1. This amendment is hereby issued to answer the following question received in response to the above numbered solicitation.

Question:

Section H.12 (4) states "The Contractor shall be excluded from competition for, or award of, any Government contract which calls for the construction or fabrication of any system, equipment, hardware, and/or software for which the Contractor participated in the development of requirements or definitions pursuant to this contract". Our question is:

What is the definition of "any government contract" and what are the boundaries? For example, if the Contractor helps develop requirements or definitions for a detection or Continued ...

( B ) sensor system for the USCG, such as a specialized nuclear or radiological detection system, would that Contractor be excluded from competition issued by a Department of Defense military Service for a similar detection or sensor system?

Answer:

"Any Government contract" refers to any procurement action funded and executed by the U.S. Government and its Agencies.

With regard to the above "example scenario", if a Contractor develops requirements resulting in access to advance information about a future Government procurement that is not generally available to other persons or firms, that Contractor should be excluded from competition.

In the "example scenario", it is assumed that the Contractor has obtained "advance information" directly related to the "similar" Department of Defense detection or sensor system. In this case, the Contractor would have an unfalr competitive advantage.

Federal Acquisition Regulation Subpart 9.508 provides several examples that illustrate situations in which questions concerning organizational conflicts of interest may arise.
