About this file
This is a Brand Name Justification and Approval document from the Defense Microelectronics Activity (DMEA) for a firm fixed price contract to procure Siemens EDA software licenses.
DMEA is procuring three Siemens Electronic Design Automation (EDA) software licenses under SOW 26-6G3 to enable collaboration with US Navy and US Army personnel who are designing custom mixed-signal integrated circuits on Skywater's S130 semiconductor process. The justification establishes that Siemens EDA tools are required because the Skywater S130 process design kit does not support DMEA's existing Cadence EDA software tools, making it impossible for DMEA to design integrated circuits on that process without Siemens software. While Cadence Design offers similar EDA software, using Siemens tools is necessary for effective collaboration with the DoD partner organizations. The procurement is conducted under FAR 16.505(a)(4)(ii) authority for items peculiar to one manufacturer. Market research identified Siemens as the proprietary owner and two authorized large business distributors—Advanced Computer Concepts and Software Information Resource Corp (both under NAICS 513210)—as potential sources. The contracting officer will post a request for quote on SAM.gov for full and open competition and has determined the anticipated cost will be fair and reasonable based on an Independent Government Estimate. No specific dollar value, response deadline, or award date is provided in the document.

DMEA #26-29

Defense Microelectronics Activity 4234 54th Street, McClellan, CA 95652
SOW# 26-6G3
Brand Name Justification and Approval
1. Agency and Contracting Activity:
Office of Secretary of Defense, Defense Microelectronics Activity (DMEA).
2. Nature/Description of Action:
New firm fixed price contract for Siemens EDA software licenses.
3. Description of Supplies/Services:
The Contractor shall provide three (3) Siemens EDA software licenses IAW SOW 26-6G3. The anticipated dollar value of this procurement is_.
4. Authority Cited:
FAR 16.505(a)(4)(ii). Requirements for use of items peculiar to one manufacture shall be justified and approved using the format(s) and requirements from FAR 16.505(b)(2)(ii) A-C, modified to show the brand-name justification.
5. Reason for Authority Cited:
DMEA has been asked to assist the US Navy and US Army in the design of two custom mixed-signal integrated circuits on Skywater’s S130 semiconductor process. The US Army and US Navy personnel are currently using the Siemens EDA tools. To collaborate with these DoW partners, it has been requested that DMEA have the same software tools. Cadence Design also sells similar EDA software tools; however, collaborating with these specific DoW colleagues would be more difficult. DMEA currently has licenses for Cadence EDA software tools;
however, the DRC software DMEA owns is not supported by the Skywater S130 process design kit. In other words, DMEA cannot design ICs on the S130 process. Thus, procuring either directly from Siemens, the proprietary owner, or one of its authorized distributors is the only viable way of fulfilling this requirement.
6. Efforts to Obtain Competition:
The proprietary owner of the EDA software, Siemens, is a large business and the two authorized distributors (Advanced Computer Concepts and Software Information Resource Corp) are also large businesses under NAICS 513210. The request for quote will be posted on SAM.gov for full and open competition. The Contracting Officer will consider quotations submitted by responsible sources in accordance with FAR 5.207(c)(16)(ii).
7. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based upon the Independent Government Estimate (IGE).

8. Market Research:
Market research consisted of a search of the Siemens website and information received directly from a Siemens representative. The result identified Advanced Computer Concepts and Software Information Resource Corp as authorized distributors. The business size of each authorized distributor was reviewed; both are large businesses under NAICS 513210.
9. Other Facts:
None.
10. Listing of Sources:
None.
11. Actions to Increase Competition:
No actions have been taken to increase competition, as adequate competition exists in this area.
12. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
