Additionally, the contractor shall warrant the material and workmanship provided for a period of at least one (1) year from the delivery date.
BASIS OF AWARD:
The Government intends to award a BPA to the responsible offeror whose offer that meets or exceeds the Government’s requirements, price and other factor and represents the best value to the Government.. . Partial awards shall not be considered. As such, offeror(s) shall propose pricing for all items listed on the Price Schedule (Attachment A). The Government intends to make a single award.
The following evaluation factors will be used in this selection process:
· Technical
· Past Performance
· Price
Technical and Past Performance when compared to price are more important.
Determination of Responsibility:
A determination of responsibility will be made on the apparent successful offeror prior to contract award in accordance with FAR Part 9.104. If the prospective contractor is found non-responsible, that offeror will be rejected and will receive no further consideration for award. In the event a contractor is rejected based on a determination of non-responsibility, a determination will be made on the next apparent successful offeror.
ICE reserves the right to award the BPAs based on the initial offers and may not require discussions or negotiations with the successful offerors or any other offeror. Therefore, it is critical that each offer be fully responsive to this solicitation and its provisions. Additionally, ICE reserves the right to conduct discussions and negotiations with any individual competing offeror, some, or all competing offerors, as the situation warrants.
EVALUATION FACTORS:
The evaluation factors to be used in the evaluation are listed below. These evaluation factors will be the basis for the BPA.
Factor 1 – TECHNICAL:
The Government will evaluate the offerors technical proposal(s) to determine if it substantiates the offerors claimed abilities to provide all the services outlined in the SOW.
1) Capability to perform all the finishes as outlined in the Statement of Work (SOW);
2) Possess a current ATF Manufacturing Federal Firearms License;
3) Business establishment must be within a 200 mile radius of the Office of Firearms and Tactical Programs (OFTP) located in Altoona, PA.
This factor will be evaluated on a meet/does not meet basis.
Factor 2 – PAST PERFORMANCE:
The Government will evaluate the offerors past performance information of a similar size, scope, and complexity, as proven by the successful management of current and previous agreements or contracts of a similar size, scope and complexity during the last three (3) years from the date of issuance of the solicitation as it relates to:
| a. | Quality of Service |
| b. | Contract Performance |
| c. | Timeliness of Performance |
In performing this evaluation, the Government requires that the offeror has satisfactory previous experience/performance in providing firearms finishing, refinishing and or lubrication services for DHS component agencies, U.S. DoD or another federal law enforcement agency.
If the offeror has asserted that it has no relevant past performance information available for evaluation, past performance will be rated as neutral. A neutral rating in the offerors past performance indicates that the offeror receives no merit or demerit for this factor.
This factor will be evaluated on a Satisfactory, Neutral, or Unsatisfactory basis.
Factor 3 – PRICE:
The Price Proposal will be evaluated for accuracy, completeness, and reasonableness but will not be assigned an adjectival rating. For award purposes, the Government will evaluate the prices for the base period as well as all options. Award will be made on the basis of the lowest evaluated price meeting or exceeding the acceptability standards for non-cost factors. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
The government will review the price schedule for completeness and accuracy. The offerors proposal will be checked for mathematical correctness to ensure all prices/costs are summarized correctly. A determination will be made regarding whether the price appears unbalanced for the separately priced items identified on the pricing schedule.
