52.204-4500 INSTALLATION ACCESS REQUIREMENTS (JAN 31 2012)
The contractor shall be responsible for ensuring full compliance with all installation access procedures. Installation access includes, but is not limited to, obtaining applicable installation passes and inspections for vehicles and personnel. Contractor employees may also be subject to background security checks/clearances in order to obtain credentials for passes. Some installations are using programs, such as RAPIDGate, which may result in a cost to the contractor. Any costs associated with such programs or with obtaining passes, will not be reimbursed separately and should be included in the contractor's proposed pricing for the product or services being acquired.

I. SUBMISSION OF QUOTES: Reference FAR 52.212-1 Paragraph (b) North American Industry Classification System (NAICS) Code applicable to this solicitation is 811310 and the Size Standard is $12.5. Per FAR 4.1201(a): Prospective contractor SHALL complete electronic annual representations and certifications (Reps& Certs) at https://www.beta.sam.gov database. Your Reps and Certs must include the NAICS applicable to this solicitation document and indicate your organization’s business size status.
Per 13 CFR 121.104 – If the size determination is based on average annual gross revenue, the method for determining business size status is based on the company’s average gross revenues for the last three fiscal years. Organizations whose average annual gross revenues exceed the size standard of this solicitation are considered large businesses. The offeror shall submit a written explanation (maximum 3 pages, single-spaced, using 12-point font, with “1 standard margins) describing how the firm will fulfill the contract requirements in accordance with the statement of work.
(3) Prospective contractors shall complete electronic annual representation and certifications at System for Award Management (SAM) website available at https://www.beta.sam.gov and must indicate their business size for the applicable NAICS code.

(a) Three (3) past performance references must be submitted that are most similar to the work of this solicitation that you have performed in the past three years.

(c) Past performance references shall be submitted- by the closing date of the solicitation.
Surveys provided directly by the offeror will not be considered.
DeCA preserves the right to consider any other past performance information available to the Government such as PPIRS or other databases.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
I. GENERAL
The purpose of this document is to establish an evaluation procedure for quotes received in response to solicitation HQC005-23-Q-0010 for the emergency backup generators maintenance and repairs requirement for the Defense Commissary Agency Headquarters.
This evaluation will be using lowest-price, technically acceptable (LPTA), simplified acquisition procedures. Technical capability, past performance, and price will be evaluated. After receipt of quotes, the Government will rank quoters by Total Proposed Price (TPP) in ascending order. The Government will first evaluate the quoter with the lowest TPP. If the quoter with lowest TPP is determined acceptable for technical capability and past performance and its price is determined fair and reasonable, the evaluation process will end as that quote is the lowest price technically acceptable. Award will be made to that quoter without further consideration of any other quotes. If the lowest ranked TPP quoter’s technical capability or past performance is determined unacceptable, or the price cannot be determined fair and reasonable, the next lowest TPP quoter’s technical capability and past performance will be evaluated and receive a rating of acceptable or unacceptable. This process will continue (in order of ascending TPP) until a lowest price technically acceptable quoter with a fair and reasonable price is achieved. Upon that achievement, the evaluation process will end and award will be made to that quoter without further consideration of any other quotes.
II. EVALUATION FACTORS
Quotes will be evaluated independently, using the following factors on an acceptable or unnacceptable basis:

1. Technical Capability: The technical factor will match the specific evaluation criteria for the solicitation and assess whether the quote will satisfy the Government’s minimum requirements. The offeror shall submit a written explanation (maximum 3 pages, single-spaced, using 12-point font, with 1” standard margins) describing how the offeror will fulfill the contract requirements in accordance with the statement of work.

2. Past Performance: Each vendor is required to submit their past performance references. Past performance factors will be evaluated on an acceptable/unacceptable basis. In evaluating the contractor’s past performance, under DeCA or similar contracts and customer surveys submitted by the references, performance will be used.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unnaceptability, a neutral rating shall be considered acceptable for this solicitation Offerors without past perfromance will be rated as neutral which is considered acceptable for this solicitation.

3. Price: Price will be evaluated to determine the price fair and reasonable. Offerors MUST provide pricing for all line items end in “AA” and “AB”. Incomplete quotes may be deemed ineligible for award. In evaluating price, the following figures will be used to evaluate the base and each option years (note that the “X” in the item number below denotes the applicable performance period).
a. Item No. X001AA: Total amount (unit price multiplied by quantity of 4)
b. Item No. X001AB: For evaluation purposes only of “AB”, the Government will use:
• 10 hours multiplied by rate per hour during normal business hours for evaluation purposes
• 5 hours multiplied by the rate per hour for overtime, holidays, other than normal business hours for evaluation purposes
• Offered trip charge will be multiplied by 1 for evaluation purposes
c. Summation of the totals for X01AA and X001AB for the base year and all option years will comprise the total evaluated price.
III. EVALUATION MINIMUM REQUIREMENTS
d. Technical Capability: An offer will be evaluated as technically acceptable if it satisfies the Government's minimum requirements specified in the statement of work.
e. Past Performance: The evaluation of past performance will be an assessment based on a consideration of all relevant facts and circumstances. The Government is seeking to determine whether the contractor has consistently demonstrated a genuine concern by performing quality services on time, with concern for the customer's satisfaction. The evaluator will use the business references provided by the vendor and any other information available, such as the Past Performance Information Retrieval System (PPIRS) and past performance surveys. If adverse information is obtained, that was not previously communicated, the vendor will be provided an opportunity to respond.
f. Price: The total evaluated price must be determined fair and reasonable in order to be determined acceptable for award. The contract specialist will evaluate all quotes. Quotes will not be discussed or released to anyone not directly involved in the source selection for this acquisition. Each quote will be evaluated independently. Price reasonableness will ultimately determine whether or not the award will be issued.
Technical capability and past performance, when combined, are equal to price.
a. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (DEC 2022) ALTERNATE I (OCT 2014)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision --
"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
"Inverted domestic corporation" means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
"Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor.
"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or

"Sensitive technology"--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
"Service-disabled veteran-owned small business concern"--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

"Successor" means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
"Veteran-owned small business concern" means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
