(End of Provision) 52.212-2 - Evaluation - Commercial Items (OCT 2014)

Evaluation Criteria The provision at Federal Acquisition Regulation (FAR) 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below. Quotes will be evaluated utilizing the Lowest Price Technically Acceptable (LPTA) process.

The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Evaluation Method:

Only the lowest priced quote will be evaluated for Technical Acceptability. Should the lowest priced quote not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced quote until the lowest priced, technically acceptable quote with acceptable or neutral past performance is identified.

Technical Acceptability: Quotes shall state the Contractor’s ability to repair the indicators in accordance with the OEM’s maintenance manual and frequency table, and to provide a certificate of airworthiness. Quotes shall also state that they are an 1) FAA Approved Repair Facility or 2) equivalent European Aviation Safety Agency (EASA) Approved Repair Facility and be an OEM Approved Repair Facility for the Indicators listed in the Schedule of Supplies/Services.

Past Performance: The Government will use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS). In the case of a contractor without a record of relevant past performance, or for whom information on past performance is not available, the contractor will be given a neutral past performance rating.

Price: The Contractor shall provide pricing as requested in the spreadsheet (Attachment 1) titled “SCHEDULE (Clins)”. Any quantity price discounts and discounts for prompt payment should be included in this section. The contractor’s quote will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable.

It is DHS policy that pricing for competitive negotiations should be based on adequate price competition. However, in the event only one responsible Contractor is obtained as a result of this solicitation, that Contractor may be required to submit either certified Cost or Pricing Data (FAR 15.403-4) or Data Other than Certified cost or Pricing Data (FAR 15.403-3) to support price negotiations.

Upon receiving this notice, the Government may acquire the supplies or services from another source.

(End of Clause) 52.216-21 - Requirements (OCT 1995)

(a) This is a requirements contract for the supplies or services specified and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government’s requirements do not result in orders in the quantities described as “estimated” or “maximum” in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.

(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after determined at time of award based on the latest contract delivery date.

(End of Clause)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least _60_ days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
