AMENDMENT #4

Question 1. Please provide a tenure listing and the total number of incumbents currently with an active EOD status on the contract.

Answer: There are currently 20 guards on the contract with the following Enter on Duty (EOD) dates:

Year Hired Number Hired 2000 5 2001 1 2002 7 2003 3 2005 1 2007 2 2008 1

Question 2. Are all incumbents fully trained and qualified as per the solicitation training and qualification requirements?

Answer: All incumbent guards are fully trained and qualified under the contract requirements.

Question 3. Please provide the ITPE Annual Benefit Plan (this is referenced in the CBA). Without this plan, there is no way to determine how much vacation, sick, and other leave must be provided to the employees.

Answer: The ITPE Annual Benefit Plan is in book format and contains information from many companies. It therefore cannot be included in the solicitation. The following information may help in developing your hourly rates:

Vacation:

--2 weeks of vacation after 1 year --3 weeks of vacation after 5 years --4 weeks of vacation after 10 years

Sick Leave:

--6 sick days per year accrued at ½ day per month

Holiday Leave:

--12 holidays per year paid at 1 per month

Question 4. Page 13, sec 4.1B, number 5 states that: “Bi-lingual security guards may be an asset to the Contractor.” What language would be of value? Are any of the current security guards bi-lingual?

Answer: There is no public traffic therefore bilingualism will not be needed. In addition, we do not keep records on what languages other than English the guards speak.

Question 5. Page 14, sec 5.2C. states that “The Government may assess price deductions…”, is there a schedule of potential deductions such as are typically found in a Performance Work Statement or are these deductions a direct reduction of billable hours for services not provided according to contract?

Answer: The deductions would be a direct reduction of billable hours for services not provided according to the contract.

Question 6. Page 29, sec 11.4.1 has a title heading of ‘Semi-Annual Firearms Re-qualification” while the text of the Section A speaks to annual recertification. Can you clarify?

Answer: The header on page 29 is incorrect. The officers are required to weapons qualify annually (1 time).

Remove page 29 of the solicitation and replace it with the attached corrected page.

Question 7. Page 30, sec 11.7 – are government provided training hours on mags and X-ray done during billable hours or is the cost for that time to be wrapped into training hours in overhead?

Answer: All costs must be figured into the hourly rate.

Question 8. Page 31, sec. 11.9 A, suggests that the contract might require less than lethal force options on site, but no other information calls out such devices, ie: baton, OC Spray, etc. Is the current force supplied with such options either by the Government or by the vendor? Are any of these options required or requested for the new contract?

Answer: In Exhibit 2C an expandable baton with holder is included in the requirements for uniform items. The weapons training in Exhibit 4E includes the use of a baton. In Exhibit 4F the annual refresher training indicates baton training.

Question 9. Page 46, sec 17.4 – the language suggests that all officers/guards must have both a suitability and a Top Secret Clearance as also shown on the table in Exhibit 6C on page 107. Is that correct or does the TS negate the requirement for a suitability as well?

Answer: Both suitability and Top Secret Clearance are required.

Question 10. Page 55, sec 20 B. states that performance evaluations will be conducted at least annually. Can you provide the last 5 years worth of evaluations on the incumbent contractor Santa Fe?

Answer: We will not release the performance evaluations of the incumbent contractor.

Question 11. Page 67, Exhibit 2E requires a .40 Caliber weapon, and suggests a number of options for manufacturer. In an effort to accurately price the training segment, can you provide the current weapon that all incumbent security guards have been certified on for this project site?

Answer: All incumbent guards are certified for the 40 caliber Glock Model 23.

Question 12. Page 131, General - lists audited financials as a requirement for inclusion in Vol II. May we provide tax returns and alternative information from our accountant instead?

Answer: Audited financial statements are only required if your company is publically traded. If audited financial statements are not available, unaudited financial statements can be provided, which would include your Balance Sheet, Income Statement, and Statement of Cash Flows.

Question 13: Page 132, Sec (4) Page Limitations A. Volume I states that it is limited to 15 pages "inclusive of any Charts, Diagrams, and/or other graphics". Attachment 1 Past Project Form is expected to be one full page per reference and included in the submission, meaning up to 6 pages if we propose a teaming arrangement. Are these Attachment 1 pages considered part of the page count?

Answer: The Past Project pages are to be excluded. Insert the words “and past performance forms and questionnaires” to the sentence that states, “The cover sheet, table of contents (not to exceed one page per volume), tabs and dividers will not count toward the page limit.”

29 (Correction) by FPS will not be deemed acceptable for the purposes of this Contract. Government firearms monitoring, testing and training will take place Monday through Friday excluding Sat. Sun. & Holidays or on a mutually acceptable date and time of the COTR / Inspector.

11.4.1 Annual Firearms Re-Qualification and Practice Qualification (see note E. )

A. The Contractor shall ensure that all Contract employees receive the training or range time necessary to successfully re-qualify on the practical firearms course annually. Any guard attempting annual re-qualification who fails to re-qualify is no longer certified to carry a weapon and shall not be permitted to work on an armed post. Refresher training for intermediate weapons will also be conducted. The costs of such preparations should be factored into the offering prices, as it will not be itemized or paid for separately by the Government.

B. Successful firearms range qualification by Contract employees as part of a state or local firearms permit/license issuance process shall not be considered an acceptable replacement or substitute for the annual firearms qualification required by this Contract.

C. FPS Law Enforcement personnel or trained representative will witness the annual firearms qualifications for Contract employees. Annual Firearms qualifications that are not witnessed by FPS will not be deemed acceptable for the purposes of this Contract.

A. The Contractor shall provide the necessary weapons and ammunition for training and qualifications. All Contractor-provided weapons used for qualifications of Contract employees will be inspection by the contractor prior to use on any firing range. Contract employees must adhere to the rules and regulations of the firing range. The Contractor shall be responsible for licenses and permits required for weapons during transit between the employee dispatch point and the range.

B. Specials Note: On this contract, NDIC is requiring that all guards qualify 1 time per year and perform 1 practice qualification prior to the annual requalification. This practice qualification will require the guard to be given 250 rounds, sufficient targets, a firearms trainer and range time. This practice qualification does not have to be FPS monitored. The contractor will place a document in the guard’s folder to show this practice qualification with 250 rounds took place.

11.5 Minimum Age for Firearms Licensing

A. Notwithstanding the minimum age requirement cited elsewhere in the Statement of Work, the Contractor must follow Federal, state and/or local licensing requirements for Contract employees. In most areas the minimum age requirements for armed security guard personnel is twenty-one (21) years of age.
