NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for reasons of unusual and compelling urgency or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program shall be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.

The Ombudsman Hotline telephone number is 202.372.3695.

STATEMENT OF WORK (SOW)

INTERNATIONAL ORGANIZATION FOR STANDARDARDIZATION (ISO)

Background: Aviation Logistics Center (ALC) Integrated Business Management System (BMS) is currently registered as compliant to the ISO 9001:2008 and ISO 14001:2004 standards. Sustainment of the ISO registrations is vital to ALC’s business system to ensure on-going process improvement, continued delivery of a high quality product and service to its customers, and a highly effective environmental management system. The International Standards specify requirements for a quality and environmental management systems. The quality and environmental systems enable our organization to develop and implement policy, objectives, and processes that address and fulfill customer requirements while maintaining strict adherence to all legal and other environmental compliance requirements. This includes taking action to improve performance and demonstrate conformity of the ALC systems to the requirements of the International Standards.

Scope: The ALC intends to maintain certification of its BMS to include both the ANSI/ISO/ASQ Q9001:2008 Quality Management System (QMS) and ANSI/ISO/ASQ E14001:2004 Environmental Management System (EMS). As such, ALC seeks to continue registration of its integrated BMS through the required integrated QMS/EMS recertification audit during the March/April 2015 timeframe. In addition, ALC will seek to continue certification of its integrated BMS as ANSI/ISO/ASQ Q9001:2008 and ANSI/ISO/ASQ E14001:2004 compliant through surveillance audits in 2016-2017, recertification in 2018 and surveillance 2019. Subsequent surveillance and recertification audits (2016-2019) will be pursued through contracting option years. ALC may be pursuing additional certifications to the AS 9110 and OHSAS 18001 during this period of performance. Timeframes for these additional certifications will align with certification and surveillance schedules for existing certifications. The ability to certify our organization to all described standards is preferred. ALC is an aviation repair facility owned and operated by the Department of Homeland Security (DHS) and staffed with approximately 1,400 civilian, military, and contract employees. The operational hours of ALC consist of the majority of the workforce working on a day shift within the hours of 0645 – 1730 with the exception of approximately 2% that work a second shift within the hours of 1515 – 2400. Because ALC is a tenant command, much of the infrastructure does not fall under the scope of the certification. In addition, off-site contracted facilities and certain contracted processes are out of scope. ALC is responsible for overhauling and repairing aircraft, providing aircraft parts and equipment to the fleet, re-engineering and manufacturing of aircraft parts, performing multi-million dollar contracting actions, logistics support, providing technical engineering support, information services, and providing teams of personnel who provide on-site field assistance to Coast Guard air stations and deployed aircraft.

Government Furnished Property/Information: The Government will provide a work area including access to telephone, copier, fax machine and computer. The Government will provide transportation and guides in support of the auditing effort. Upon request or award, the Certification Body (CB) will be provided copies of current certification and three years of accepted corrective actions and audit reports accepted by the current CB.

CB Accreditations and Experience: The CB shall meet the following minimum accreditation and experience:

1. The CB shall be accredited through the American National Accreditation Program for Registrars of Quality Management Systems and Environmental Management Systems as administered by the ANSI-ASQ National Accreditation Board (ANAB) or other recognized equivalent accreditation bodies. The scope of this accreditation shall include requirements covered by IAF Code 21 for Aerospace (North American Industry Classification System (NAICS) Code 336413 for aircraft overhaul, repair and aviation component overhaul).

2. The CB shall have the capability of providing references that have achieved registration through their organization to ANSI/ISO/ASQ Q9001:2008, ANSI/ISO/ASQ E14001:2004, OHSAS 18001:2007 and AS 9110. The auditors working for the CB shall have experience in alignment with NAICS Code 336413 for aircraft overhaul, repair, and aviation component overhaul and repair.

3. The CB shall have participated in the registration audit of at least one U.S. government organization. CB experience certifying government aviation organizations is preferred. The auditors working on behalf of the CB are preferred to have participated in at least one aircraft facility certification audit for conformance to ANSI/ISO/ASQ Q9001:2008, ANSI/ISO/ASQ E14001:2004, OHSAS 18001:2007 and AS 9110 standards.

4. Members of the CB’s Audit Team shall be certified auditors. Auditors qualified in multiple standards is preferred including the ANSI/ISO/ASQ Q9001:2008, ANSI/ISO/ASQ E14001:2004, OHSAS 18001:2007 and AS 9110 standards. ALC utilizes a fully integrated business system. Utilizing dual system qualified auditors increases audit depth and aligns with local ALC audit techniques.

5. Audits under this contract will be performed aboard a DHS facility with special access requirements for foreign nationals. The CB shall be responsible for obtaining all special access clearances in a manner that will not affect scheduled performance for all personnel provided to work under this contract.

6. Capability to certify our organization to the following additional standards: AS 9110 and OHSAS 18001 are preferred. ALC is currently in the process of evaluating the benefits of these standards and plans to pursue one or more within the timeframe of this contract.

7. Availability of a CB provided interactive documentation/record system for retrieval and submission of Corrective/Preventive Actions, audit reports and other audit documentation is preferred.

Quality Assurance: The CB shall have a multi-layered appeals system through which ALC may appeal any ruling, determination or action of the CB relating to the auditing and/or registration processes.

Technical Requirements:

1. Integrated Management System Recertification: Prior to expiration of the current ANSI/ISO/ASQ Q9001:2008 and ANSI/ISO/ASQ E14001:2004 certificate of registration, ALC will contact the CB to begin discussions concerning the performance of a recertification audit. During this recertification process, ALC may also pursue certification to the BS OHSAS 18001:2007 Standard as an option. If awarded and following successful completion of the audit, the CB will recertify ALC as conforming to the requirements of the ANSI/ISO/ASQ Q9001:2008 and ANSI/ISO/ASQ E14001:2004 standards in addition to the OHSAS 18001:2007 standard if pursued. Certification to the OHSAS 18001:2007 standard shall be considered as an option. The recertification shall include the presentation of a Certificate of Registration to all standards pursued and the presentation of camera-ready artwork of the CB’s quality mark, those of the CB’s accrediting organization for use by ALC. The performance of this recertification audit shall be completed within a five day period and involve no greater than 70% of our organization.

2. Integrated Management System Surveillance Audits: The CB shall provide surveillance audits to ensure compliance and certification to ANSI/ISO/ASQ Q9001:2008, ANSI/ISO/ASQ E14001:2004 standards in addition to other certifications pursued. The next recertification/surveillance efforts will be accomplished through option years within this contracting effort. Exact dates shall be agreed between ALC and the CB. During the surveillance cycle, ALC may also pursue certification to the AS 9110 standard. This additional certification shall be considered an option.

(ii) options;

(iii) contracts to acquire stock;
