A. The hour and date specified for receipt of offers is hereby extended to January 23, 2008 at 16:00 EST.
B. The following questions and answers are hereby provided for informational purposes only:
1). Question: Could you please provide me with a seniority listing of all incumbent employees for this project.
Answer: This information is only required to be provided to the successful offeror.
2). Question: Could you please provide the following information regarding the incumbent contractor: Who are they? When did they win this contract? What was the original winning bid price? What is the current pricing for the current contract period and what is the length of this contract period for which you are providing the current pricing? Was the original contract also a set-aside contract? Is the incumbent contractor eligible to bid on this project again?
Answer: The incumbent contractor is DTM Corp. located in Silver Spring, MD. This contract was awarded on August 19, 2002. All questions regarding past and present pricing on this contract must be requested via the Freedom of Information Act (FOIA). The original contract was an 8(a) set-aside. The incumbent contractor is eligible to bid on the solicitation.
3). Question: In Section C-28 page 71 of the solicitation in the instructions for the Relevant Experience Factor of the technical proposal, you indicate that to have our customers send the Past Performance Questionnaires to Josh Clemens. Is this correct or did you intent to have the PPQ’s sent to you instead?
Answer: Past Performance Questionnaires should be sent to Brian Connolly, fax 215-521-2297, e-mail brian.connolly@dhs.gov.
4). Question: You indicated that the incumbent contractor is DTM Corp., but the specs include two CBA’s, one for DTM and one for Ares. Can you clarify why there are two CBA’s and only one contractor?
Answer: The building located at 4401 N. Fairfax Drive, Arlington, VA covered by the Ares CBA, is not on the current contract; however, it is included in this solicitation.
5). Question: You indicated that you would not be able to provide a seniority list and that the winning contractor will need to obtain the seniority list from the incumbent contractor after contract award. However, the Service Contract Act (SCA) requires the incumbent contractor to provide seniority data to the Contracting Officer upon request. Can you please request the incumbent contractor to provide the requisite seniority data and provide it to the offerors on this RFP?
Answer: The Service Contract Act (SCA) does require a contractor to provide a seniority list to the Contracting Officer upon request; however, it does not require the Contracting Officer to provide it to any other contractors prior to contract award. This information will not be provided.
6). Question: Attachment I lists that all posts require relief; this seems somewhat unusual for the rovers and the supervisor positions. In general these positions are self-relieving and do not require separate relief.
Answer: Attachment I is hereby revised to read no relief for rovers and supervisors.
7). Question: Attachment I also lists that the 15 minute break and 30 minute lunch breaks are paid breaks; we understand that the 15 minute breaks are paid, but in general the lunch break is unpaid. Can you verify and confirm that it is the government’s intention to require the contractor to provide paid 30 minute breaks to all personnel.
Answer: A paid 30 minute lunch break shall only be provided to those individuals working a minimum 8-hour shift as indicated on Attachment I.
8). Question: The Arlington Square site lists that posts 1, 2 and 3 are fixed/rover posts. Please clarify which portion of their shift is fixed and which is rover. Are the duties different during the grave and swing shift compared to the day shift?
Answer: Some posts may require a combination of fixed hours at a security guard booth and roving patrols. Security guards should adhere to the patrol schedule as outlined in the post orders or as directed by the COTR as stated in the SOW.
9). Question: The subject solicitation clearly identifies the requirement for Guard II service at both the DC and Arlington locations. The CBA between Ares Group, Inc. and the ITPEU does not identify a Guard II wage rate for the Arlington location. The CBA does identify a Guard I wage rate of $15.50. That wage rate is significantly lower than the prevailing Guard II wage rate of $17.66 set forth by the USDOL. What is the wage rate that applies to this solicitation for personnel employed as Guard II at the Arlington location?
Answer: The solicitation does require Guard II service at both the DC and Arlington locations. You are correct that the CBA between Ares Group, Inc. and ITPEU does not identify a Guard II wage rate for the Arlington location. Therefore, the Guard II wage rate of $17.66 contained in Wage Determination No. 2005-2103 (Rev. 4) dated 7/5/07 is hereby incorporated into subject solicitation. This rate is to be utilized by offerors in determining their pricing for the Arlington location only; however, all of the fringe benefit rates contained in the CBA between Ares and ITPEU are still in full force and effect and shall be utilized by offerors in their pricing.
C. Attachment I is hereby revised to read “no relief” for rovings guards (this does not include fixed/roving posts) and supervisors.
D. All other terms and conditions remain unchanged.
