About this file

This document is a Justification for Other than Full and Open Competition for the Defense Commissary Agency (DeCA). The justification covers a short-term blanket purchase agreement (BPA) HQC00625A0007 with Coastal Pacific Food Distributors (CPFD) to supply fresh fruits and vegetables (FF&V) to South Korea commissary locations. The 90-day procurement includes a 30-day base period from 24 May 2025 through 23 June 2025, with two additional 30-day option periods, and has a total estimated order value of $1,777,885.00.

The sole-source justification stems from a prior General Accounting Office (GAO) protest regarding a previous FF&V contract. DeCA requires an uninterrupted supply chain while implementing corrective actions and soliciting a new competitive contract. The agency determined that no other vendor currently possesses the established infrastructure and logistical capabilities to provide FF&V within the required timeframe, citing previous supply disruptions that necessitated costly international sourcing and airlift of products from the contiguous United States. The document emphasizes that establishing a new supply chain typically requires at least six weeks and involves complex vendor coordination, online catalog development, and base access acquisition.

Justification for Other than Full and Open Competition Control Number: HQC006-25-11

A. Justification

1. Contracting Office: Defense Commissary Agency (DeCA), Pacific Contracting Office, Kadena

Commissary, Japan, Unit 5156, Bldg 407, APO, AP 96368-5156

2. Description of Supplies or Services: DeCA has a requirement to award the short-term blanket purchase agreement (BPA) HQC00625A0007 for the uninterrupted supply of a full line of worldwide available products that shall be of equal to or better quality than fresh fruits and vegetables (FF&V) Class 1 standards as outlined in the International Standards for Fruit and

Vegetables (ISFV) as set up by the Organization for Economic Cooperation and Development

(OECD) and products grown locally in South Korea of equal or better quality than OECD Class 2 standards from Coastal Pacific Food Distributors (CPFD) to South Korea commissary locations.

The period of performance is a 30-day base period from 24 May 2025 through 23 June 2025, with two 30-day option periods. The total 90 day estimated value of orders to be placed against the BPA is $1,777,885.00.

3. Authority Cited: 41 U.S.C. 1901 in accordance with FAR 13.106-1(b)(1) as implemented by FAR subpart 13.5. See also FAR 6.302-2.

4. Reason for Authority Cited: The General Accounting Office (GAO) received a protest regarding

DeCA’s award HQC00625A0001 for the long-term supply of the supplies described above. The

Agency requires uninterrupted FF&V supply to DeCA commissary locations in South Korea while implementing corrective actions in response to GAO’s recommendations. These actions include canceling the existing FF&V contract and awarding a new contract pursuant to GAO-prescribed procedures, which are currently underway. DeCA issued Notice of Termination dated 15 April

2025 followed by a bilateral modification terminating the BPA effective 23 May 2025. DeCA is presently soliciting proposals for a new contract under Federal Acquisition Regulation (FAR) Part

6, utilizing FAR Part 15 procedures. However, the necessary timeframe for solicitation, award, and contract transition necessitates this short-term sole source award while a new contract is being procured in accordance with the GAO’s recommendations.

5. Fair and Reasonable Cost Determination: The Contracting Officer will ensure that contract terms, conditions and price are commensurate with the Government’s need. Price reasonableness will be established in accordance with 13.106-3. Price reasonableness will be determined based on current price lists.

6. Market Research: Market research was not conducted for this short-term action. Establishing the requisite supply chain for FF&V provision in South Korea typically requires a minimum of six

Control Number: HQC006-25-11 weeks. This includes vendor coordination with suppliers, development of online catalogs, acquisition of base access, and other administrative prerequisites. DeCA’s recent experience with supplier disruption underscores the logistical complexities and substantial lead time required to establish a new FF&V supply chain. Previous disruptions necessitated extraordinary measures, including costly and logistically challenging international sourcing and airlift of FF&V from the contiguous United States (CONUS). This resulted in incomplete provisioning, significant cost overruns, and widespread disruption for all stakeholders. Based on this experience, DeCA has determined that no other vendor currently possesses the established infrastructure and logistical capabilities to provide uninterrupted FF&V supply with the required timeframe.

8. Actions to Increase/Foster Competition: DeCA is actively underway with actions to award a competitive contract as outlined above.
