual line items may result in a quotation being excluded from further consideration.

Past Performance:

Past performance will be evaluated with a rating of “acceptable” or “unacceptable”. The Government may use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting

System (CPARS). Offerors are advised that more recent performance is more relevant than less recent performance and will be given greater weight in the evaluation process. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be given a neutral past performance rating.

If the offeror does not have any relevant past performance with the government, the offeror shall provide three (3) past performance references that reflect relevant experience performed within the past five (5) years. Relevant experience includes that which is similar in supplies/services provided. The following information shall be provided for each reference listed: Name of Contracting Activity, Contract Number, Contract Type, Contract Amount, Short Description of Work Performed, Contracting Officer and Telephone

Number, Technical Point-of-Contact and Telephone Number. Offers may provide information on problems encountered on the identified contracts and the offeror’s corrective actions. The document “Past

Performance Information Sheet” is attached to this solicitation.

Evaluation Method:

Only the lowest priced offer will be evaluated for Technical Acceptability. Should the lowest priced offer not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced offer until the lowest priced, technically acceptable offer with acceptable or neutral past performance is identified.

52.212-3 Offeror Representations and Certifications-Commercial Items (MAR 2015)

ALT 1 (OCT 2014)

An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at https://www.acquisition.gov/ . If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (o) of this provision.

(End of clause)

52.216-18 Ordering. (OCT 1995)

Such orders may be issued from contract award through one-year from date of contract award for the base period and for options, effective date of option exercise through one-year from effective date of option exercise.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

(End of clause)

52.216-19 Order Limitations. (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than one each for any line item, the Government is not obligated to purchase, nor is the

Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of the total estimated contract line item quantity;

(2) Any order for a combination of items in excess of 50% of the estimated contract quantity; or

(3) A series of orders from the same ordering office within thirty (30) days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the

Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within fifteen (15) days after issuance, with written notice stating the Contractor’s intent not to ship https://acquisition.gov/far/current/html/52_216.html#wp1115057 the item (or items) called for and the reasons. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the

Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the

Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.

(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.

(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the

Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after determined at the time of award base on six (6) months after expiration date of the ordering period.

Alternate I (Apr 1984). (c) The estimated quantities are not the total requirements of the Government activity specified in the

Schedule, but are estimates of requirements in excess of the quantities that the activity may itself furnish within its own capabilities. Except as this contract otherwise provides, the Government shall order from the Contractor all of that activity’s requirements for supplies and services specified in the Schedule that exceed the quantities that the activity may furnish within its own capabilities.

The Contracting Officer may exercise the option by written notice to the Contractor within 30 days before the end of the period of performance being extended.
